OCEANSIDE, Calif. (KGTV) - A man was taken into custody in Oceanside on Monday morning after police say he broke into a short-term rental and sexually assaulted a woman. The sexual assault happened around 4 a.m. on the 800 block of South Pacific Street. According to police, Kwahmell Archer entered the home through an unlocked front door. Oceanside Police said there were 20 people inside the three-story rental when the suspect walked into a closet, got undressed and entered a sleeping woman’s bedroom. The 49-year-old woman woke up and screamed when the man grabbed her, waking up the rest of the house. Police said the suspect then ran back into the closet and was pinned inside by other people inside the house. Police arrived and took the man into custody. 773

(KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. OTAY MESA (CNS) - Border Patrol agents stopped a car in Otay Mesa and arrested five people, including a man who claimed to be a national guardsman from California, for alleged human smuggling, a Customs and Border Protection officer said Saturday.Around 3:45 p.m., Border Patrol agents stopped a car near the intersection of Alta Road and Otay Mesa Boulevard, according to Customs and Border Protection Officer Ralph Desio. The area is about a mile north of the U.S.-Mexico border.Agents interviewed the five people inside the car, all men, and determined two were U.S. citizens and the other three were undocumented Mexican nationals, Desio said.The driver of the car claimed to be a California National Guardsman in the process of separating from the service, according to Desio. California National Guard spokesman Lt. Col Jonathan Shirmo, however, told City News Service that the man was not a national guardsman, and was believed to be a U.S. Army reservist.The Army could not be immediately reached for comment.The five were all arrested, and the two citizens could face charges of human smuggling, Desio said.The three undocumented people were being held as witnesses in the case and will later face deportation proceedings, according to Desio. 1264

The team works to build trust among their homeless clients in hopes the trust will lead to them accepting help.Their client Joel relapsed after nine months. He wants help but can’t get a prescription after losing his ID. Thanks to recent city funding, a second social worker was hired to the team.A separate team works to tackle homeless encampments in the riverbed.
