ASU accuses the account of posting false and offensive statements about ASU, and its leaders."In several posts the owner of this account portrays ASU and its leadership as Nazis, referring to ASU's President Crow as Führer Crow and comparing ASU's mask requirement to forcing Jews to wear a yellow Star of David."The suit goes on to say ASU leaders have been pleading with Facebook, the company who runs Instagram, to remove the account, but have been unsuccessful."Despite actual knowledge of the infringement, and the ability to control and monitor the "asu_covid.parties" account on its platform – and contrary to its own terms, policies and community guidelines – Facebook continues to provide its Instagram service to "asu_covid.parties," which in turn provides the means of infringement.""Further worsening this situation, the initial investigation indicates that the parties behind this account may be located in Russia and are using the account to sow confusion and conflict and to interfere with the health of the Arizona State University community by trying to worsen the pandemic here."Living on campus, students like Justin Gutfeld believes most students hope to keep from spreading the virus among the ASU community, after seeing universities across the country reverse in-person learning after only days of students returning to campus."The last thing we want to do is spend all this effort like moving in to just move out again," he said. The Indianapolis 500 will be held without fans in attendance on Aug. 23 due to escalating concerns over the coronavirus pandemic in Marion County, the Indianapolis Motor Speedway announced Tuesday.It will mark the first time in the 109-year history of the Indy 500 that it will be run in front of empty stands at the 2.5-mile oval track.“As dedicated as we were to running the race this year with 25 percent attendance at our large outdoor facility, even with meaningful and careful precautions implemented by the city and state, the COVID-19 trends in Marion County and Indiana have worsened," a news release from IMS said.First held in 1911, the Indianapolis 500 is the largest single-day sporting event in the world with approximately 350,000 people annually packing the track's grandstands and infield to watch "The Greatest Spectacle in Racing." Running the race without fans prevents the seventh cancellation in Indy 500 history. The race was not held in 1917-18 during World War I, and from 1942-45 during World War II.In late March, IMS leaders rescheduled the race from May 24 to Aug. 23. Officials said on June 26 that Indy 500 attendance would be limited to no more than 50%.That number was further decreased on July 22 when plans were scaled back to host the race at 25% capacity. Face coverings would be required, and the Speedway released an 88-page health and safety plan that provided guidelines and protocols for how the race would be run in 2020.Even at 25% capacity, the race would have been the largest event held in the United States since the beginning of the coronavirus pandemic.IndyCar and IMS owner Roger Penske previously said he wouldn't run the race without fans, but the realities of the pandemic prevailed.“We need to be safe and smart about this,” Penske told the Associated Press. “Obviously we want full attendance, but we don’t want to jeopardize the health and safety of our fans and the community. Over the years, everyone from Billy Joel to Cheryl Crow to Jimmy Buffet has graced the stage here. But it’s the smaller, less well-known artists who truly rely on a black box venue like this one.“It’s a purist’s room. It’s just a great old school style place,” explained owner Chris Cobb.Since March though, Exit/In and thousands of other venues like it across the country have been shut down--forced to close their doors because of the coronavirus.“It’s just not safe. It’s not safe to do what we do right now, unfortunately, and there’s no pivot option. We can’t curbside a concert, we can’t to-go a concert,” Cobb lamented.It’s that kind of daunting reality facing owners of clubs, venues and smaller music halls across the country. Many have already run out of money and most are out of time. Aside from the 57 employees that Cobb had to lay off, there are also closed signs now popping up on businesses around the neighborhood who rely on live shows to bring customers in.“We’re on the edge of a cliff with a huge number of venues right there at the edge and about to go over, and they won’t come back,” he added.While it’s not a giant stadium, venues like Exit/In are the kind of spaces where smaller artists get their start. In cities across the country, independent venues are deeply engrained in the culture of the communities they operate in.For musician Daniel Donato, not having a stage like Exit/In to play on has been difficult.“I want to create memories that people can go back to. I want to be somebody’s Friday night. And the first thing a musician plays is the venue, they don’t play their instrument, they play the venue they’re in,” Donato said.In addition to the income he’s lost, the 25-year-old musician is also missing out on a chance to refine his craft. There are countless musicians like him across the country stuck in a kind of painful limbo.“I have to have the energy of the people in the room, take that, put it in a guitar and make it something great,” he added.By the end of the year, live performance venues are expected to lose about billion on ticket sales alone. Because of the impending crisis facing smaller venues, nearly 2,800 have banded together to form the National Independent Venue Association (NIVA).A stunning 90 percent of venues in the organization say they will close by the end of the year without any federal assistance.“It’s happening and every day that goes by is a risk that it happens more, people have run out of money,” explained Audrey Fix Schaefer, who serves as the director of communication for the group.In recent months, NIVA has created the "Save Our Stages Act." It’s a billion grant program for independent venues with bi-partisan support. Now, all they need is a vote in Congress.“People have run out of money and they’re running out of hope,” she added.As for Cobb, it's not just about the jobs that have been lost, it's about the music that the country may never hear if independent venues go silent forever.“It’s hard to think about American music without this network of independent music venues that have existed in this country for decades now. American music, as we know it, would not exist. I’m afraid that’s what we’re about to learn the hard way is it can’t exist the way we know it if these venues go away,” Cobb said.But for now, that's a song Cobb is trying not to write, hoping that the sun doesn't permanently set on some of the nation's most beloved stages. 3854

  

The Minnesota Police and Peace Officers Association broke its silence on Tuesday, saying it wants to set the record straight amid calls to disband the city’s police department.In a lengthy statement with comments from a number of members of Minneapolis’ police department, officers placed blame on the unrest on local politicians.“Crime won’t be wished away, and we can’t simply abolish or defund police departments. Politicians who suggest this aren’t serious about solving problems in their community,” said Rich Walker, officer and director of the Minneapolis Police Federation.Earlier this month, members of the Minneapolis City Council voted to disband the city’s police department. The vote came after the death of George Floyd while in custody of officers, which prompted massive unrest in the city.Councilmember Steve Fletcher said in a Twitter post that it’s time to “declare policing as we know it a thing of the past.”“Our city needs a public safety capacity that doesn’t fear our residents,” Fletcher said. “That doesn’t need a gun at a community meeting. That considers itself part of our community. That doesn’t resort quickly to pepper spray when people are understandably angry. That doesn’t murder black men.”The police union said it takes issue with how officers are being portrayed by politicians.“The only way we can begin the work to rebuild relationships and strengthen communities is if politicians stop characterizing law enforcement as violent racists and demonizing the police,” Sherral Schmidt, sergeant and vice president of the Minneapolis Police Federation, said. “There is a great deal of work toward building a safer Minneapolis, but it cannot happen until politicians stop pointing fingers and bring us all together to move us forward.”Minneapolis Mayor Jacob Frey, who opposes disbanding the department, said he takes issue with how the union can appeal terminations of officers through arbitration.“What's more disappointing is that the most essential change (the Minnesota legislature) could have made — preventing arbitrators from reinstating police officers who engage in egregious misconduct — was never considered,” Frey said this week.The police union said that the arbitration is something that the city and its officers agreed to as part of a standard practice for public employees.“The system of workplace justice – which is closely akin to our criminal justice system in many respects – requires that all public employees, even police officers, have the opportunity to contest discipline before a neutral third-party” said Schmidt.To read the full statement, click here. 2623

  

The New York state attorney general's civil lawsuit against the Donald J. Trump Foundation, President Donald Trump and his three eldest children can proceed after a state court judge on Friday denied their motion to dismiss the case.In her decision, Justice Saliann Scarpulla ruled that a sitting president can face a civil lawsuit in state court for actions not taken in his official capacity. That ruling puts Scarpulla in agreement with another recent ruling against Trump, a decision in the defamation lawsuit brought against him by Summer Zervos, a former contestant on "The Apprentice."And, Scarpulla said, it is in line with the US Supreme Court's 1997 ruling concerning President Bill Clinton in response to Paula Jones' sexual harassment lawsuit."Allowing this action to proceed is entirely consistent with the Supreme Court's holding in Clinton v. Jones that the President of the United States is 'subject to the laws for his purely private acts,'" Scarpulla wrote.As she did in court in October, the judge noted that Trump has appealed the Zervos decision, and if the appeals court rules in his favor, the attorney general's office would likely need to amend its lawsuit to remove Trump himself as a defendant.The Trump Foundation case is being considered in the New York Supreme Court, the state's trial court.The suit, filed in June, names as defendants the foundation, Trump and his children Eric, Donald Jr. and Ivanka Trump, all of whom sat on the charity's board. It alleges that they violated federal and state charities law with a "persistent" pattern of conduct that included unlawful coordination with the 2016 Trump presidential campaign.The attorney general's office, led by Barbara Underwood, is seeking to dissolve the Trump Foundation and wants .8 million in restitution, plus additional penalties. The office is also seeking to ban Trump from serving as a director of any New York nonprofit for 10 years and to prohibit the other board members, the Trump children, from serving for one year."As we detailed in our petition earlier this year, the Trump Foundation functioned as little more than a checkbook to serve Mr. Trump's business and political interests," Underwood said in a statement Friday. "There are rules that govern private foundations — and we intend to enforce them, no matter who runs the foundation."An attorney for the defendants, Alan Futerfas, said "the decision means only that the case goes forward. As we have maintained throughout, all of the money raised by the Foundation went to charitable causes to assist those most in need."He added: "As a result, we remain confident in the ultimate outcome of these proceedings."The judge gave the defendants 45 days to respond to the lawsuit. 2745
