(KGTV) - California's nearly 3-year-old ban on single-use plastic bags may be having an unintended impact: a spike in shoplifting.In late June at Major Market in Escondido - just before closing time - two women are recorded sauntering down the liquor aisle, before they begin stuffing their bags. "They're putting in our high-end champagne. About a bottle," said night manager John Kuper.By the time they're done, they collect seven bottles of champagne and one bottle of vodka."They didn't establish eye contact when I said goodbye to them. Their purses looked awfully full," said Kuper.Kuper says when he later looked at the video, he saw them walk out without paying. "Makes me sick to my stomach. That's your profit coming out of the registers there ... We believe the same women may have come in a month before and stolen champagne," says Kuper.Kuper's market is not the only one feeling the pain, as these scenes become more and more common. The Neighborhood Market Association estimates shoplifting losses at local groceries has climbed from 25% to 30% since the ban became law in 2016. Kuper says with so many customers now bringing in their own bags, spotting shoplifters is a big challenge."If they walk out with their own bags, we can't check every bag," said Kuper.Hiring extra security at the door is pricey and risks alienating customers. But critics say there is vague guidance for what happens if there is a school outbreak.As states across the country weigh the risks of reopening schools this fall, the message from the White House has been loud and clear.Last week, President Donald Trump stated he would like schools to reopen, stating, “Yeah, I would like to see the schools opened, open 100 percent.”Most doctors, educators, and psychologists agree that going back to school would be in the best interest of students. But what happens if just one student contracts the coronavirus? Would that force a shutdown?Some health experts are wary.“Once you start getting into dozens, or even more kids and teachers starting to get infected, it's going to be very hard to keep that school open, said Dr. Ashish Jha, a professor of medicine and the director of Harvard University’s Global Health Institute.“We have to have really smart planning and we have to have a clear protocol for how to identify kids and teachers and staff who get infected and then know what to do when we identify them. I just haven't seen that kind of clear protocol yet.”Late last week, the CDC did issue new guidelines for school reopening. They include encouraging social distancing, spacing out desks and requiring face coverings.But the guidance leaves it up to states, schools and local health departments how to precisely handle an actual outbreak.“What we have is patchwork, not just across states, but even within states across communities,” said Dr. Jha. “States are turning over the responsibility to individual communities and saying, ‘You figure it out.’”Recommended strategies from the CDC’s guidelines include:Immediately separating staff and children with COVID-19 symptomsSetting up safe transport for anyone who is sick to their home or to a healthcare facilityClosing off areas used by a sick person, cleaning and disinfecting after 24 hours when possibleImmediately notifying health officials, staff, families and anyone who may have had close contact with an infected person while maintaining confidentiality lawsStill, there is concern.A recent survey from The Associated Press-NORC Center for Public Affairs Research found, “46 percent of Americans believe schools need major modifications to deal with the coronavirus pandemic, and another 31 percent think they shouldn’t reopen for in-person learning at all.”“We can open schools safely but key to that is making sure the level of community transmission is pretty low, so you don't have sort of raging wildfires in the community,” said Dr. Jha. “Because it's going to be very hard to keep those fires out of the school.” 2772

(KGTV) -- The Encinitas teenager bitten by a great white shark is thanking all who saved him and those who continue to support his recovery.It was nearly two months ago when 13-year-old Keane Webre-Hayes was attacked while lobster diving at Beacon's Beach.Webre-Hayes sustained substantial damage to his left torso and face. His humorous was broken, ball joint broke in half, and rotator cuff torn apart in several places. He also lost a significant amount of his deltoid and lat muscles.The 13-year-old underwent hours of surgeries and got 1,000 stitches."I feel really thankful to have my arm, to be alive, and I'm thankful to probably in the future help other people," said Webre-Hayes.He's now considering a career in lifeguarding. Those who helped him are on a long list of people he wants to thank.“The people that towed me in from the kayak, the first responders, the pilot, the doctors, the nurses, all the companies that have given me things, it's motivation to get back out there and do what I love, like surfing and skateboarding," said Webre-Hayes.His mother, Ellie Hayes, says she is grateful for the outpouring of support and financial donations which will help with ongoing medical expenses."It’s one of the ultimate tests, and I know that there’s a reason and meaning, and there’s good that we can do with it," said Ellie. "We don’t know what that is right now, we’re going through it day by day, but we're open and ready to make sure we spread the word of courage and strength."Webre-Hayes will continue physical therapy and could have additional surgeries in the future. 1620
Employers may soon be able to require workers who make tips to share that money with other staff. It's part of a new regulation from the Department of Labor.The agency says the rule could help increase pay for back of house staff, like cooks and dishwashers who have historically been excluded from tip pools.The rule says pooling is only allowed if the tipped employee makes the full federal minimum wage.Federal law allows tipped workers to make .13 an hour, as long as they earn enough tips to match the minimum. State laws vary on that point, though.The rule also gets rid of a guideline that said tipped workers must spend at least 80% of their time doing tasks that earn them gratuity.The National Restaurant Association has praised the rule, calling it a win for the industry because it clarifies laws under the Fair Labor Standards Act.“Today’s Department of Labor (DOL) final rule revising tipping regulations under the Fair Labor Standards Act (FLSA) is a year-end victory for the restaurant industry and its workers after years of litigation," said the National Restaurant Association in a statement. "The changes in this rule bring much needed regulatory clarification for the small business owners and their employees about what the law allows and requires. At a time when the restaurant industry is faced with instability, this rule provides renewed sensible regulations on tip-pooling and tip-credit standards.”We spoke to an employment attorney named Louis Pechman who founded WaiterPay.com. He said there may be some clarification in the rule, but that's not the big issue.“Tips traditionally have been viewed by management as kryptonite. Don't touch the tips, servers' tips, stay away. That's my money. Now you have a whole situation where servers, it's my money. The tip was left for me. Why am I paying a cook in the kitchen?” said Pechman.The Economic Policy Institute has estimated the rule would let employers take 0 million from tipped workers each year. That's based on numbers before the industry suffered under the pandemic.As Pechman points out, some local laws are very protective of employee tips and will supersede federal regulations.“So, it's important if you're analyzing the issue, is there a state regulation, is there a city regulation which gives more protection to workers than the FLSA does?” asked Pechman.The rule is set to go into effect in 60 days.
