In a statement released Wednesday, Fox News president Jay Wallace says the network supports CNN's lawsuit to restore one of its reporters "hard" press passes.Wallace also said the network would file an amicus brief on behalf of CNN today."FOX News supports CNN in its legal effort to regain its White House reporter's press credential. We intend to file an amicus brief with the U.S. District Court. Secret Service passes for working White House journalists should not be weaponized. While we don't condone the antagonistic tone by both the President and the press at recent media avails, we do support a free press, access and open exchanges for the American people," Wallace's statement read.Fox News joins the Associated Press, Bloomberg, First Look Media, Gannett, NBC News, The New York Times, POLITICO and the Washington Post. The E.W. Scripps Company, this station's parent company, also joined in filing an amicus brief on CNN's behalf."Whether the news of the day concerns national security, the economy, or the environment, reporters covering the White House must remain free to ask questions. It is imperative that independent journalists have access to the President and his activities, and that journalists are not barred for arbitrary reasons. Our news organizations support the fundamental constitutional right to question this President, or any President. We will be filing friend-of-the-court briefs to support CNN's and Jim Acosta's lawsuit based on these principals," E.W. Scripps said in a statement. The White House pulled CNN reporter Jim Acosta's hard pass last week after an incident at a press conference in which a White House staffer tried to forcefully grab a microphone while Acosta attempted to ask President Trump follow-up question. Trump had repeatedly told Acosta he was moving on to another reporter.Though the White House maintains that it was simply revoking his "hard" pass and that Acosta could continually apply for daily passes, he has been denied daily passes multiple times since the incident. On Tuesday, CNN filed a lawsuit against the White House, seeking the restoration of Acosta's hard pass on First and Fifth Amendment grounds. It's also seeking a preliminary injunction to allow Acosta to immediately resume covering the White House.A hearing on the lawsuit is scheduled for 3:30 ET Wednesday.  2366

In a memo sent to state governors, the federal government says that states should be prepared to begin distribution of COVID-19 vaccines to the public this fall. The memo signed by CDC head Robert Redfield told governors that the federal government has contracted with the McKesson Corporation to assist in distributing the vaccine to local and state health departments, medical facilities, doctor officers, and other vaccine providers. In the letter, Redfield requested governors to waive any regulatory barriers that would prevent McKesson from operating distribution facilities. Redfield said the goal is to have these facilities operational by November 1.According to McKesson, the company provides “next-day deliveries” to pharmacies and has a nationwide network of distribution centers. While there is urgency for both public health and economic reasons for a vaccine, some experts have expressed concern over the speed of a vaccine and whether the expedited timeline is long enough to demonstrate efficacy. Dr. Anthony Fauci told NBC News on Wednesday that he believes a “safe and effective” vaccine could be ready by the end of the year."I believe that by the time we get to the end of this calendar year, that we will feel comfortable that we do have a safe and effective vaccine," he told NBC News.On Monday, a third vaccine candidate entered “Phase 3” trials in the US. AstraZeneca is testing its COVID-19 vaccine candidate for 30,000 participants. The AstraZeneca vaccine would come in two separate doses, according to the National Institutes of Health.Even though a vaccine could be ready by year’s end, trials will be expected to continue for over a year to monitor for possible side effects.According to the FDA, a typical Phase 3 trial would take one to three years.“NIH is committed to supporting several Phase 3 vaccine trials to increase the odds that one or more will be effective in preventing COVID-19 and put us on the road to recovery from this devastating pandemic,” said NIH Director Francis S. Collins, M.D., Ph.D. “We also know that preventing this disease could require multiple vaccines and we’re investing in those that we believe have the greatest potential for success.” 2208

IMPERIAL BEACH, Calif. (KGTV) - Mayor Serge Dedina delivered the annual State of the City address Monday night. The mayor spoke to a room full of government, community, and business leaders at Burress Auditorium. The address, lasting about 30 minutes, highlighted the cities accomplishments and outlined a vision for the future.“We have one of the safest cities in San Diego County,” Dedina said when discussing the cities crime rate. He also talked about many of the infrastructure projects ahead, as well as affordable housing. The mayor also addressed the elephant in the room at the end of his speech; the ongoing issue of water quality due to Mexican sewage runoff. Dedina reaffirmed the community’s commitment to fighting for clean water and beaches.“I seem to be talking about clean beaches a lot, and since I'm a surfer, that’s fine,” he said, “But we need to redouble our efforts to expand our skate park and senior center and build a swimming pool and do all the things that most communities take for granted. He also talked about the need for more water quality testing and the lawsuit that IB has filed against the federal government, for its role in allowing raw sewage from the Tijuana ?River Valley to flow into local beaches.“We’re in court right now, the federal government twice tried having it thrown out of court, they lost. We’re going to continue to fight. If they’re smart, they’ll settle because we’re gonna win,” he added. 1454

In another sign of the times for retail, Lowe's is closing 51 North American stores. The home improvement chain said Monday that locations are underperforming and the decision will help the hardware chain focus on its most profitable stores and "improve the overall health of its store portfolio."Lowe's (LOW) is shutting down 20 stores in the U.S. and 31 in Canada. The company said that a "majority" of the shuttered stores are within 10 miles of another Lowe's location. The stores will be closed before Feb. 1, 2019. The company will try to find jobs at nearby stores for its employees affected by the closings."We believe our people are the foundation of our business and essential to our future growth," said CEO Marvin R. Ellison.Lowe's is struggling to keep up with its larger rival Home Depot. Ellison, who joined the company in May, has already made some big strategic decisions, including closing all of its Orchard Supply Hardware stores and slashing inventory at its Lowe's stores. The company cut its sales and profit outlook for the year. Its next earnings report is on November 20. 1102

House Speaker Nancy Pelosi and Rep. Jamie Raskin, D-Maryland, introduced legislation Friday that establishes a Congressional commission that would be able to investigate a President's health under the 25th Amendment. While President Donald Trump's health has come into question following his COVID-19 diagnosis, Pelosi and Raskin insisted that while Trump's health prompted their bill, it would not be used to remove him from office.Instead, Raskin said the commission would be a bipartisan effort that would be set up in case the health of other presidents came into question.Passed in 1967, the 25th amendment to the U.S. Constitution spells out the presidential line of succession. The amendment has four sections:1- When a president dies or resigns, the vice president finishes the term.2- When there is a vice presidential vacancy, the House and Senate votes to confirm a replacement nominated by the president.3 - When a president needs to temporarily cede power, he or she can hand the duties to the vice president who then becomes the acting president.4 - The vice president and a majority of secretaries can vote to remove the president if the president is "unable to discharge the powers and duties of his office. The section also grants power to a body "established by Congress" to invoke the amendment and transfer power to the Vice President.Raskin said his bill would establish that "body" that could investigate the health of the president. For Congress to invoke the 25th Amendment, the Speaker of the House and the President pro tempore of the Senate must provide "written declaration" that the President is "unable to discharge powers and duties of his office." Sen. Chuck Grassley, R-Iowa, is the current President pro tempore and will unlikely make such a declaration. In addition, the President could object to the Congressional body's findings. Reports surfaced later on Thursday that the House is planning to introduce legislation to institute a commission to evaluate the president's health.Pelosi then criticized the White House for not stating the president last submitted a negative coronavirus.“I think that the public needs to know the health condition of the President. There’s one question they refuse to answer. Before he got the virus and admitted to it, when was his last negative test? When was his last negative test? To make a judgment on the actions that were taken after that,” Pelosi said.Editor's note: A previous version of this story incorrectly stated that Congress has no authority to remove the president under the 25th Amendment. 2582
