SAN DIEGO (KGTV) - A local brewery's decision to use compostable can holders is the latest example of San Diego companies deciding to go green.Pure Project Brewery made the change last month, giving its customers an easier way to take home 4-packs of beer while still being environmentally friendly."You have to make that decision; do I wanna do the right thing, or do I wanna do the cheap thing," says Pure Project Co-Founder Mat Robar. He says every decision his company makes takes the environmental impact into account."It costs us a good amount of money to brew beer with organic and local ingredients, and sometimes it takes a little longer. Ultimately it's the right thing to do," says Robar.The new can holders are made of recycled grain, leftover from the brewing process. They biodegrade in 200 days. And, if they wind up in the ocean by accident, they're safe for animals to eat.Pure is one of the hundreds of San Diego companies emphasizing the planet over profits.Right now, the San Diego Green Business Network lists more than 200 local companies as members.Experts say it can help build a brand, attract a loyal customer base, and also help make money in the long run."The efficiencies of going green has significant business implications," says Heather Honea, the Chair of the Marketing Department at SDSU's Fowler College of Business."If you're trying to build a brand that's meaningful for consumers, you have to speak to the things they care about. Your brand has to be associated with the things they care about," says Honea.In California, that includes environmental impact."If I'm deciding between product a and product b, I'm choosing the product that not only delivers a certain set of quality attributes but also is going to have the impact on my local community or local environment that I think is acceptable," she says.Honea also says that investments in green technology and business practices may cost a lot of money upfront, but they tend to pay themselves off in the long run. She says that's especially true for companies that stay one step ahead of local and state laws.At Pure, they say protecting the environment is their "North Star," a guiding principle for everything they do."It takes a little bit of effort," says Cheyna Swartz, the Tap Room Manager, "But it's definitely worth it." 2331
SAN DIEGO (KGTV) — A Rancho Bernardo hotel hit hard by the loss of midweek conventions is taking new steps to fill vacant rooms."We were doing pretty good and then Labor Day came and we fell off a cliff again," said Jeff Livingston, who directs sales at the Rancho Bernardo Inn. Livingston says the number of employees has gone from the hundreds into the dozens, as the business conventions the inn depends on have all but dried up. Now, the Rancho Bernardo Inn deems success at 35% occupancy, a number that a year earlier was upwards of 90%. "During the week we're literally sometimes in single digits," Livingston said. "There are times where there are more staff than there are guests." The Rancho Bernardo Inn has plenty of company. San Diego's tourism industry has lost 52,000 jobs in the last year, a nearly 26% drop, according to data released Friday by the Employment Development Department. The region's unemployment rate was 9% in September, with jobs down 117,000 over the year. Lynn Reaser, chief economist at Point Loma Nazarene University, said hotels are seeing a few more visitors because of road trips, but that business will be limited until a vaccine arrives.Meanwhile, the Rancho Bernardo Inn has dropped its rates on Sunday nights through Thursday, in some instances offering two nights for the price of one. But that's not all it's doing. Livingston said he and other workers are knocking on doors, visiting businesses, and doing all they can to spread the word about the discounts. Additionally, the hotel converted one of its meeting rooms to a kids game room. It has also arranged for a bird trainer on weekends that brings an owl and a falcon, which eat rabbit meat off of a guest's gloved hand for . "No stone goes unturned and there really isn't a bad idea right now," Livingston said.Livingston said beekeeping could be next. He said if the occupancy rate can get to at least 40% and stay that way, more jobs could come back. SAN DIEGO (KGTV) -- A La Jolla store in an upscale mall is facing scrutiny from customers who told Team 10 they were misled after buying hundreds—even thousands—of dollars worth of skin care products.Team 10 spoke to at least two customers who had similar complaints. When they tried to return unopened products, they said they were sold lies.Christianna Ortiz regrets walking into Gold Elements at the UTC mall on La Jolla Village Drive.“I’m honestly very embarrassed I fell for it,” Ortiz said.Last summer, she said Gold Elements employees encouraged her to purchase products, including a skin care regiment.“He wanted me to buy it for 0. I said yeah, that's not going to work. He said I'll tell you what, I'll throw in a facial and I was like, now that sounds interesting, but I don't want to come here alone. I'll throw in two facials,” Ortiz said the employee told her.When she went to her appointment, she said employees would not give her the facials she paid for.“I said, I want to return the stuff then and he said no return.I said I paid for something that was an outright lie,” Ortiz said.Ortiz said they never told her there was a no refund policy.She disputed the charge with her credit card and could not believe what happened next.“They sent me back the copy of my receipt along with another sheet of paper that listed the refund policy. I had never seen that sheet of paper, didn't exist!” Ortiz said.“You’re hustled,” said Sharon Garrow, another Gold Elements customer.Garrow spent nearly ,500 on products in September. She admits spending more than she should. When she tried to return the products the following morning—less than 24 hours later—she said she was not allowed to.She went to the store Saturday, where she said an employee told her there was nobody who could help her. She went again on Monday. “He [said] there’s no return on [these] products,” Garrow said.It was on her receipt, but like Ortiz, she signed on a computer and said the policy was not visible on the screen. She said nobody told her anything in person and there were no signs in the store that customers could see.A Team 10 investigative photojournalist also visited the store. He also did not see any return policies in the store.On the California Attorney General’s website, it says: “Stores that do not accept returns must clearly display their policy.”The California Civil code states that retail sellers shall display their policy “either on signs posted at each cash register and sales counter, at each public entrance, on tags attached to each item sold under that policy, or on the retail seller’s order form, if any.”Goods that cannot be resold due to “health considerations” are an exception. Both women said they never opened the Gold Elements boxes before trying to return the items.When Team 10 visited the store to get answers, there were no managers available to talk to us. An independent esthetician told Team 10 to contact a Gold Elements promoter. That person did not call back.Less than an hour later, a man who claimed he was the owner called Team 10 and said they always give the best help to customers and have not had problems with refunds. The man would not agree to an in-person interview, saying that he was not in town.He told Team 10 all future communication would be with his lawyer, but would not give his lawyer’s name.It was a different story on the Better Business Bureau website, where the store has an F rating. A 2017 class action lawsuit filed in Northern California against Gold Elements products and affiliated companies.Part of the complaint was that “complimentary facials” were not honored when customers tried to use them.““If I got taken, so many other people are probably getting taken. Somebody has to stop it,” Ortiz said.Team 10 discovered the La Jolla store could also be violating different state code.On Gold Elements’ wall is a price list for facials. The Board of Barbering and Cosmetology, under the California State Department of Consumer Affairs, said a business that charges for facials should have an establishment license.The store has no record of that license.The women have a warning for others.“It’s not like I’m a dummy,” Ortiz said. “Do what I usually do. Check reviews ahead of time.”The Attorney General’s office said if any customers have concerns about a return policy, or lack of one, you can file a complaint with their office. 4419
SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial.
