SAN DIEGO (KGTV) -- California’s new gig economy law was meant to help rideshare drivers and other freelance workers get better benefits, but some critics say it’s threatening the spirit of Christmas itself.Those critics are mall Santas, who have traditionally been hired as independent contractors through third-party bookers or employment agencies.Under Assembly Bill 5, authored by Assemblywoman Lorena Gonzalez (D-San Diego), those workers must be reclassified as employees with insurance and other benefits.“Lorena Gonzalez, she might kill all the Santas. She might kill the Easter Bunnies,” said Steve Schafer, the president of the San Diego chapter of the Fraternal Order of Real Bearded Santas.Some Santas warn that bookers may go to great lengths to avoid paying employee benefits. “I don't know how someone can justify this,” said Jerry Tamburino, a Santa who has worked for more than a decade at a large commercial store.Tamburino said his agent notified him Tuesday that she would replace him and other Santas at a chain of California retail stores with out-of-state St. Nicks.“That's what [the booker is] being forced to do to address -- or evade -- or stay in business with this stupid law,” he said.Bringing in out-of-state workers to skirt AB-5 would violate California law, since labor laws apply to anyone performing work in the state, said Gonzalez’ office. SAN DIEGO (KGTV) - Customs and Border Protection officials responded Monday to the arrival at San Diego’s U.S.-Mexico border of the first group of migrants from the caravan moving through Mexico.Some 85 people associated with the LGBTQ+ community are near the San Ysidro Port of Entry, according to journalist Jorge Nieto. Though, Wilson added a shutdown was worth ensuing more border security for him and other agents. "It's about darn time Congress do something about border security. They keep punting, and we're very, very tired of it. SAN DIEGO (KGTV) - California health officials announced Friday the steepest climb in positive coronavirus cases in history."When I'm worried I'll tell you so you can worry with me and we're there," California Health and Human Services Secretary Dr. Mark Ghaly said. He's worried hospitals could be overwhelmed if we don't stop the rapid spread of the virus."This rapid rate of rise could be even higher if we don't act soon," Dr. Erica Pan, state epidemiologist and deputy director of the California Department of Public Health Center for Infectious Diseases, said.Pan added that we could have a higher spike than we saw over the summer.Many are taking their words to heart and stocked up to stay home. San Diegans saw empty shelves and product limits this week across the county, but officials urge consumers not to worry."We didn't put limits on early enough. There's plenty of product in the supply chain and we just thought it would be better to be proactive because when people only buy what they need there's plenty of supply in the supply chain," said.
