There are tens of thousands of sexual assault cases that not only go untold, but unsolved. Joyful Heart Foundation is a non-profit fighting to get backlogged rape kits sitting on evidence shelves tested in order to clear more cases. The former "House of Cards" star has pleaded not guilty and did not attend the Monday hearing. If convicted, he could face up to five years in prison.The pretrial hearing in Massachusetts focused on the cell phone the accuser used to text his girlfriend and send a video during the alleged assault. The prosecution said it obtained data from the phone, which it shared with the defense, and returned the phone to the man's family.But the phone is now missing.Spacey's defense team wants to examine the phone itself, claiming that exculpatory evidence may have been deleted before it was given to police and prosecutors. One of his lawyers, Alan Jackson, told the judge they believe the accuser and his mother "deleted things off the phone....they sanitized the phone."After testifying he didn't delete anything from the phone, the accuser consulted with his attorney and decided to exercise his Fifth Amendment right against self-incrimination. On Monday, they reiterated that to the court in testimony.The accuser's mother -- Heather Unruh, a former TV news anchor in New England -- told Jackson she never instructed her son to delete text messages on his phone but did look at the phone herself before turning it over to police. She said she was looking for a video showing Spacey's hand down her son's pants because it was "very important."Unruh testified that "I deleted a few things," but she did not say exactly what. There was "no intent on my part," she said.Jackson showed her photos of her son drinking alcohol that were deleted. Asked if she deleted the pictures because they did not play into the narrative that Spacey plied his son with alcohol, she responded she was a mother looking at her son's phone for the first time and she saw things that "concerned" her."I didn't touch anything that was relevant to the case," she said.Jackson thundered back that "everything" was relevant.What happened to the phone?Legal filings by the defense say that during the alleged assault, the accuser sent text messages to his girlfriend from the phone, including a short video, and that the screenshots of the messages appear to begin mid-conversation.Some of the texts include the accuser telling his girlfriend: he got my number, he asked me to come out with him, he pulled my zipper down... he reached down my pants. They have a thumb drive and a forensic image of the accuser's MacBook, but he could not guarantee there were no deletions, Garabedian said.Civil lawsuit gets droppedIn another surprising twist, a civil lawsuit filed in June against Spacey was dropped last week.In court Monday, Garabedian said "because of the emotional aspect," the civil suit has been dismissed. Garabedian, referring to Spacey's accuser, said "he only wanted one roller coaster ride at a time."Later during the testimony of the accuser's mother, Jackson asked her if the civil suit was dropped because of a secret settlement. She emphatically answered no.Spacey's accuser, who was an 18-year-old busboy at a Nantucket bar at the time of the alleged assault, filed the civil complaint on June 26. In it, the accuser said Spacey bought him "multiple alcoholic beverages" before he forcibly touched and fondled his genitals -- the same allegations he made in the criminal case.The civil lawsuit accused Spacey of explicit sexual behavior and infliction of mental distress. Shooters in three different mass killings this year have posted manifestos on a little-known website where extremists gather to cheer on and recruit others. The 8Chan website has been down and then back online repeatedly since the mass killings in El Paso Saturday. A growing number of people studying mass shootings say homegrown extremists are organizing and recruiting like the way well-known terror groups such as ISIS or Al Qaeda have done, and they are using the 8Chan website to do it. Robert Evans doesn’t give off the look of someone who has studied extremists academically. The day he met us, he was dressed like a world traveler, wearing a TV, vest, jeans and boots. “I study how terrorist groups use the Internet to radicalize and recruit," Evans told investigative reporter Jace Larson during an interview Monday in Mexico City. Ten days ago, Evans was in Syria. He traveled to study extremist groups in Mosel, Iraq in 2016 and 2017. Since a shooter went on a rampage in March, killing 51 people in Christchurch, New Zealand, Evans has devoted much of his time to studying how three mass-shootings were connected to the 8Chan website. “8Chan went from a bunch of disaffected, misogynist videogame fans to outright neo-Nazis,” Evans said. The site started after users were booted from a similar, but slightly more regulated website called 4Chan, an image-based online bulletin board where users post and discuss images. 8Chan was developed as a place where any speech is allowed. Evans showed how users freely post violence, anti-Semitic themes and race-related extreme views. Pro-white nationalism images are easily found. Robert was among the first to find a connection between 8Chan and three 2019 mass killings: the Christchurch massacre in March, the Poway synagogue shooting outside San Diego in April that injured three and killed one, and the shooting in El Paso that killed 22 Saturday. The killers appeared to have left manifestos in each case on the 8Chan website before the killings. Killing on 8Chan is sometimes likened to a video game. The phrase “beating his high score” is used to refer to anyone who can kill more than a previous killer. As evidence of this phenomenon, Evans points out that the Christchurch killer livestreamed his bloodbath with a first-person point of view from a helmet cam. “There's a reason that the Christchurch shooter livestreamed his massacre for the people at 8Chan, and there's a reason that he put together a music list that was full of songs that were like related to in jokes within that community,” Evan said. On the site, readers also talk about something called “replacement theory,” which is also referred to as “white replacement theory.” Some express a concern that the white race could be eliminated as more people immigrate from Mexico, other central American counties and elsewhere. “It's this idea that white people are going extinct because of immigration,” Evans said. He pointed out that he believes the theory is false. USERS LOOK TO TWEETS FOR VALIDATION The views of many on the site would have been considered in the past, even by users, as extreme and not shared by the public.
