SAN DIEGO, Calif. (KGTV) - A former assistant at a local nursing home is accused of raping a disabled patient. In a story that you'll first see on 10News, Team 10 investigative reporter Jennifer Kastner discovered the patient was a stroke victim who uses a wheelchair. What may have happened behind the walls of the Paradise Hills nursing home is difficult to process. An accusation of rape seemed to have slid under the radar for almost a year, until now. It was a few months ago when 10News was tipped off about Reo Vista Healthcare Center, which touts being named one of Newsweek's top nursing homes and having a Medicare 5-star rating.This week, San Diego Police confirmed that detectives referred the case to the District Attorney's office, which is charging 26-year-old Ariel Chavarin-Camargo with forcible rape and a "lewd act upon a dependent adult by a caretaker". He is now sitting in a South Bay jail. According to state documents, it happened last February to a 58-year-old woman who uses a wheelchair and was living in the nursing home after suffering from a stroke and panic disorder. The documents report that the morning after the alleged assault, she reportedly came "crying" to a nurse, claiming that the night before, when she was returning from the kitchen and on her way back, "one of the CNAs (Certified Nursing Assistants) stated that one of her breasts was exposed." According to the documents, he “followed her and he exposed his private parts to her". She reportedly said, "the CNA raped her" for up to three minutes. A forensic exam reportedly found male DNA in her private area. According to the documents, when he was later questioned, he suggested that she came onto him but admitted "it happened” and “there was penetration". He reportedly said, "I feel bad. It happened so fast." Prosecutors believe that man is Chavarin-Camargo. He resigned after the reported rape. The administration of Reo Vista Healthcare Center sent 10News the following statement on Tuesday."We are grateful to local law enforcement and the District Attorney’s Office for successfully prosecuting this individual for their crime. Our team took immediate steps last February to suspend the individual, to notify, and to fully cooperate with authorities. We take all matters regarding patient safety and the conduct of staff seriously. Moreover, the actions of this individual do not reflect the values we hold at our facility. Our priority remains to provide the highest level of care for the patient and their families." Chavarin-Camargo’s next court hearing is scheduled for February 11th. 2603

SAN DIEGO, Calif. (KGTV) - A large San Diego Church is continuing to hold in person, indoor services despite orders from San Diego County to hold services in outdoor settings only. Awaken Church has gotten three cease and desist orders at different locations and also had an outbreak at one of those locations, according to San Diego County.County Supervisor Nathan Fletcher said the church is not cooperating with the county in regards to the outbreak at their Balboa location, so the county had to publicly announce the community outbreak and ask anyone impacted to quarantine. Typically, the specifics of community outbreaks would not be publicized, but he said the lack of cooperation from the church led to the public notice.“The Awaken Church in general has continued to be very defiant and continue to put the members of their church at a great risk and continue to not cooperate as we seek to investigate positive cases, which led us to the unique situation of publicly reporting that they did have a public outbreak at the Awaken Church,” said Supervisor Fletcher.Anyone who went to the location at 7620 Balboa Ave. between Nov. 15 and Nov. 22 is asked to quarantine for two weeks.Related: County asks Kearny Mesa church attendees to quarantine after COVID-19 outbreakSupervisor Fletcher said the county is trying to find a balance between respecting freedom of religion and also keeping the community safe.“We do recognize the first amendment role and I recognize the important role faith plays in our lives and in our community, particularly in a time of difficulty, which is why we work so hard to try and make sure that it is available, it just has to be available in a safe way,” he said.Glenn Smith is a Professor of Constitutional Law at California Western School of Law and also teaches at UC San Diego, and said there’s a chance churches could fight restrictions in court, but it depends on the circumstances. He said if a church is impacted by blanket rules for an area, they would likely not win in court. A church would have to prove that they were treated differently.“If religions are being treated in a nondiscriminatory fashion, in other words if there’s a general law that establishes how many people can be in a room or what are the conditions, and it happens to have an incidentally impact on religion, that’s not a special problem as long as government has a rational reason for doing that, that’s alright. It’s only when government discriminates against religion that a special level of review called strict scrutiny is required and government has to have a really really good reason for discrimination,” said Smith.He added that the makeup of a court will also impact any future decisions on religious freedom, saying when Justice Ruth Bader Ginsburg was alive, cases regarding religious freedom during the pandemic were found to not be discriminatory, however with the newly appointed Justice Barrett, it’s more likely the Supreme Court would rule in favor of a church. 3009

SAN DIEGO COUNTY, Calif. (KGTV)— With precipitation numbers up, participation numbers were down for outdoor events around San Diego County. But many who chose to endure the rain said it was worth the extra splash. It’s a rare sight in the heart of San Diego: kids sledding on a giant snowy hill at Montgomery Waller Park. For the Murillo family, it’s an annual tradition. “We go to see Santa Claus, we go to the little stores that they have there, and we come to sled down for a little bit,” mother Diane Murillo said. She and her children were bundled up while having fun at San Diego Snow Day. But this year, Murillo noticed that the crowds were much smaller. “It’s a lot smaller. It’s empty today. There’s actually parking,” Murillo laughed. She said the steady rain discouraged many folks from showing up. The City of San Diego even had to cancel Santa Claus’ helicopter fly-over of the park, due to inclement weather. Murillo also noticed that the snowy hill was very sludgy, and only about half its normal length. But by the looks of the children, the event was still worth it. Meanwhile, in the South Bay, there was a tent full of Christmas-themed games. From Candy Cane trees, ring tosses, to face paint, families enjoyed the free entertainment at the Chula Vista Children’s Faire. “It helps, because that way, we’re not getting wet while they are getting their stuff done and doing the activities. So it’s nice,” mother Felice Navarro said. Her neighbor invited her and her children to join them at the fair this year. The kids also had an option to splash around if they wanted, as they ran through an obstacle course as Chula Vista junior firefighters. Fun was not just reserved for children. Up at Liberty Station, hundreds of people waited in line to join the San Diego BBQ and Beer festival. 25-year-old Victoria Ransom was not going to let the rain dampen her birthday celebration. “We wanted to be able to double fist if that was a possibility. Hands-free rain protection,” Ransom joked. She said she bought eight rainbow-colored umbrella hats online, the moment she found out about the weather. “You drink, you eat, it’s great,” Ransom said. “I got a nice pour because it’s my birthday, and we’re having a great time.” 2243

SAN DIEGO, California — One year ago, life forever changed for Navy EOD technician Kenton Stacy and his family.He was in a Syrian hospital clearing IEDs when one exploded, leaving him with a two percent chance of survival. His comrades fought to save his life and did, but Kenton was left paralyzed and unable to talk.He's now receiving care at the VA Medical Center in La Jolla.“We’re all ready for him to come home, it's just been hard juggling being here, being with the kids," said Lindsey Stacy, Kenton's wife.The couple has four children, one with special needs.As they work through Kenton's recovery, the family was hit with yet another unexpected hardship.They've been renting their Chesapeake, VA home for the last two years, not realizing tenants were destroying the house.The carpet and blinds were destroyed as well as much of the hardwood floors. The tenants also smoked cigarettes in the home."I just couldn't believe that people would destroy someone else’s property like that, shocking and it hurt,” said Lindsey.She shared what happened on their Facebook page #StacyStrong.It didn't take long for the community to step up and help make it right, with members of the EOD community spending hours to repair the house.Real estate agent Julie Fish, wife of an EOD tech, also stepped up to help.She's going to help sell the house without taking a commission and has enlisted help for labor and needed repairs. "The EOD community, they really have made it that they're taking care of it and it's one less thing I have to worry about," said Lindsey. SAN DIEGO, Calif. (KGTV) -- The family of Crystal Odom filled a San Diego courtroom Monday morning to hear a judge sentence the man convicted of killing Odom in a drive-by shooting in 1995. The judge sentenced Aswad Walker to 15 years to life for Odom's murder, plus three years for gang ties. He was convicted of second-degree murder back in February for Odom's death. Two previous trials had ended in hung juries. Odom's parents spoke before the sentencing. Her mother called Walker a coward and told him he would get what he deserved in prison. When Odom's father, James Odom, spoke, the family became very emotional, tears and sobs could be heard throughout the courtroom. Odom said a burden was lifted off his shoulders and that the sentencing marked an end to a long ordeal. At the time of the shooting, Crystal was with her then boyfriend and her 10-month-old daughter. Her daughter and boyfriend were unhurt. 959
