According to ABC 10News’ media partner Televisa, the state of Baja California has had almost 27,000 COVID-19 cases and nearly 5,000 deaths since the start of the pandemic.For comparison, San Diego County's had startling 97,549 cases but far fewer deaths. As of Thursday, 1,103 deaths had been reported.On Thursday morning, ABC 10News spoke to Televisa anchor Estephania Báez about how hospital capacities across the border are maxed out, pulling the city out of its less restrictive orange tier and back into its most restrictive red tier. That hasn’t happened since the summer.“The difference between now and then is that now people don't have fear with COVID-19 here and [people have] to go to work so they prefer to [become] positive rather than to lose a day of money,” she added.Baez said there's concern over both apathies to wearing masks and resistance to any news of a vaccine. “They don't even want to get vaccinated. The key word there is reasonable.“The problem with what's going on right now and some of the things that have been going around the internet, is that the advice, kind of spurious advice that's being put forth is to use the provision for reasonable accommodation as a sword rather than as a shield,” said David Tarrien, an associate professor at WMU-Cooley Law School.Tarrien says the conditions that qualify as a mask exemption have a smaller scope than many realize. For example, he says asthma patients likely do not fall under that scope. But later stages of pulmonary respiratory disease, emphysema, or a serious mobility issue can be "legitimate" reasons.Furthermore, you could face repercussions for lying.“If they're claiming that they have a disability and they don't have a disability, if that is found out, then there are criminal and civil penalties for that,” said Tarrien.As for privacy concerns, Tarrien says store employees are allowed to ask customers why they're not wearing a mask. If you refuse to answer, they may refuse entry.Even if you give a legitimate reason to not wear a mask, you may still be refused entry. That's because the ADA does not apply if there's a “direct threat” to someone's health or safety.Tarrien says HIPPA privacy laws also do not apply in this kind of situation. The coronavirus is only the sixth time a global health emergency has been declared.Compared to the previous five emergencies, experts say the coronavirus pandemic is easily the most severe.Here in the United States, we’re still far behind when it comes to recovery. Health security experts at Johns Hopkins University say we have seen some success in treating the virus, but there hasn't been much success in responding to it, especially when it comes to testing.“Many states did not invest in testing and many states did not invest in contact tracers, so when you see cases spiral out of control in certain states, it's not surprising to me,” Dr. Amesh Adalja of Johns Hopkins University said. “That's exactly the recipe you would set up if you wanted cases to rise.”Dr. Adalja says in order to tackle the spread of the virus, the US needs to prioritize testing, tracing and isolating.Health experts across the country have also signed a letter calling on the US to shut down the country and start over. The letter includes a list of recommendations for what's needed before cities can reopen. It calls for enhanced testing capabilities, more contact tracers and more personal protective equipment.Dr. Bill Hanage at Harvard University was one of those who signed the letter, and says safely reopening can happen, “If we look at countries like New Zealand, South Korea, then you can actually see that it is possible with sustained action to shut down, strangle the virus, throw it back to the sea, and then you can open with substantial amounts of normal economy.”Hanage adds that while it can be done, it's yet to be seen if the US is capable of doing this.The Association of American Medical Colleges has also offered a road map that would change the country's approach to the pandemic. Tour promoter Live Nation has announced its first-ever drive-in concerts series in the U.S. for July, months after the live music industry has been on lockdown due to the coronavirus pandemic. The entertainment company on Monday announced “Live from the Drive-In” — a set of nine shows to take place July 10-12 in three different cities. Brad Paisley will headline shows in all three cities, while fellow country artists Darius Rucker and Jon Pardi will also perform in Nashville at Nissan Stadium. Nelly will perform in Maryland Heights, near St. Louis.The 3-day concert series will take place at the Ruoff Music Center in Indiana and Hollywood Casino Amphitheater in Missouri - both are outdoor concert venues - and in the parking lot of Nissan Stadium, where the Tennessee Titans play. Each location will have LED screens and speakers around the lot, according to Live Nation. Ticketing is per vehicle with up to four people inside, and includes access to a parking space and adjoining "tailgate" area.
