NEW YORK — New York City residents may not be able to eat inside their favorite restaurant until next year.Restrictions around the rest of the state have been eased, but New York City Mayor Bill de Blasio is holding off on lifting restrictions on a number of indoor activities."If folks miss the theater, if they miss, you know, the indoor dining, those things will be back," he said Monday. "They'll be back next year at some point. I think that is overwhelmingly the case."He pointed to indoor dining and drinking at bars as a source of the spread of coronavirus cases around the world, but members of the restaurant industry are outraged. They pointed to a Bronx IHOP just across from a Panera Bread that's in Westchester County. Under current restrictions, the IHOP can't have customers, but the Panera Bread has been seating customers inside for more than a month.NYC Hospitality Alliance Executive Director Andrew Rigie warned that workers' livelihoods are at stake."The other week it was, we may not open until we have a vaccine. Then it's we may not open until the new year," Rigie said. The NYC Hospitality Alliance may pursue legal action over the issue. Rigie pointed to restaurants in just over the Queens-Long Island border in Nassau County that are open for indoor dining."Right now, you can sit indoors at a diner in Nassau county, but basically across the street in Queens, you can't," he said. "You can do the same thing in the Bronx. If you go into Westchester County, people are eating indoors. So is COVID somehow different there? I don't think so."Scott Hart, co-owner of 44 & X in Hell's Kitchen, said he was surprised by de Blasio's remarks on reopening Monday."It just doesn't seem like there was a real plan," he said. "To hear that today makes me feel like I don't know how we're going to make it through the winter."Hart spent money to create an outdoor seating area and is currently operating at 35 percent, but he's worried about the weather since colder temperatures are around the corner."If we close because of cold weather, what are we going to do? Put everybody in furlough again for five months again until spring? You know, it's really hard to start and stop and start and stop," he said.Outdoor dining isn't sustainable for his business, he said.De Blasio said he feels for the hurting business owners, but said he couldn't provide a specific reopening timeline."I've never for a moment felt anything but sympathy that these folks have built these businesses, often family businesses, that took immense hard work are suffering so much right now," de Blasio said. This story was originally published by Cristian Benavides and Aliza Chasan on WPIX staff in New York City. 2711

NFL defensive end Michael Bennett was indicted Friday in Houston on a charge of injury to the elderly in connection with an incident that occurred when he was a spectator at the 2017 Super Bowl, authorities said. The Harris County district attorney's office said Bennett rushed the field when the game ended to congratulate his brother Martellus Bennett, who played for the winning New England Patriots.Bennett was told to use a different field entrance, but he pushed through the security detail, which included a 66-year-old paraplegic woman in a wheelchair, Houston Police Chief Art Acevedo said at a news conference. The woman suffered a sprained shoulder in the Feb. 5, 2017, incident, Acevedo said."It's offensive to me that a man who's supposed to be an example, a professional athlete, thinks its OK to act like this," Acevedo said.Bennett's legal team does not have a comment at this time, Frank Perez, a member of the team, said Friday night. CNN reached out to Bennett for comment through his representative Doug Hendrickson but has not heard back.Harris County said the felony charge carries a penalty of up to 10 years in prison and a ,000 fine.Bennett was one of the most vocal NFL players in protesting the national anthem before games. He appeared on CNN and said he didn't understand why President Donald Trump would "stoop so low" as to say that NFL owners should fire players who protest.Bennett, 32, played with the Seattle Seahawks for five seasons and just signed a contract with the Philadelphia Eagles. He played high school football in Houston and college ball at Texas A&M University.Acevedo said Bennett's lawyer has been notified. The chief said Bennett has not been arrested yet but should turn himself into police as soon as possible. When asked why it took more than a year to file charges against Bennett, Acevedo said police had to prioritize more serious crimes. Also, Hurricane Harvey hit Houston in August, he noted.Acevedo said an officer at the game witnessed Bennett pushing the woman but decided to check on the elderly woman rather than immediately arrest Bennett, whom he recognized."We knew who the suspect was," Acevedo said. "We knew what he had done and we knew where to find him."The Philadelphia Eagles said in a statement Friday: "We are aware of the situation involving Michael Bennett and are in the process of gathering more information. Because this is an ongoing legal matter, we will have no further comment at this time."Last September, Bennett complained that police in Las Vegas unfairly singled him out, threatened him with a gun and detained him briefly after he attended a prizefight between Floyd Mayweather Jr. and Conor McGregor.Las Vegas authorities said officers were responding to a call of battery and assault with a gun that had turned into an active shooter situation and thought that Bennett might be involved. No charges were filed. 2920

NEW YORK (AP) — An annual tribute to John Lennon held in his adopted city of New York will go online like so many other events during the coronavirus pandemic. Organizers said there was no way they'd miss it, not on what would have been the former Beatle's 80th birthday and their 40th year of gathering to pay homage. The five-hour event will be streamed for free on Lennon's birthday, October 9, starting at 7 p.m. Eastern time on the LennonTribute.org website. “For 40 years, Theatre Within has remembered John with its heartfelt annual tribute, while having a powerful positive impact with its John Lennon Real Love Project music program for those impacted cancer," Yoko Ono said on the event's website. "What a wonderful way to honor John and his highest values!” It will feature recorded performances from Patti Smith, Rosanne Cash, Natalie Merchant, Jackson Browne, Jorma Kaukonen and others.Since there aren't any tickets being sold, contributions are being accepted for programs that benefit people affected by cancer. 1035

NEW YORK (AP) — Lawyers for the Girl Scouts say that the century-old organization is now directly competing with the Boy Scouts for female recruits and that it's not a fair fight. The lawyers filed papers Thursday in federal court in Manhattan to repel an effort by the Boy Scouts to toss out a 2-year-old trademark infringement lawsuit. Lawyers for the Boy Scouts last month asked a judge to reject claims that the organization is infringing on trademarks when it recruits girls with words like “scouts" and “scouting.” The Girl Scouts say in their filing that the Boy Scouts' marketing of expanded services for girls is “highly damaging.” 648
