SAN DIEGO (KGTV) – A man was fatally shot by San Diego Police as officers responded to calls of vandalism in the Mountain View neighborhood early Monday morning.According to police, officers were called to the 300 block of South Pardee Street just before 4:30 a.m. after receiving reports of “a violent disturbance involving a weapon.”Residents at the home were woken up by a man they say ripped a metal curtain rod from the window and began breaking windows and other objects.“Fearing for their safety, they asked another resident to call 911. A neighbor also heard the commotion and called 911 reporting it sounded like someone was being tortured,” police said.When officers arrived, police say they gave the man directions in English and Spanish but received no response. According to police, that’s when the man crawled through a broken window before running towards officers with a metal pole.“Fearing for their safety, one officer fired a bean bag round, one officer fired a Taser, and one officer fired several rounds from his service pistol. SAN DIEGO (KGTV) - A judge decided Friday to place a sexually violent predator in the East County community of Boulevard. Michael Joseph Martinez, 64 has multiple previous convictions including child molestation and lewd and lascivious acts upon a child under 14, according to County Supervisor Dianne Jacob’s office.The judge added Friday that the sheriff’s department will be extra vigilant and security will be heightened.The judge decided to place Martinez at the Department of State Hospitals recommended location of 2135 McCain Valley Road. The schools closest to the address include Clover Flats Elementary School and Jacumba Elementary School, according to the San Diego County Sheriff's Department.A mother of one of the victims from 25 years ago spoke at the hearing saying, “I know that you can’t change the order and I’m glad that there’s going to be very strict ordering, but I hope this doesn’t happen to another child or family.”RELATED: Dianne Jacob slams proposed placement of predatorJacob said the placement would put public safety at risk. She adds that several sexually violent predators have been placed in East County in recent years and in some cases, the convicts ended up violating the conditions of their placement.In a letter to Judge David M. SAN DIEGO (KGTV) - A local family says they were fighting to get back thousands of dollars in family heirlooms. They only got answers, they say, after Team 10 stepped in. "It makes me sick. It's really emotional," said Jill Robertson of Escondido. We interviewed Jill with her son, Jon, and his girlfriend, Megan Gielczyk. Jill and Jon shared with us a few of the limited old pictures they could find of their family heirlooms.She pointed to a photo of her late father wearing a ring. It was one of the pieces of sentimental jewelry that she said her family had given to local jeweler Mark Himmel to redesign. Jon said he was planning to use one of the rings to propose to his girlfriend but he added that the proposal and engagement were put on hold because Himmel hadn't returned their jewelry. Records verify that Himmel operates Sa-Ling Jewelry Imports Incorporated in San Diego. The Robertsons said it was Aug. 12 when they gave him a down payment to redesign thousands of dollars in family jewelry. They said they had expected to have the job completed in two to three weeks, but we met with them almost two and a half months after they wrote out a down payment check."There's evasion. He's constantly evading," said Jill. Jon's girlfriend, Megan, told us Himmel hung up the phone on her. San Diego police confirm they showed up to Himmel's home, where he operates his business, to try to get answers. However, no one came to the door. Two days after Team 10 left Himmel a voicemail, the Robertsons said they got a priority mail package with some of the heirlooms, but not all of them. They said there was no explanation for the wait time or behavior. It was early last week when Team 10 started making calls and leaving voicemails for Himmel. None of Team 10's calls were returned.We made a second attempt to visit him in-person this Thursday and were successful. He told us he's sending out the remaining pair of earrings on Thursday and he will soon send a remaining gold nugget."It took two months this time because I handmade the ring," he told us.He spoke to Team 10 later over the phone. He said he was responsive to the Robertsons about his slight delays. He sent us what he said was a screenshot of a text exchange from mid-September when he notified them that the job would likely take another three weeks and they thanked him.  A representative with the California Franchise Tax Board notified Team 10 that Sa-Ling Jewelry Imports Inc. in San Diego was suspended on 07-03-2017 for unpaid liability with a current billable balance of ,336.81. The Better Business Bureau verified that the Robertsons filed a complaint. SAN DIEGO (KGTV) - A new report says San Diego Unified School District is losing nearly million a year due to the exploding number of charter schools.School districts receive funding per student. The report by the organization, In the Public Interest, found SDUSD loses nearly ,913 a year per charter school student, largely due to costs that cannot be reduced when a student goes to a charter school. SDUSD is the second-largest district in California.There are about 120 charter schools in San Diego County. Roughly 50 of those schools are in the SDUSD. Elva Barajas’ son attends a local charter school.“I liked what they were offering for the students. There were smaller classrooms… less than 25 kids in the classroom. It was more individualized for the students,” Barajas said.Miriam Rodriguez’s daughters go to traditional schools within SDUSD.“At the end of the day, the schools are in my community,” Rodriguez said.The report, called "Breaking Point: The Cost of Charter Schools to Public School District," analyzed three California school districts including San Diego.Superintendent Cindy Marten and SDUSD trustee Richard Barrera argued that local districts need more control over school charter decisions. Barrera said district leaders need to ask critical questions, including fiscal impact. Currently, he said they are not allowed to do so.“What is it bringing to the table, what is it adding to the mix of schools… but also, what is it taking away?” Barrera said.Michelle Anderson, Regional Manager for the California Charter Schools Association, said districts already have enough oversight. “This is really a misrepresentation of issues that came through from a report that was paid for by special interests. Charter schools are really not the bad guys in this issue,” Anderson said.Both sides agree that education funding goes beyond this particular issue, although they differ in the impact of charter schools. SAN DIEGO (KGTV) - A man from El Salvador has been granted asylum in the United States after having been sent back to Mexico to await his trial.According to his attorney, Narciso Cruz, the man is only the second person to receive asylum who had been sent back to Mexico due to the Trump administration’s Migrant Protection Protocol (MPP.)“This individual is a bit of a rarity,” said Cruz, referring to his client’s success in court.But his story is not a rarity.Marcos fled violence in El Salvador and did no want to use his full name for this story, still fearing the gang he fled in El Salvador.“They’re a terrorist group,” said Marcos.He became targeted earlier this year after he tried to help his cousin who was being recruited by the gang. After he interfered, he started receiving death threats.“They will kill you and your entire family,” he said.He traveled to the United States, crossing the border on June 25 somewhere near Tecate.He said he wandered in the desert for five days before he was eventually picked up by Border Patrol agents and taken to a holding facility. Within a day he said he was sent back across the border to Mexico where he would wait for his case to be heard.The Trump Administration implemented the MPP in January. Despite some pushback from the courts, the policy, also called “remain in Mexico,” was allowed to go forward.As of September 1, the U.S government has sent 42,000 asylum seekers to Mexico, according to the Department of Homeland Security.As for Marcos, his case is not officially done yet. The government reserved its right to appeal the court’s decision. They have until October 25 to file an appeal. 1659
