The holidays are right around the corner, but Walmart won't be hiring for help.The retailer plans to meet its need for extra work during the holiday shopping season by giving existing employees more hours, according to a release from the company.Hiring seasonal holiday help is a tradition in retail. Walmart rival Target has already announced plans to bring on 100,000 temporary holiday workers.But Walmart's move is a sign of the tightening labor market which has made it difficult for employers to fill open positions. There were a record number of unfilled job openings nationwide in the latest government reading of the labor market. More than 600,000 of the open positions were from retail.It also can be seen as part of the effort by Walmart, the nation's largest private sector employer, to make jobs there more attractive and to cutdown on turnover.The company announced a series of pay raises for its lowest paid employees in early 2015, which took the minimum pay for most employees to an hour by last year, and the average pay for its full-time workers to about an hour. Part-time workers are paid about an hour on average.For part-time employees, additional hours could increase total pay more than an increase in hourly pay.Walmart says it employed the same strategy of more hours for existing employees during the holidays last year and "we heard great feedback from our customers and associates," according to Judith McKenna, chief operating officer of Walmart U.S.Walmart had 1.5 million U.S. employees as of Jan. 31, according to a company filing. 1585

The Justice Department has dropped its case against a woman who laughed out loud during the confirmation hearing for Attorney General Jeff Sessions, ending months of legal wrangling.The woman, Desiree Fairooz, was protesting with Code Pink, a progressive group whose activists are regularly seen around Washington. She was arrested by a Capitol Police officer after audibly laughing during Sessions' confirmation hearing in January.But prosecutors filed a "nolle prosequi," or notice that it would no longer pursue charges, with the DC Superior Court on Monday.She had been prosecuted by the DC US Attorney's Office and had been convicted of a misdemeanor before a judge threw out the conviction in July and ordered a new trial. The government had decided to retry the case after Fairooz rejected a plea deal, and a trial date had been set for next week.Fairooz tweeted the notice was a "relief" Monday night."Just received this, "Governments Notice of Nolle Prosequi" What a relief! Guess they've got enough "laughing" matters to deal with!" she tweeted.The US Attorney's Office declined to explain what had changed."The US Attorney's Office for the District of Columbia yesterday filed a notice dismissing the case involving Desiree Ali-Fairooz," said spokesman Bill Miller. "The US Attorney's Office typically does not discuss charging decisions, and has no comment on the decision to dismiss this particular case."The original arrest happened after Fairooz laughed after Alabama Republican Sen. Richard Shelby told senators at Sessions' confirmation hearing that his former colleague had a record of "treating all Americans equally under the law."Her laughter lasted a few seconds and Shelby continued with his speech without acknowledging the disturbance.Fairooz's attorney said in a statement his client is "relieved and happy" about the result."Yesterday the government dismissed the case for reasons I can only speculate about. And which I may never fully know (though I have various theories)," Samuel Bogash said in an email. "Though as her lawyer I would have preferred a 'not guilty' at the first trial, I'm happy for Ms. Fairooz." 2156

The political and judicial world were turned upside down on Friday following the death of Justice Ruth Bader Ginsburg. While many questions remain in Washington, like whether President Donald Trump has the votes to replace Ginsburg before the election, one thing is clear: issues will come before the Supreme Court very soon.HEALTH CARE ARGUMENTS IN NOVEMBERWhile election issues are expected, the future of the Affordable Care Act is an issue guaranteed to come up before the Supreme Court soon. A hearing is set to take place one week after the election regarding whether the law can be struck down. Essentially, Republicans from around the country believe that the only reason the Supreme Court upheld the law in 2012 was because the opinion said Congress has the power to tax. Since that time, however, Trump has removed the tax penalty for not having health insurance. The thinking from some conservatives is that since the tax penalty is gone, the entire law can be struck down now, too. WHERE THE COURT STANDS Prior to Ginsburg's death, the general thinking was that the law would still stand. It faced a challenged in 2012, but Chief Justice John Roberts sided with four liberal justices to uphold it. With Ginsburg's passing, there are only three liberal justices on the court. If Roberts joins the liberal justices it would create a 4-4 tie. "If there is a 4-4 split on the court, then no precedent is set and whatever the lower court decided stands," Professor Paul Schiff Berman with George Washington University said. That would mean parts of the Affordable Care Act can be struck down since lower courts have already ruled in that way. If Trump is able to get another nominee on the court before the hearing, it would only make the court more conservative. Berman cautioned though that other conservatives could potentially join the liberals on this case since the lawsuit's legal standing is murky. Still, the future of the Affordable Care Act is in more jeopardy today than it was last Thursday. 2020

  

The parents of Otto Warmbier are suing North Korea in a 22-page complaint filed Thursday in federal court in Washington.Warmbier was a college student from Wyoming, Ohio, who was jailed in North Korea and died shortly after he was returned to the United States in a coma.In the document, Fred and Cindy Warmbier accuse Kim Jong Un's "criminal" regime of brutally torturing and murdering the 22-year-old during his 17-month-long captivity from Jan. 2, 2016, through June 13, 2017.“Otto was taken hostage, kept as a prisoner for political purposes, used as a pawn and singled out for exceptionally harsh and brutal treatment by Kim Jong Un. Kim and his regime have portrayed themselves as innocent, while they intentionally destroyed our son’s life. This lawsuit is another step in holding North Korea accountable for its barbaric treatment of Otto and our family," said Fred Warmbier in a statement. Examine the full complaint in the box below.Last summer, Fred Warmbier told the hosts of Fox & Friends and CNN "it looked like someone had taken pliers and tried to rearrange" Otto's bottom teeth. He said he noticed this while?examining?his son after he returned to the U.S. in June. But the Hamilton County Coroner's Office disputed that account. In a news conference, Coroner Dr. Lakshmi Sammarco said she did not see "any evidence of trauma" to Otto's teeth upon his return from North Korea and that she was surprised by the Warmbier's statements.The Warmbiers also attended President Trump's State of the Union address in January.“You are powerful witnesses to a menace that threatens our world, and your strength inspires truly us all,” Trump said to the Warmbiers. “Tonight, we pledge to honor Otto's memory with total American resolve.”Following that, Fred Warmbier accompanied Vice President Mike Pence to the Olympics in South Korea.  1935
