SAN DIEGO (KGTV) -- A Team 10 investigation discovered a North County deputy was found deceptive to a question on a polygraph exam before he was employed with the San Diego County Sheriff’s Department.A transcript from a separate case involving the deputy, which is currently working its way through the federal court system, revealed this new information.According to the transcript from that case, Deputy Kyle Klein denied ever being associated with a white supremacist organization during a polygraph exam. The polygraph exam report indicated he was being deceptive to that question, the court transcript said.Klein is being sued for allegedly using excessive force against a North County man.The lawsuit filed by Thomas deLeon III alleges that in December 2016 he was thrown to the ground and repeatedly punched and kicked in the area of his head, face, neck and spine."Looked like he got beat up, like a whole bunch of guys punched him in the face," said deLeon's sister Marlene deLeon.Marlene said physical injuries aside, her brother is suffering emotionally. He was not up for an interview for this story, but his sister said wanted to tell his story. She said since his 2016 encounter with deputies he struggles to leave the house."What did he do to deserve that?” she still questions. "Why did he get beat up? Why did that happen?”According to court documents, deLeon was on his bike when deputies stopped him.“Thomas slowly retrieved his identification from his wallet and handed it to deputies. At all times, Thomas was standing over his bicycle with it between his legs. He was not moving in any direction. Then, suddenly and without warning, Thomas was violently slammed to the ground, his head hitting the asphalt/concrete,” his suit states.A bystander at a nearby fast-food restaurant captured the incident on camera, but the video doesn’t begin until deLeon is already on the ground."He produced his identification, a brief conversation took place and the next thing was he was thrown to the ground,” said deLeon family attorney Brian Cline.Cline said deputies claim at some point Thomas deLeon resisted arrest and that’s why things got aggressive.DeLeon's lawsuit filed against the county, the sheriff and arresting deputies and others claims once on the ground Thomas deLeon was handcuffed, offered no resistance, and then violently beaten."If you've ever seen a professional fight at the point where they stop the fight because it’s gotten too violent, this is where it started and then they continued,” Cline said.The Sheriff's Department wouldn’t discuss the case with Team 10 saying the department can’t comment. SAN DIEGO (KGTV) - A San Diego woman who was shot at the Route 91 music festival in Las Vegas is making great strides in her recovery.Tina Frost and her boyfriend were with eight friends when Stephen Paddock opened fire. Frost was the only one of her group who was shot. The bullet went into her eye.Her family says the recovery has been difficult but that she continues to power forward with her therapies.Frost’s mother posted an update on the GoFundMe page indicating Frost has walked without assistance, thrown a ball, baked cookies, and painted an eye patch for herself.Amy Klinger, a close family friend, says Frost's strength and resilience is no surprise."She is not going to let anything get in her way of getting back to her normal, happy, and healthy life," said Klinger.  "It was so amazing, I walked into the room and she was talking with her physical therapist and because her sentences were so clear, I did forget for a minute she had not been speaking."A lifelong soccer player, Frost has even been able to kick a soccer ball to her dad in the hallway."The fact that they did say at the very beginning, let's see what happens in a year, and it's only less than five weeks out and she's walking and she's talking, she's just, the progress has been amazing and is a testament to who she is," said Klinger.Klinger believes the worldwide support and power of positivity has been a factor in the healing, for both Frost and her family."Just knowing there's this enormous community, Team Tina, that's out there behind the family, it keeps their spirits up and keeps them positive because this is a lot to do deal with," said Klinger.Frost has a big surgery in the upcoming weeks where doctors will begin facial reconstruction. 1749

SAN DIEGO (KGTV) — After San Diego leaders passed an ordinance allowing people to sleep in their vehicles, a group of critics say they're ready to camp in front of the Mayor’s house to reverse course or address the matter another way."I don’t think they realize that vehicle habitations were the beach community’s biggest problem,” said Racheal Allen, who's a part of the coalition opposed to vehicle habitations on residential streets. The new coalition is fighting against the City Council’s decision to repeal a decades-old ordinance that had prohibited people from living in vehicles on city streets. Now that it’s legal again the group says vans and RVs are creating homeless camps in their neighborhoods.RELATED: Allowing homeless to live in vehicles is causing problems, residents say“We have literally witnessed buckets of waste being thrown out of some of these vehicles," Allen said. "I’ve seen drug dealing out of some of the vehicles, we’ve seen bike chop shops operating."All of this, just in the month that living in vehicles has been legal again. And the coalition has been hounding the Mayor’s office to change it. She proposed South Shores parking lot because of the 200 spots and access to bathrooms.Allen said she recently received an email from the Mayor's office saying, “we are actively pursuing a new ordinance to address the public’s concerns.”"We have to put our foot down," Allen said.Members of the coalition told 10News they don’t support a plan of using South Shores or anything that close to the beach because of the impact it could have on the environment. 2483

SAN DIEGO (KGTV) — A virtual job fair for Camp Pendleton Marines, their spouses, veterans, and members of the reserve and guard is set for Thursday.Organizer RecruitMilitary says more than 35 employers will attend, and more than 400 job seekers have already signed up. The jobs run the gamut from full to part-time, telecommuting, and include local and national employers. The City of Carlsbad and the San Diego County Sheriff's Department will be there recruiting. Other employers include Northrop Grumman, ADT, Spectrum and Eli Lilly. "We have employers that have made the transition themselves," said Jennifer Hadac, a Navy veteran organizing the fair for RecruitMilitary. "A lot of them are veterans themselves or military spouses or members of the military community, so they understand the challenges that they face, they speak the lingo, so it kind of bridges the gap for them."The nationwide Veteran unemployment rate is now at a seasonally adjusted 8 percent, the Bureau of Labor Statistics reports. SAN DIEGO (KGTV) — After receiving criticism from the Chicano Federation, UCSD Health officials met with the group Friday to review plans to recruit volunteers for a COVID-19 vaccine clinical trial.The Chicano Federations sent the following statement Thursday after hearing about UCSD’s plans to enroll approximately 1,600 volunteers to participate in the AstraZeneca COVIS-19 Phase 3 clinical trial:“Once again, the burden of COVID-19 is falling on communities of color. It is unfair that underserved communities who have the least access to information are now being targeted to participate in an experimental vaccine. This tactic, unfortunately, does not come as a surprise given that this country has a history of using people of color for experimental medical treatments. We did meet with UC San Diego, and we are going to be working with them in making sure that our community receives the education around these clinical trials.”Maldonado said community outreach would ensure that volunteers have all of the information necessary to make informed decisions.“When outreach is done in a way that is respectful to the community that different then some of the other approaches that other clinical trials are taking,” she said.UCSD made it clear that this trial is entirely voluntary, and consent forms will be available in English and Spanish.“I would just encourage anyone who has any questions or who might also be confused about the different trials and what’s going on, to contact the community-based organization that they know and trust to get some more information,” said Maldonado.The trial is expected to begin on Sept. 8.
