CARMEL, Indiana — The family of a Carmel High School student who took his own life after getting in trouble at school has filed a lawsuit against the school district.Patrick McCalley got in trouble for a Snapchat message, showing a noose around the neck of an African-American schoolmate. McCalley died by suicide after the school had him sign an affidavit over the incident without his parents being notified.His parents are now suing the Carmel-Clay School District for negligence and for violations of due process of the Fourth Amendment's ban on unreasonable searches. 610

California regulators want to tax text messages to increase funds for programs that bring connectivity to underserved residents.A new surcharge proposed by the California Public Utilities Commission (CPUC) wouldn't be a per-text tax, but a monthly fee based a cellular bill that includes any fees for text-message services. Most carriers offer a flat fee option for texting, and already charge a similar fee for other services included in the bill — such as phone calls. The exact structure of the charge would vary from carrier to carrier.The commission will vote on the measure January 10, 2019, and is facing strong opposition from industry trade groups like the CTIA, which represents AT&T Mobility, Sprint, and T-Mobile. (AT&T is the parent company of CNN.)The 52-page proposal by CPUC Commissioner Carla J. Peterman lays out the details of the plan, and says the state's Public Purpose Program budget is going up while incoming fees to fill it are decreasing. Currently the surcharge rate is less than 7%.The proposed plan could be complicated by a new Federal Communication Commission ruling. On Wednesday, the FCC approved a new rule that classifies text messages as an "information service" like email. Proponent of the rule say it will give carriers the ability to crack down on spam messages, and critics say it could lead to carriers censoring messages.The CTIA argued in a legal filing submitted Wednesday that if texts are an information service, then the CPUC doesn't have authority over them and can't add on surcharges. It claims the proposal would go against federal law.The industry group also says the proposal would create inequity "between wireless carriers and other providers of messaging services," such as WhatsApp, iMessage and Skype."Subjecting wireless carriers' text messaging traffic to surcharges that cannot be applied to the lion's share of messaging traffic and messaging providers is illogical, anticompetitive, and harmful to consumers," the CTIA said in its filing.In light of the FCC ruling and other legal filings submitted to the CPUC, the group could change its draft proposal before the vote next month.According to the CPUC, the charges go to a number of different programs, including 911 services, subsidized phone service for low-income residents, and equipment for deaf and hard-of-hearing users. 2379

CBS Television Studios has released a statement after "NCIS" star Pauley Perrette implied that "multiple physical assaults" were the reason she quit the hit series.In a series of tweets earlier this week, Perrette -- who played forensic scientist Abby Sciuto -- talked about "tabloid articles out there that are telling total lies about me" and referenced her not "spilling the beans."She also mentioned "a very rich, very powerful publicity 'machine'" she also alleged was spreading false information about her before tweeting the reason she says she left."Multiple Physical Assaults," Perrette tweeted. CAMERON PARISH, La. – Hurricane Laura made landfall along the Louisiana coast, specifically near the community of Cameron. Not much information has come out from there, in part because several of the roads that lead down there remain flooded. Highway 27, one of the main roads in and out of the communities of Creole and Cameron, is covered in water.A deputy with the sheriff’s office said they had not been able to return to their station in Cameron. They left Wednesday before the storm.The roads are barely passable there – in order to get to an elevated bridge on 27, drivers need to use a gravel shoulder between the main road and the waterway that runs next to it. About 12 miles from the shore, the road begins to flood.It can be a little deceiving here in coastal Louisiana because the coast is made up of bayous and marshes.Some people have taken it upon themselves to bring their personal boats in an attempt to get to some of those communities along the coast.The sheriff’s office said some people did ride out Hurricane Laura in some of those coastal communities, but communications have been spotty at best. As for the roads, the water will need to recede, before the recovery there can truly begin. 1220

Charges have been dropped against the man accused of criminal homicide in the Opry Mills shooting.Chaos ensued when 22-year-old Justin Golson?shot at?22-year-old?Demarco Churchwell, who was taken to Skyline Medical Center in critical condition where he later died.Immediately after the shooting, Golson ran from the mall to a ticketing booth outside, placed his gun on the counter, and told the people inside to call 911. He told detectives he acted in self-defense after being threatened over social media by the victim and his friends.The mall was evacuated as police secured the area and investigated the incident.Court records show Golson's charge of criminal homicide was dismissed on Monday, July 30. 729
