BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer. The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case. The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record. The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed. On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled. The man did not receive a settlement to drop the civil case, his mother said. His lawyer said he dropped it because he was emotionally overwhelmed and wanted only "one roller coaster ride at a time" and so chose to focus on the criminal case. The man's mother, former Boston TV anchor Heather Unruh, alleged in 2017 that Spacey got her son drunk and sexually assaulted him at the Club Car, a bar on Nantucket where the teen worked as a busboy. The man told police he went over to talk to Spacey after his shift because he wanted to get a picture with the former "House of Cards" star. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. The man said he fled when Spacey went to the bathroom.Shortly after Spacey was charged, he posted a video on YouTube in the voice of his "House of Cards" character who was killed off after the sexual misconduct allegations emerged, saying "I'm certainly not going to pay the price for the thing I didn't do."Spacey has faced several other accusations. His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26. Spacey said he did not remember such an encounter but apologized if the allegations were true. The Associated Press does not typically name people who say they are the victims of sexual assault unless they identify themselves publicly. Rapp has; Unruh's son has not. 3783

Bill Cosby's retrial on aggravated indecent assault charges has been set to start April 2 in a suburban Philadelphia courtroom.Montgomery County Judge Steven T. O'Neill set the date in an order issued Friday. The order said jury selection questions and jury instructions must be submitted to the judge by March 15.The case centers on testimony from Andrea Constand, a former Temple University employee who accuses Cosby of drugging and assaulting her in January 2004. Cosby's attorneys argued that the sexual contact was consensual. 540

BONITA, Calif. (KGTV) - A nine hour standoff in Bonita has finally come to an end.Deputies have taken 37-year-old James Gilbert, who was wanted for a domestic violence incident, into custody. He has been booked into San Diego Central Jail on charges of making threats with a weapon, making terrorist threats and resisting arrest.Gilbert refused to come out of the home for hours.A San Diego Sheriff's Department SWAT team brought in two BearCats, made multiple flyovers with a helicopter and even called in a bomb squad. Two blocks of Allen School lane were blocked off all day due to the incident.Witnesses say a man believed to be the suspects brother tried running past the Sheriff's tape, ignoring deputies who tried to stop him. That man was handcuffed and taken into custody.Nearby Ella B. BONITA, Calif. (KGTV) - A City of Chula Vista spokesman said the city does not have any immediate plans to redevelop the Chula Vista Municipal Golf Course despite a report that showed roughly 2,700 homes built on the Bonita-area course.“For anybody to want to take it away, it’s hurtful,” exclaimed Bonita resident Xochitl Rouston.A report called “Redevelopment of the Chula Vista Municipal Golf Course” was shared on a Bonita Facebook group by a member who found the report online. The report outlines options to redevelop the area currently occupied by the course and parts of Rohr Park, which is in Chula Vista but borders Bonita.“Where are we going to take the kids?  Where are we going to go walking?  Where are we going to have our parties?” questioned Rouston who has lived in Bonita for more than 40 years.A Chula Vista spokesman told 10News the city completed a study in 2015 that said revenue at the course was declining and it wasn’t generating enough revenue to refurbish the course.  The report in question was issued so the city could “know what our options are should the golf course not be able to generate a return and pay for itself.” The spokesman emphasized the city is in the very early stages and there is no timeline for any projects.“We’re just trying to raise awareness, get everybody together,” said Rouston, who said they were surprised to learn any redevelopment was being considered. The Chula Vista spokesman said the Bonita residents would be notified of any discussions or meetings pertaining to the golf course or Rohr Park. 1594

BATAVIA, Ohio -- Some of Robin Hornberger's best students at West Clermont High School have two choices when it comes to college, and neither is ideal: Go into debt to afford the next phase of their education or abandon it altogether. "Our dream is that they can do what they want to do, that they can look at all the professions possible and pick their profession," she said. "But for some kids, it's just too expensive. … They would be having more debt per month than they would be making per month just starting a job."She wants to help them find a third option: Go to college with enough assistance -- no repayment required -- to make it manageable. That's why she's training every week and paying registration fees out of her own pocket to run in one marathon for each month of the next three years. She's already got two under her belt.Hornberger's marathons are a fundraiser and a way for her to draw attention to the difficult situation of economically disadvantaged students who want to better themselves through higher learning. Two months into 2018, she's raised ,000. By the end of 2021, she hopes it will be 0,000 -- enough to send one West Clermont graduate to college with an ,000 scholarship in hand for the next six years."One kid at a time is slow, but if you look into the future, 20 years down the line, that's a whole classroom of kids that have parents who have gone to college," she said. "That's pretty significant."Hornberger is running with support from sponsors such as Chipotle, Perfection Gymnastics and the Tri-State Running Company in addition to taking donations from individuals. Anyone wishing to support her mission and see her racing schedule can do so here."The vision is that they can be what they want to be, and then their kids will have parents who have been college," she said. "Once you get the first generation in college, it becomes more of a norm. That's what I want for our community." 1962
