Poway, Calif., (KGTV)-- The City of Poway's water boil advisory was officially lifted on Friday, but the inconvenience continues for many residents. Tenants of two dozens units at the La Privada Apartments are being evicted suddenly after management discovered rain damage. When it rains, it pours, especially for Poway resident, Allan Moore. "We have a week left," Moore said. "We have to be out by the 15th."Right in the middle of last week's city-wide water boil advisory, he and tenants in 23 other units at the La Privada Apartments were surprised with an eviction notice. It said they must leave the premises and turn in their keys by December 15, 2019. Moore said management explained that the same set of storms that destroyed the city's water system caused the water damage to the units. According to the notice, Moore will get his security deposit, December, and part of November's, rent paid back."I'm very clueless about it right now," Moore said. "And I haven't had hardly any communication."According to law experts, people in Moore's situation do have rights. Laws state that the landlord or property manager must give "reasonable" time for tenants to move out. The specifics of that time frame are in the provisions of the leasing agreement. In Moore's case, the property manager or tenant has the right to terminate a leasing contract if repairs are expected to take longer than 60 days. In this case, management company, Capital Growth Properties, states the repairs could take up to six months. How much assistance the landlord gives, such as finding new or temporary housing, is up to the property manager. Experts told 10News, in some cases, if the management companies own other properties, they may relocate tenants into unaffected, open units. However, Moore says he has not heard of this option from Capital Growth Properties. The rest, such as additional living expenses and food during the inconvenience, is up to their renter's insurance. In the meantime, Moore's house is a mess. "Christmas has kind of been put on hold," Moore sighed. A nutcracker and one sad set of lights are the only signs of the holidays in the usually festive home. "We're just going to have to take it down before Christmas, so we're like, 'let's just stop decorating,'" Moore said. Moore just hopes they find a place soon before they get kicked out. "We are just going to try to play it by ear and take everything one day at a time," Moore said. 10News spoke to the on-call manager at Capital Growth Properties. (KGTV) -- Poway residents are expressing concern after Stoneridge Country Club closed without notice Wednesday morning.The club closed after voters defeated a measure Tuesday which would have rezoned the property to allow owner Michael Schlesinger to replace part of the club with 180 new condos.One member told 10News "I want the people of Poway to realize that it’s not just about losing golf. It’s about our home values and losing our history that we’ve had here for so long.”Her home sits directly adjacent to the course. She's concerned Schlesinger will stop maintaining the property, turning it into a major fire hazard.Several other residents also expressed worries about vagrants setting up camps on the vacant course and that overgrowth could lead to a spread of coyotes in the area.Those fears are stoked, the residents say, by what has happened at the Escondido Country Club, also owned by Schlesinger.The club has gone to waste in the four years since he made the decision to close it and Poway residents worry they're about to be victims of the same fate.Club members tell 10News there has been no communication from Stoneridge about the closure.Many members paid their 2018 dues in advance and fear Schlesinger will not refund their money.10News contacted a spokesperson for Schlesinger, who replied with a statement:"We are on day 2 of the process of closing a business that has been open for 60 years. Our employees were our first concern, and now we are just beginning to figure out details. President Donald Trump plans to announce his Supreme Court nominee on Saturday. Wade debate isn't all about the Supreme Court.“Enough lower courts have not decided what they think about this,” said Carol Sanger, a professor at the Columbia law school. “We, the Supreme Court, doesn't like to lead on a particular issue until the lower courts who have trials and so on have thought about it.”Under a conservative majority, the Supreme Court has ruled on an abortion case. Conservative Chief Justice John Roberts sided with a ruling that kept abortion clinics open by not requiring abortion doctors to have nearby hospital admitting privileges.The high court already ruled on a similar case out of Texas.“There is a special doctrine called stare decisis, which means when you have a case and it’s like a previous case, look to that previous case and say how did that come out,” said Sanger. “And unless there is a very, very strong reason to change that decision, you follow precedent, you follow what happened the last time this issue came up.”Sanger says enough lower courts have to rule and be split on the decision to make it to the Supreme Court.The Supreme Court would need to decide it wants to take up Roe v. Wade before courts before them. Sanger believes that's unlikely to happen.“It seems pretty clear that he doesn't want to be known as the guy who had Roe knocked out under his chief justice-ship,” said Sanger.Both Justices Kavanaugh and Gorsuch said they accepted Roe v. Marco was heading for a possible hit on the Louisiana coast. Tropical Storm Laura, another potential hurricane, battered the Dominican Republic and Haiti and headed to the same part of the U.S. coast.
