Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758

(KGTV) — East County authorities are searching for a reported person trying to lure students at a nearby elementary school.El Cajon Police said officials at Flying Hills Elementary requested extra patrols Thursday over concerns of someone trying to lure students. Police said a 9-year-old boy was in an alley near the 1300 block of North Cuyamaca St. when a man approached in a vehicle. The man waved to the boy and said "get in the car." The vehicle was described as a red sedan, while the suspect was described as a white man in his 20s, with a mustache, red shirt, and black baseball hat.Police said they are aware of two other separate incidents as well. The first was on Tuesday in the 100 block of South Mollison Ave. A 12-year-old girl was approached by a man in a vehicle as she was walking to school. The man asked her a question and made a sexual comment before driving away, police said.The man was described as a white man, with balding dark hair, "scruffy" unshaven face, and possibly wearing a gray shirt and gray pants.The second incident occurred that same day just after 3:15 p.m. on Swallow Dr. A 13-year-old girl was walking home east of Finsh St. when man on foot approached her and said "come with me, I'm safe." He was described as a white man in his 40s, with a gray beard, short dark hair, and last seen wearing tan shorts, a dark shirt, black baseball hat, and black backpack.Police are investigating all three incidents, but said they do not believe they are related. Police have increased patrols in the area and at nearby schools.School staff from Lakeside Middle School also reported a suspicious incident as well just after 9:30 a.m. Thursday, according to the San Diego Sheriff's Department. Staff say one of their students was walking near Woodside Ave. and Winter Gardens Blvd. when he was approached by a man driving a blue car and told to get in the car.However, the student ignored the driver and kept walking to school, where he reported the incident.Anyone with any information is asked to call El Cajon Police at 619-579-3311 or San Diego Sheriff's at 858-565-5200. 2129

EL CAJON, Calif. (KGTV) - Vandals tagged two Catholic Churches in El Cajon with graffiti early Saturday morning, shocking parishioners."It's very devastating," says Father Daniel Shaba of the St. Peter's Chaldean Catholic Cathedral. "We fled persecution in Iraq, and here we are facing it again, in a place where we thought we wouldn't."Graffiti at St. Peter's, and also at Our Mother of Perpetual Help Catholic Church, featured swastikas, white power slogans, pentagrams, the Black Lives Matter acronym BLM, and the words "Biden 2020.""It was very confusing," says Father Shaba. "It had things that didn't have to do much with each other."Father Shaba found the graffiti early Saturday morning when he arrived at St. Peter's. He posted a video of it on twitter.Word of the vandalism spread fast, but help from the community came more quickly.By mid-morning, community members with power washers and paintbrushes helped Father Shaba clean up at St. Peter's. He told 10News everything had either been covered up or washed away by the afternoon and called the help a blessing."I'm very proud of them," Father Shaba says of his community. "We had an enormous amount of people come and see how they could help us in any way, shape, or form. But to also hold tight to Jesus."The Sheriff's Department confirmed they are investigating both instances. In a statement, they say no suspects have been identified, but there is "no tolerance for these crimes occurring in our communities."Father Shaba says surveillance cameras at his church caught high-quality footage of the vandals. He says they'll seek justice. He also has a message for the vandals."To the people who did this, we will pray for you. We will pray for your conversion and repentance," he says. 1759

  

EL CAJON, Calif. (KGTV) - The City of El Cajon is adding hand washing stations and sanitizing streets to stop the spread of hepatitis A.El Cajon officials are working closely with the County of San Diego to conduct vaccination events, said Assistant City Manager Graham Mitchell.San Diego public health officials said many of the Hepatitis A cases are in Santee, La Mesa and El Cajon.The City of El Cajon has 38 existing hand washing stations at city parks and is working to install more at Prescott Promenade, the county library, and trolley stations.RELATED: How can you tell if you have hepatitis A?El Cajon officials also requested that the MTS power wash trolley stations.For more information on El Cajon’s hepatitis A response, click HERE.  764
