CHICAGO (KGTV) -- Police say three people were shot and one person is dead after a shooting at a Starbucks in Chicago Thursday night.According to ABC 7 in Chicago, the shooting happened in the city's Uptown neighborhood at 8:30 p.m. Police say a 12-year-old was transported to the hospital in unknown condition after being shot in the groin. An adult male was shot and took himself to the hospital. CARLSBAD (CNS) - Attorneys for the alleged victims of a former Carlsbad military boarding school headmaster whose molestation conviction was overturned last week by a state appellate panel asked the San Diego County District Attorney's Office Wednesday to appeal the ruling or retry the case against him.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet at the Army and Navy Academy beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial and reversed the conviction on Friday.RELATED: Appeals court reverses molestation conviction for former Carlsbad boarding school headAttorney John Manly, whose firm represents four alleged victims in civil suits filed against Barton and the academy, said, "We disagree with the ruling of the court of appeal. Jeffrey Barton is a serial sexual predator who is known to have sexually molested at least six boys in horrific ways. The evidence against him is overwhelming and we ask District Attorney Stephan to appeal this decision and, if necessary, retry this case in the interest of justice and public safety."So far, two of those civil suits have been settled and two are pending.A District Attorney's Office spokeswoman said, "We have contacted the victims who testified in the case and are working to provide them support. At this time, we are exploring our appellate options, which include retrial."The convictions came in Barton's second trial.In his first trial, almost two years before, a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on all but one of the counts involving those victims.The appellate panel ruled that Barton's second trial could have concluded differently had one juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged. 2921

(KGTV) -- Customers of the Campo Group Water System are being advised that the county has issued a drinking water warning after samples found increased levels of nitrates.Sample results found that on September 2, 2020, nitrate levels exceeded the maximum contaminant level for safe drinking water.The group serves a mini mart, gasoline station, and an office, according to the county.Nitrates in drinking water are a health concern for infants less than six-months-old and pregnant women are advised not to consume the water.“Boiling, freezing, filtering, or letting water stand does not reduce the nitrate level,” the county said.The Campo Group Water System is providing bottled water until nitrate levels fall below the maximum contaminant level, the county said. 788

CARMEL — The pastor of a Catholic church in Carmel, Indiana, is facing scrutiny after he compared Black Lives Matter demonstrators to "maggots and parasites" in a since-deleted post on the church's website.Bishop Timothy L. Doherty of the Diocese of Lafayette-in-Indiana said Father Theodore Rothrock of St. Elizabeth Seton Catholic Church should issue a clarification of the post Rothrock wrote Sunday in a weekly message. The group Carmel Against Racial Injustice called on Doherty to remove Rothrock from his position."The only lives that matter are their own and the only power they seek is their own," Rothrock wrote. "They are wolves in wolves clothing, masked thieves and bandits, seeking only to devour the life of the poor and profit from the fear of others. They are maggots and parasites at best, feeding off the isolation of addiction and broken families, and offering to replace any current frustration and anxiety with more misery and greater resentment."Rothrock continued, writing that, "We must stand in solidarity with our brethren across the world to oppose this malevolent force."He also questioned if Frederick Douglass and Dr. Martin Luther King Jr. would have marched in today's demonstrations and criticized the removal of monuments."Black Lives Matter, Antifa, and the other nefarious acolytes of their persuasion are not the friends or allies we have been led to believe," Rothrock wrote. "They are serpents in the garden, seeking only to uproot and replant a new species of human made in the likeness of men and not in the image of God. Their poison is more toxic than any pandemic we have endured."The post has been deleted from the church's website, however, an archive of the message was captured on the Internet Archive.Doherty said in a written post on the website of the Diocese of Lafayette-of-Indiana that he expects Rothrock to explain his message."I neither approved nor previewed that article," Doherty said. "Pastors do not submit bulletin articles or homilies to my offices before they are delivered. I expect Father Rothrock to issue a clarification about his intended message. I have not known him to depart from Church teaching in matters of doctrine and social justice."The group Carmel Against Racial Injustice called on Doherty to remove Rothrock as a priest and require training and education for priests and deacons on systemic racism and diversity. They also invited parishioners of the church, members of the community and other religious leaders to denounce Rothrock's statements."Carmel Against Racial Injustice is disgusted and shocked by the recent letter written by Father Theodore Rothrock," the group said in a statement. "We are also deeply saddened by the fact that the church leadership did not condemn the statement and saw fit to allow its publication.
