SAN DIEGO (KGTV) - A San Diego County woman has filed a lawsuit against a local physician who she says used his own sperm to artificially inseminate her.The discovery occurred decades later after Beverly Willhelm and her husband sought out a fertility specialist in the late 80s.Instead of receiving anonymous sperm, she says the doctor used his own. Willhelm says her son, 23-year-old James Mallus, learned after taking a 23andMe DNA test that his biological dad was the same man that his mother consulted to become pregnant.Willhelm says she's now suing the doctor for fertility fraud in a civil lawsuit.Though Willhelm's attorney said the lawsuit was filed Wednesday, ABC 10News is not naming the doctor because we have not been able to confirm that with the San Diego County Courthouse.According to the lawsuit, the doctor still practices in San Diego County. The lawsuit claims that "the Defendant, without Plaintiff's knowledge or consent, used his own sperm to impregnate her."The suit goes on to say that "based on allegations regarding his mistreatment of numerous patients in 1992-93, Defendant surrendered his California medical license in 1999."The doctor's license was reinstated in 2004. Those allegations are not related to the current lawsuit or other instances of fertility fraud.ABC 10News has reached out to the doctor in the lawsuit, but have not heard back. SAN DIEGO (KGTV) -- A new report shows that a majority of San Diegans decide to move to the region before landing a job. According to Apartment List, more than 65 percent of San Diego metro renters are location-first movers who chose to move to the area prior to searching for a job. The report also shows that only 32 percent of San Diego renters plan to settle down in the area long-term. SAN DIEGO (KGTV) -- A San Diego gym owner said he is keeping his doors open despite state restrictions on indoor operations that took effect early Wednesday morning.For Shawn Gilbert, the owner of Boulevard Fitness in University Heights, keeping his business open is a matter of survival."I took a huge financial hit in May. Money out of my pocket that's never coming back. We have bills to pay, we have rent to pay,” Gilbert told ABC 10News.Gilbert said he believes his gym can operate safely with face covering and social distancing guidelines because it is a large, open space with high ceilings. The gym also has an outdoor space that Gilbert plans to also utilize.According to Gilbert, none of his gym members or employees have tested positive for coronavirus.Gilbert told ABC 10News he’s prepared for any possible citations for staying open."We have a lawyer with six other gyms, all representing us gym owners. SAN DIEGO (KGTV) -- A San Diego couple is challenging a luxury carmaker after their BMW SUV suddenly caught on fire. The Pearsons said they bought a BMWx5 in August 2018 because they thought it would be safe and reliable. In December, they replaced the battery at BMW of Escondido. The next month, Lisa Pearson was driving on Interstate 15 when she noticed a warning light showing an airbag and parking brake error. She pulled over and noticed smoke coming from the back of the car.“It happened so fast,” Lisa said. A fire had started from the rear of her vehicle. A passing tow truck driver stopped to help put out the smoke and flames. Firefighters told her it could have been a different story if her children were inside in their car seats. “It was really nerve wracking,” Lisa said. “I was really thankful since I saw that the fire was happening in the back of the car that the kids weren’t there.”They said their SUV was a total loss. It was after the fire that the Pearsons ran into even more problems. When BMW of North America inspected the vehicle, they blamed it on “an improperly secured connection of the battery cable." In the letter to the Pearsons dated February 29, 2019, Executive Customer Care Representative Michael Pigoncelli wrote, “BMW NA cannot accept responsibility for any damage, injury, or loss associated with the fire…” BMW of Escondido disagreed with corporate’s allegations, writing to the Pearsons that “the repair was done as per the BMW guidelines.” “It just seems that they’re pointing fingers at each other. Nobody cares about us or the consumer,” said Ryan Pearson. “It was still under factory warranty,” Lisa added, saying they hadn't even had it for five months. “What’s it going to take? Does someone need to die?” The Pearsons are not the only local couple to have their BMW catch fire. In October 2017, Laura Ohme said her parked BMW started a fire at the Torrey Hills homes where she lived with her family.She was in the shower when she heard a strange noise. “I just hear this really really weird popping kind of noises,ll ” Ohme said. With her two kids asleep in their rooms, she threw on a towel to find out what was going on. She went downstairs and saw smoke. “The door itself [was] literally black and glowing.”Ohme grabbed her two children and ran outside the house. “The fire, it was raging at that point,” she said.Fire investigators determined her recently purchased 2014 BMWx5 started the fire. It was a certified pre-owned vehicle she bought just a few months before. Ohme said the vehicle was sitting in the garage and turned off at the time of the fire. "I didn’t even put 5,000 miles on the car,” Ohme said. She said BMW has had a “non-response” to the situation. “BMW is not taking responsibility,” she added.While the Ohmes and Pearsons’ fires started under different circumstances, they shared things in common. Both BMWx5s were recently purchased just a few months before the fires. They both had warranties and neither vehicle was under a recall.ABC News started investigating mysterious BMW fires in 2017. Like the Ohmes, dozens involved vehicles that were parked and turned off. Since then, about 1.6 million BMWs have been recalled for fire risk. A BMW spokesperson told Team 10: "BMW notifies owners of vehicles affected by a recall via registered mail to advise them that their vehicle is part of an upcoming recall campaign and what the next steps are. BMW recently expanded its recall notification system for vehicles built after 3/2016 to allow owners to also be notified through the BMW Connected App on their smartphone. A vehicle recall may require that a part be replaced or software be updated." A spokesperson for BMW of North America told Team 10 they could not comment on the Ohme’s situation “due to litigation.” The Ohmes' attorney told me they are preparing a class-action lawsuit for the damages caused by the BMW fires.“I was able to get myself and my children out safely, but at some point someone is going to die,” she said.Regarding the Pearsons, BMW of North America wrote on March 22nd that they still believe the Pearsons’ vehicle caught fire because of “an improperly tightened battery terminal after a recent battery service.” The spokesperson added: “BMW is currently working with the dealer and the owner to resolve the matter.”In an email on March 22nd, a few days after Team 10 first contacted BMW of Escondido, the service manager wrote he “sent the Pearsons claim and contact info for [their] insurance company” and instructed their insurance to settle her claim as quickly as possible. They still disagree with BMW of North America’s findings. “We can’t let this go on and hurt other people,” said Ryan.“You are saying you are a very high quality company that sells very luxury cars, and yet your cars are catching fire. SAN DIEGO (KGTV) - A local family says they were fighting to get back thousands of dollars in family heirlooms. They only got answers, they say, after Team 10 stepped in. "It makes me sick. It's really emotional," said Jill Robertson of Escondido. We interviewed Jill with her son, Jon, and his girlfriend, Megan Gielczyk. Jill and Jon shared with us a few of the limited old pictures they could find of their family heirlooms.She pointed to a photo of her late father wearing a ring. It was one of the pieces of sentimental jewelry that she said her family had given to local jeweler Mark Himmel to redesign. Jon said he was planning to use one of the rings to propose to his girlfriend but he added that the proposal and engagement were put on hold because Himmel hadn't returned their jewelry. Records verify that Himmel operates Sa-Ling Jewelry Imports Incorporated in San Diego. The Robertsons said it was Aug. 12 when they gave him a down payment to redesign thousands of dollars in family jewelry. They said they had expected to have the job completed in two to three weeks, but we met with them almost two and a half months after they wrote out a down payment check."There's evasion. He's constantly evading," said Jill. Jon's girlfriend, Megan, told us Himmel hung up the phone on her. San Diego police confirm they showed up to Himmel's home, where he operates his business, to try to get answers. However, no one came to the door. Two days after Team 10 left Himmel a voicemail, the Robertsons said they got a priority mail package with some of the heirlooms, but not all of them. They said there was no explanation for the wait time or behavior. It was early last week when Team 10 started making calls and leaving voicemails for Himmel. None of Team 10's calls were returned.We made a second attempt to visit him in-person this Thursday and were successful. He told us he's sending out the remaining pair of earrings on Thursday and he will soon send a remaining gold nugget."It took two months this time because I handmade the ring," he told us.He spoke to Team 10 later over the phone. He said he was responsive to the Robertsons about his slight delays. He sent us what he said was a screenshot of a text exchange from mid-September when he notified them that the job would likely take another three weeks and they thanked him.  A representative with the California Franchise Tax Board notified Team 10 that Sa-Ling Jewelry Imports Inc. in San Diego was suspended on 07-03-2017 for unpaid liability with a current billable balance of ,336.81. The Better Business Bureau verified that the Robertsons filed a complaint. The BBB reported to Team 10 that it's the first complaint against Sa-Ling Jewelry, which has been in business for many years.  2810
