SAN DIEGO (CNS) - San Diego County public health officials have reported 352 new COVID-19 cases and no new fatalities, raising the region's total to 57,102 cases with deaths remaining at 891.Of the 12,879 tests reported Saturday, 3% returned positive with 239 people hospitalized.The county avoided the state's purple tier, the most restrictive, for yet another week on Tuesday, remaining in the less restrictive red tier of the state's four-tiered coronavirus monitoring system.The county's adjusted case rate dropped to 6.5 new daily COVID-19 cases per 100,000 population.According to the California Department of Public Health, the county's unadjusted case rate is 7.4 per 100,000 -- enough to be in the purple tier, which has a floor of 7 per 100,000. The testing positivity rate continued an upward trend, rising 0.2% from last week to reach 3.5%, but remains low enough for this metric to remain in the orange tier. If a county reports statistics meeting metrics in a higher tier for two consecutive weeks, it will move into that more restrictive tier for a minimum of three weeks.The state's health equity metric, which looks at the testing positivity for areas with the lowest healthy conditions, dropped from 5.5% to 5.1% and entered the orange tier. This metric does not move counties backward to more restrictive tiers, but is required to advance.All students at San Diego State University are under a stay-at-home advisory until 6 a.m. Monday. University officials said the move was made to discourage students from participating in Halloween events in which physical distancing cannot be done. SAN DIEGO (CNS) - San Diego Padres outfielder Tommy Pham has sued a Midway District strip club where he was stabbed last month.Pham, 32, was stabbed around 10:30 p.m. Oct. 11 outside Pacers Showgirls International by an unknown person or persons who took part in a fight that broke out in the club's parking lot.According to the lawsuit filed Tuesday in San Diego Superior Court, the fight outside Pacers left Pham "trapped" inside the club.The suit alleges the club's private security "escalated the risk" to Pham "by participating in the fight and antagonizing" the fight participants.The suit also alleges club employees did not contact law enforcement "or take any reasonable measures to mitigate" the dangers. SAN DIEGO (CNS) - The Port of San Diego announced Monday a three-year pilot project to test the use of concrete tide pools as a shoreline stabilizing tool. The concrete company ECOncrete will analyze the efficacy of its concrete tide pools as a possible replacement for traditional shoreline-stabilizing tools like rock armoring. The concrete tide pools will also serve as ecosystems for aquatic animals and organisms that live in natural tide pools. The tide pools interlock like puzzle pieces and are made of low carbon concrete that, according to the company, is environmentally safe and tailored to the environment in which its placed. ECOncrete plans to install 72 of the concrete tide pools across three areas of Harbor Island's shoreline, according to the Port of San Diego. ``ECOncrete's Coastal Star tide pools have great potential to provide many benefits for San Diego Bay,'' said Port of San Diego Board Chair Garry Bonelli. ``The Port looks forward to seeing if they can provide shoreline stabilization, help guard against coastal flooding, and improve the ecology of our bay water.'' The project is the eighth approved in the Port of San Diego's Blue Economy Incubator, which is intended to streamline the process in which businesses can launch pilot projects for so-called blue technology. The port launched the incubator program in 2016 as a way to collaborate with businesses focused on restoring ecosystems, improving water quality and fisheries and monitoring the environment. ECOncrete plans to monitor the tide pools every six months to examine how they could replace current shoreline stabilizers in the San Diego Bay. SAN DIEGO (CNS) - Parole was granted Wednesday for the man who killed a 20-year-old college student and pizza deliveryman in 1995 when he was a 14-year-old gang member.Tony Hicks, now 37, was the first youth in California to be tried as an adult under a law adopted in 1995 that allowed juveniles as young as 14 to be tried as adults for murder. He pleaded guilty to first-degree murder in the death of Tariq Khamisa and was sentenced to 25 years to life in prison. He has served 23 years behind bars.Wednesday's decision, made by the state parole board, now goes to the governor's office for possible approval.Gov. Jerry Brown recently signed Senate Bill 1391, which eliminates the ability to try a defendant under the age of 16 as an adult for any violent crime. Those convicted under the new law will be held in locked juvenile facilities instead of adult prisons."If this law (SB 1391) had been in effect in 1995, Tony (Hicks) would have been prosecuted in Juvenile Court and paroled many years ago,'' said Azim Khamisa, the victim's father. ``The other two individuals involved in the crime were sentenced in Juvenile Court. Tony made a mistake. He has atoned for it in many ways. He has paid his debt to society. It is time for him to be it in many ways. He has paid his debt to society. SAN DIEGO (CNS) - The San Diego City Council voted unanimously Monday to amend an agreement between former Mayor Bob Filner and the developer Carmel Partners over the development of an apartment complex that drew criticism.The development's current owner, Trea Blvd63, LLC, sought to nullify the agreement, which required the development's owner to rent apartments to tenants by the room rather than by the bed. When it was being built in 2013, opponents of the apartment complex argued that it more closely resembled a dormitory rather than the luxury units it was billed as.``I applaud my council colleagues for correcting these corrupt mistakes of the past, and moving forward from Filner's blatant misuse of power,'' Sherman said. ``This is a good reminder that big problems happen when elected officials abuse the power of their office.''Carmel Partners began work on the CentrePoint apartment complex, located in Rolando, in 2013. The city ordered the stoppage of construction of the complex, citing the need for additional construction permits.
