SAN DIEGO, Calif. (KGTV) – A prominent harbor cruise company is continuing to operate despite being cited for violating a County health order. Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. Tuesday, a company spokesperson sent the following statement to 10News.“We are part of the Passenger Vessel Association, not recreational boating. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail. SAN DIEGO COUNTY (KGTV)-- Scattered showers sprinkled all across San Diego County Saturday, bringing with it up to a quarter inch of rain. While rain totals were not significant, it was the reason for hundreds of car accidents.At 11:40 AM, 10News found a passenger van flipped onto its side. The driver said he was turning onto the Home on-ramp on WB 94 when he hydroplaned and flipped over. With some help from good Samaritans, he was able to climb up out of the passenger side door. He was not hurt. There were no passengers. One of many solo spin-outs happened on the 163 S to the 8 E on-ramp. The driver said at around 12:30 PM, he lost control of his truck at the top of the loop, then smashed into the concrete barrier. He said he felt lucky he did not roll down into a 50-foot embankment like another car did just a few hours prior in the same spot.RELATED: Check today's San Diego forecast10News crews also saw countless fender benders and flatbed tow trucks roaming the highways. Mother nature also wreaked havoc onto herself. At around 2:30 PM, a tree toppled onto Northbound 805 near Plaza South.Branches partially blocked the slow lane until clean up crews arrived.By afternoon, the rain clouds started to concentrate over North County. A three-car crash happened along Westbound 78 near the Nordahl Rd on-ramp in San Marcos. The small red vehicle ended up mangled, and the Prius somehow climbed up an embankment. SAN DIEGO, Calif. — For months, health professionals have urged the public to help stop the spread of COVID-19, while promoting face coverings, social distancing, and hand washing.“We’ve known for a long time that this virus is an enveloped virus and has an outer lipid layer, and we know that it’s sensitive to agents that can disrupt this fatty outer shell. That’s why we ask patients and people to wash their hands with soap," said Dr. Kami Hoss, founder and CEO of The Super Dentists in San Diego. Throughout the pandemic, Dr. Hoss has also asked patients to swish some mouthwash before they sit down for care.“That’s just one more layer of protection we’ve added," said Dr. Hoss. Now, researchers at Cardiff University in the United Kingdom are learning some mouthwashes can kill COVID-19 within 30 seconds, at least in a lab setting. The study found mouthwashes containing .07 percent of cetylpyridinium chloride showed promising signs of combating the virus, as well as those with ethyl lauroyl arginate. But while these mouthwashes killed the virus in the lab, the virus is continuously replicating in humans. SAN DIEGO (KGTV): The San Diego Zoo got quite a surprise this week when one of its Siamang Apes gave birth.It was a surprise because zoo officials had no idea the mother, Eloise, was pregnant.The zoo confirmed the birth to 10News, saying Eloise had been on birth control.The baby was born Monday morning.SDSU student Francelia Amaya was there shortly after the birth. She has been observing the Siamang apes for the past few months as part of a project for her Anthropology class.Amaya says Eloise had been acting oddly that morning."She was really uncomfortable," says Amaya. "She was trying to find the right position. There were a lot of odd behaviors."Amaya got a few pictures and cell phone video of Eloise holding the new baby and swinging around the ape enclosure with the newborn in her arms.Eloise and the baby were taken out of the exhibit shortly after the birth, as was the father. All three are in observation right now.According to the zoo's website, Eloise is "is the best mom a young siamang could hope to have. She's had lots of practice, having given birth to seven youngsters over the years."The zoo says Siamangs are one of a few primate species that form permanent pairs. Eloise and the father, Unkie, have been together since 1987.There's no word from the zoo about how long they'll be kept out of the public eye. 1353

SAN FRANCISCO (AP) — A California state appeals court has thrown out the sole conviction against an immigrant who fatally shot a woman on the San Francisco waterfront in 2015.The 1st District Court of Appeal on Friday overturned a gun conviction against Jose Inez Garcia-Zarate because the judge failed to instruct the jury on one of his defenses.Garcia-Zarate was acquitted of murder in the killing of Kate Steinle, who was on a pier with her father when she was shot in the back in July 2015.The case of Garcia-Zarate, who was in the country illegally and had been deported five times, touched off a fierce immigration debate.He said he unwittingly picked up the gun wrapped in a T-shirt and it fired accidentally.Garcia-Zarate is in custody and facing federal gun charges. 783
