SAN DIEGO (KGTV) -- The effort to establish a new independent police commission in the City of San Diego appears to be heading to victory.As of Wednesday afternoon, Measure B was leading with roughly 75% voting yes.There is currently a Community Review Board on Police Practices, but supporters of Measure B said that body is far from independent.“Their legal council is the city attorney, who represents both the Police Officers Association and the CRB so it represents a true conflict of interest,” Maresa Talbert with San Diegans for Justice told ABC 10News back in June.Proponents of the new Commission on Police Practices said they have been waiting for years for this to be a reality.“A lot of people will look at this and think, oh look, it happened overnight. Well, no,” said Martha Sullivan, one of the early members of Women Occupy San Diego. “It took nine years of very persistent [and] consistent, research, education, [and] lobbying.”One of the goals of Women Occupy San Diego ended up being police reform after the Occupy San Diego protests in 2011 and 2012. Sullivan said they submitted complaints to the review board at that time, but many of those complaints were lost.Since then, the push for an independent police commission grew. “This measure is the epitome of strength in numbers. It is the epitome of community support,” said Andrea St. Julian with San Diegans for Justice. She helped write the charter amendment that ultimately became Measure B.The Community Review Board will be dissolved and the new commission will be formed, once election results are certified. The commission will have independent counsel, subpoena power, and the ability to review officer misconduct and make recommendations.“They'll have greatly expanded powers, a lot more responsibility, and a lot more freedom to do the right thing,” St. Julian said.Jack Schaeffer, President of the San Diego Police Officers Association, said the POA took a neutral stance on Measure B.“We trusted the voters to decide on the type of oversight that they believe is necessary. SAN DIEGO (KGTV) -- The Carlsbad Police Department released body camera footage Saturday night in response to public concerns over officer misconduct during an incident involving a 27-year-old black man.The June 11 incident gained attention after cell phone video surfaced showing officers using a Taser on the man and pressing his head into the pavement in an attempt to subdue him."A video is circulating showing a police use of force incident from Thursday night. Open lines of communication between the Police Department and the community are more important now than ever," Carlsbad police said in a statement."As with all uses of force, we fully investigate incidents to ensure the officers’ conduct is consistent with the Police Department’s policies," police said.The cell phone video doesn't show the start of the incident. The witness video begins with the man on the ground surrounded by paramedics and two officers lying on top of him.The newly released six-minute body cam video starts from the moment two officers respond to the scene. According to the department's timeline of the incident, officers and paramedics responded to a call at 8:48 p.m. about a man found face down on a sidewalk at Ponto Road and Carlsbad Boulevard."Two officers arrived and found the firefighters evaluating the man, who was now standing," police said.Bodycam footage shows the man talking with paramedics, and the group appears to disperse. With the officers approaching, the paramedics step away from the man. The man tells the paramedics, "I'm not complaining about anything else."The man appears to hear something from the group of paramedics and screams out, "are you mocking me?"A paramedic tells the man, "No, I'm not mocking you at all."One officer says, "Hey, they're just here to help you, man."The man stands face to face with the paramedic telling him, "the way he said it is different from how you said it. Because I understand how the f--- you say it. But what do you mean when you say it?"According to the police timeline, "The man walked quickly toward the medics while continuing to yell profanities. Officers, fearing for the safety of the medics, interceded."The report says, "Officers reached out to the man and told him to stop."A struggle ensues and the body cameras are knocked to the ground leaving only an audio recording of the incident for about two minutes. The officers pick up the cameras and resume video recording the scene about two minutes later.The department juxtaposed three camera angles of the confrontation with the man -- two from officer body cameras, and one that was recorded by an unidentified "resident." The witness video fills in a section of lost body cam footage.Carlsbad police said the investigation is still ongoing and are asking the public who may have witnessed the incident to contact the department at their non-emergency line at 760-931-2197.The man in the video, Marcel Cox-Harshaw, 27, of San Diego, was cited and released for resisting arrest. Police also charged him with being drunk in public. He was not injured, but he continued to shout angrily. Officers asked him to calm down, but he refused to comply and continued shouting.At 9:03 p.m. Officers considered the man detained.A mesh bag called a spit mask was placed on the man’s head to protect the officers and paramedics from coming into contact with droplets coming from the man’s nose and mouth This bag is porous and does not restrict breathing.At this time, paramedics were able to place the man on a gurney, where he continued to yell and struggle.At 9:07 p.m. Paramedics transported the man to a local hospital where he was sedated, assessed and released.The man, 27-year-old Marcel Cox-Harshaw of San Diego, was cited and released for resisting arrest. An additional charge of drunk in public has been presented to the District Attorney's Office. The initial investigation indicates that drugs and or alcohol played a role in the incident.The investigation is still ongoing. We are asking any community members who may have witnessed the incident to call the non-emergency police number at 760-931-2197 to share their accounts.Here are some of the department’s policy that pertain to the incidentOfficers shall use only that amount of force that reasonably appears necessary given the facts and totality of the circumstances known to or perceived by the officer at the time of the event to accomplish a legitimate law enforcement purpose.When determining whether to apply force and evaluating whether an officer has used reasonable force, a number of factors should be taken into consideration, as time and circumstances permit. These factors include but are not limited to:o The apparent immediacy and severity of the threat to officers or others – Mr. Harshaw charged unarmed fire personnel while yelling profanities.o The individual’s apparent ability to understand and comply with officer commands – Mr. Harshaw would not comply with officer commands.o The conduct of the individual being confronted, as reasonably perceived by the officer. Mr. Harshaw was yelling and behaving aggressively toward fire personnel.o Proximity of weapons or dangerous improvised devices. – Officers had no way of knowing what was in Mr. Harshaw’s backpack or baggy pants.o The effects of drugs or alcohol. Mr. Harshaw appeared to be under the influence of drugs and or alcohol.o Whether the person appears to be resisting, attempting to evade arrest by flight, or is attacking the officer. Mr. Harshaw was at no time compliant.The TASER device may be used in any of the following circumstances, when the circumstances perceived by the officer at the time indicate that such application is reasonably necessary to control a person:o The subject is violent or is physically resisting. Mr. Harshaw was physically resistant and behaved aggressively toward fire personnel.o The subject has demonstrated, by words or action, an intention to be violent or to physically resist, and reasonably appears to present the potential to harm officers, him/herself or others. – Mr. Harshaw charged fire personnel, while yelling profanities and he was not compliant with officer commands.Supervisory notification shall be made as soon as practicable following the application of force. A supervisor was immediately called to the scene and an investigation was opened. SAN DIEGO (KGTV) - The Florida school shooting is conjuring painful memories for an uncle who calls his nephew the "14th Columbine victim.""You get choked up and then you're mad," said Tim Barnes.It was a flood of different emotions, as Barnes watched coverage of the tragedy in Florida.April 19th, 1999, as news broke about the massacre at Columbine High through frantic 911 calls, the San Diegan had his nephew Greg on his mind: A Columbine High student and one of the top basketball players in Colorado.Greg did survive the shootings, but one of his best friends did not. Greg was among several students who tried to keep the girl's basketball coach alive."From my understanding, he was holding Coach Sanders when he bled to death," said Barnes.Two months later, Barnes sat down with his nephew.    "Everything's cool. I'm good. I'm fine. Don't really want to talk about it. And that scared me. SAN DIEGO (KGTV) — Tens of thousands of unemployed San Diegans are about to see the biggest chunk of their income disappear. That's because the extra 0 in weekly unemployment payments from the Federal Government are expiring this month. The loss will reduce the maximum weekly unemployment paymeny to the 0 that comes from the state. City Heights resident Abby Heilbron is about to see her weekly checks go from ,050 to 0. Heilbron, whose husband is still working full time, said a dozen of her friends moved out of San Diego during the pandemic, unable to afford the region's high cost of living."And it is going to be a really scary time for a lot of people here, very quickly," Heilbron said. The extra 0 was part of the Federal stimulus package passed by Congress and the president in late March. The state Employment Development Department says the payments will end July 25. Whether to extend the benefits is now a political issue on Capitol Hill. The loss of the income comes when San Diego County restaurants are not allowed to serve indoors, meaning one of the area's biggest sectors is not hiring. "I've heard the argument that this gives people the incentive not to work, but the problem is that there are fewer alternatives for those people to go work at," said Alan Gin, an economist at the University of San Diego. SAN DIEGO (KGTV) — The City of San Diego will consider making a significant change to the way voting is done, best known as "ranked choice voting."It would allow voters to list up to four candidates in order of preference, rather than just cast a traditional ballot for one candidate."It's a very interesting system that hopefully decreases some of the negative campaigning that we ordinarily see," Councilmember Mark Kersey, who supports ranked choice, told 10News Friday.In the proposed version of ranked choice that San Diego is considering, the top four candidates in each primary race would advance to the general election, rather than the top two. In November, voters would then rank the candidates by preference. If one candidate has more than 50 percent of the vote on first count, that candidate would win. If no candidate reaches 50 percent, the last place finisher would be thrown out. That person's votes would then be reallocated according to the voters' second choice. The field would continue winnowing until a candidate tops 50 percent.UC San Diego political science professor Thad Kousser says ranked choice allows voters to feel like they are not wasting their vote on a long shot, and helps avoid the idea of voting for the lesser of two evils. "It allows voters to take a sincere vote without throwing away the weight that their vote would have," Kousser said.Kousser also says ranked choice helps keep races from getting as negative. "It could give candidates incentive to play nice with each other, to be less negative in their advertising beceause they would love to be second place on every voter's dance card," he added.Kersey says the City Council will consider placing ranked choice on the November ballot, with the goal of making the change in 2022. If the council elects not to put ranked choice on the ballot, supporters say they will launch a signature drive to get the measure on the ballot that way.Other cities in California have already adopted ranked choice, including San Francisco, Oakland, and Palm Desert. The concept is also gaining steam elsewhere in the country, with Maine moving to ranked choice for statewide elections."There's a reason why people are looking at doing it this way," Kersey said.
