DENVER (AP) — A Colorado police officer will not face charges for fatally shooting a homeowner who had just killed an intruder inside his suburban Denver home, prosecutors said in a letter released Monday.Adams County District Attorney Dave Young described Richard "Gary" Black's death as a "harrowing tragedy" but said his role was to determine whether the Aurora Police officer who shot the 73-year-old Vietnam War veteran was justified in using deadly force.Based on witness interviews and more than 90 videos captured by officers' body cameras, Young said Officer Drew Limbaugh did not know who Black was and fired when the homeowner refused police commands to drop his handgun.Young said Limbaugh's belief was reasonable and prosecutors cannot prove that the officer was not justified in firing. He said there also is no evidence that Limbaugh was reckless or criminally negligent."Officer Limbaugh engaged in conduct that was consciously focused on minimizing the risk to public safety," Young wrote.At the time of the shooting, Young said police did not know that Black had woken after midnight to investigate banging sounds and soon heard his 11-year-old grandson screaming as an intruder attacked him inside the bathroom. Police also did not know that the intruder, later identified as Dajon Harper, was lying on the bathroom floor after being shot twice by Black, he said."The evaluation of Officer Limbaugh's reasonable belief must be based not upon what we now know, but the circumstances as he perceived them at the time: hearing gunshots and then seeing an armed man emerge from a back room who refused commands to drop the weapon," Young wrote.The witnesses and police officers interviewed by investigators paint a chaotic scene. Young said police arriving at the home in Aurora around 1:30 a.m. on July 30 had little information and no description of a suspect.Within seconds, he said police heard gunshots inside the house and saw Black come into the hallway holding a handgun in one hand and a flashlight in the other. Young said the body camera footage shows police repeatedly told Black to drop his weapon before he came toward officers, raising the flashlight, and Limbaugh fired three times.Police have said Black had hearing impairment due to his military service. Young wrote that Black may not have heard the commands or recognized the officers as police but said that does not change Limbaugh's "reasonable belief that Mr. Black presented a threat."Witnesses told police that Harper was at a party at a family member's home nearby and may have been using drugs. Early that morning, he ran away and apparently broke down the Black family's front door.Black's grandson told police he woke up after feeling a cold breeze. He described walking toward his father's bedroom but then seeing a stranger showering as he passed the open bathroom door.The boy said the man grabbed him, locked the bathroom door and was strangling him before his father and grandfather were able to get inside the room.Harper, who was 26, died after being shot twice in the chest by Black. DENVER — Doctors are reporting a rare polio-like illness in children is once again spiking around the country, including in Colorado. Acute flaccid myelitis (AFM) is a spinal disease the can leave children with permanent paralysis. Health officials report 14 cases in Colorado so far in 2018.It's believed AFM is connected to enterovirus.The Colorado Department of Public Health and Environment said of the 14 cases diagnosed so far, 11 people tested positive for enterovirus A71, one tested positive for enterovirus D68 and two people tested negative for any type of enterovirus."While all the patients were hospitalized, nearly all have fully recovered. There have been no deaths," CDPHE's Shannon Barbare said in a statement.Children's Hospital Colorado saw a cluster of AFM cases in 2014, which led to more research into the rare disease. In 2016, KMGH profiled Kiko Violante, a 3-year-old boy who was diagnosed with AFM. At first all he had were typical cold-like symptoms."Runny nose, cough and for about a week he was like that," said Laura Violante. She wasn't too concerned — until he started having trouble walking."He just wasn’t walking the way he used to. I had to really support him," she said. "And then he couldn’t look at me. He started doing this rigid movement in his neck, and he couldn’t really turn."Colorado has previously had outbreaks of the less-common enterovirus types. Enterovirus D68 sickened 11 people with AFM. Enterovirus A71 caused similar outbreaks to this year's in 2003 and 2005, the CDPHE said."There is no vaccination or specific treatment for enteroviruses. People with mild illness typically need treatment only for symptoms," Barbare said in a statement. "However, some illnesses caused by EV-A71 and EV-D68 can be severe enough to require hospitalization."The CDC has a web page devoted to AFM. Democratic Sen. Bill Nelson on Sunday conceded the Florida Senate race to Republican Gov. Rick Scott, ending his re-election bid after the completion of a statewide recount.Scott announced the concession in a statement, saying, "I just spoke with Senator Bill Nelson, who graciously conceded, and I thanked him for his years of public service."Nelson will make a statement at 3 p.m. ET on Sunday, his campaign announced.The concession brings to conclusion a key Senate race that continued to be fought well after Election Day.The Senate race -- along with the governor's and state's race for agriculture commissioner -- went to a machine recount a week ago, but the recount did not do nearly enough for Nelson and further formalized Scott's more than 12,000-vote lead. The contest still fell within the .25% standard for a manual recount of overvotes and undervotes, however.Nelson conceded after the noon deadline for the manual recount, when all of Florida's 67 counties were required to submit their final vote totals to the secretary of state, meaning every vote deemed admissible by county canvassing boards and the courts had been officially counted.The results of the recount showed Scott with a vote lead of 10,033 over incumbent Nelson. Before the completion of the manual recount, Scott had a lead of 12,603 votes.Nelson's concession comes a day after Tallahassee Mayor Andrew Gillum ended his campaign for governor by acknowledging that Republican Ron DeSantis had defeated him. The concession was a blow to Nelson, given the two top Democrats had figuratively stood together in calling for every legal vote cast in Florida to be counted. DETROIT - The bodies of 11 infants were found in the ceiling of a former funeral home on Detroit's east side Friday evening, according to Detroit Police. Police say the bodies were found in a box and in a small casket. Cadaver dogs were on scene, and in all police found the 11 bodies of infants and stillborns. The Cantrell Funeral Home was shut down earlier this year due to several violations and "deplorable, unsanitary conditions." Police say a tip through the Michigan Department of Licensing and Regulatory Affairs (LARA) sparked the investigation. LARA reported Cantrell Funeral Home had 60 days to either assign its existing prepaid contracts to another person registered under the Prepaid Act and notify the Department and contract buyers of the assignment within 30 days of the assignment.The funeral home's other option was to cancel their current contracts and issue refunds to each contract buyer, providing copies of refund checks and correspondence to each contract buyer to the Department within 90 days, unless the Department modifies, vacates, or extends the terms of the Order.A spokesperson from LARA has released this statement regarding their investigation: 1228
