SAN DIEGO (KGTV) - A battle is brewing between the San Diego bay cruise companies over which companies can start up again and which ones cannot. Some companies are cleared to resume dinner cruises next weekend, while others are still stuck at the docks. On Hornblower Cruises & Events’ Facebook page, the announcement is up that it's reopening this upcoming weekend. Wednesday, the fleet was docked but starting Saturday, the company is offering dining cruises through the bay. “At the moment, we have not been permitted to leave the dock,” said Carole Noska, owner of Charter Services. She told 10News that her boat and other charters still can't operate bay tours. County guidelines only permit recreational boating, not charters, and the recreational sailing is only for passengers within the same household. The County reports that dining cruises, though, are fine to set sail so long as they operate within the County's dine-in guidelines for restaurants.“We probably lost ,000 to ,000 over Memorial weekend after having already been at the dock for the last two months since COVID started," Noska told 10News and added, “Those of us in the legal charter community the credentialed vessels for charter would just ask that the County and the Port and the State level the playing field.”In a press release, Hornblower Cruises & Events provided an extensive list of safety measures its implementing, including social distancing aboard, and facial covering requirements. The company sent 10News the following statement on Wednesday."In accordance with the latest Stage 2 Variance which now permits dine-in restaurants to operate, we are thrilled to be able to offer a limited choice of seated dining cruises starting this weekend. Like other restaurants within the County, we are adhering to the specific guidelines laid out in the San Diego Safe Onsite Dining Plan for Restaurants and the State guidance for Dine-in restaurants. In addition to already stringent cleaning protocols, we are adapting the onboard experience to reflect the need for social distancing, alongside elevated health and hygiene practices. So, while our Guests can still expect the same high standards and welcoming service, they can be assured we are fully compliant with all relevant and necessary requirements."Flagship Cruises & Events is starting dining cruises as well, but the company is also doing bay tours which is in violation of the County health code. The company was cited by Harbor Police over the holiday weekend but reports that it is continuing its operation, maintaining its allowed to do so under a certain section of County code, which the County disputes. 2679

SAN DIEGO (KGTV) - A gray whale spotted frolicking in shallow waters attracted dolphins and a crowd of swimmers and surfers in the ocean off Mission Beach Wednesday. Lifeguards got a call about the whale possible tangled in fishing line about noon, an official said. A lifeguard who swam toward the whale to investigate determined it was free.The gray whale was young, possibly a year and a half old, whale watcher and photographer Domenic Biagini told 10News. Gray whales are starting to migrate north from Mexico during the spring. There is a good chance San Diegans will see more mothers and juvenile whales closer to shore, Biagini says, because the shallow waters keep the whales safe from orcas. "It's some of the most exciting times for us as professional whale watchers to see these animals, but it's also when we see the most conflicts with these animals coming in with people," said Biagini.Sky10 was above the whale as a group of surfers and swimmers approached it near Mission Beach, coming close to the giant mammal.Biagini warns that can be extremely dangerous for humans and can also stress the animal."These gray whales, despite not being the largest of the great whales we see out here, they can still get 50 feet long and weigh up to 80,000 pounds, so you're talking very large animals. All it takes is one flick of the tail and you have a catastrophic accident. And moms are naturally protective of their young," said Biagini. SAN DIEGO (KGTV) — A brush fire in the Japatul Valley area exploded in size in about an hour on Saturday, forcing nearby residents to evacuate.The Valley Fire ignited off Spirit Trail and Japatul Road, just southeast of Alpine, just before 2:50 p.m., according to Cleveland National Forest. The fire had scorched about 1,500 acres and was 0% contained as of 5:50 p.m.Fire officials said the dangerous rate of spread was pushing the fire southwest toward Lawson Valley. According to Cal Fire Cpt. Kendal Bortisser says the intense heat and rugged topography of the area are also posing a challenge for crews. SAN DIEGO (KGTV) - A former La Jolla restaurant owner convicted of raping multiple women was sentenced on Tuesday to 40 years in prison.On a live stream to the courtroom while sitting in jail, Daniel Dorado was read his term after several women gave their victim impact statements.The former owner of Voce Del Mare was found guilty last December on 20 counts related to rape and sexual assault of four victims who were unconscious and intoxicated. ABC10 News broke the story two years ago when he was charged with drugging and raping women, sometimes at his restaurant.Fighting back tears on Tuesday, one victim described her trauma from meeting Dorado after answering an ad on Craigslist for a hostess position. "Years after the assault, I still don't feel safe going to job interviews in-person, alone. I don't feel safe to do outdoor activities alone. I can't tolerate being around men. Not even family," she stated."He is an evil individual," said another woman who added, "I simply went on a date with him and ended up getting sexually assaulted by him for hours in a hotel room where I was unconscious."One woman who was named as a victim defended Dorado on Tuesday and said that she was even friends with him. She accused detectives of manipulating her to testify against her will and appear confused about a possible assault. She told the judge, "Your honor, Mr. Dorado never raped me. I never went to the police. I never filed a police report. In fact, I declined a restraining order against Mr. Dorado and I told detectives that I did not want to press charges."Dorado addressed the courtroom and denied any wrongdoing. He added, "I have spoken the truth since the very first day that this all began. I did not skip town. I did not make faces to the accusers. I am still in shock by what has happened." He maintains his innocence and has said that every sexual encounter was consensual."The total term of imprisonment is 40 years. I don't mind saying [that] I believe this is the maximum I can impose under the law," the judge told the courtroom. SAN DIEGO (CNS) - Two additional suspects were arrested today in connection with a shooting that left a 20-year old man mortally wounded in a Bay Terraces-area neighborhood 16 months ago.Ethan Leland Apan, 28, and Kevin Herrera, 26, were jailed this afternoon on suspicion of taking part in the slaying of Joaquin Ruiz of San Diego, according to police.Another suspect, 26-year-old John Orozco, was taken into custody last Wednesday on suspicion of murder in the case, Lt. Andra Brown said Shortly after midnight on July 13, 2019, patrol officers responding to a report of a possible traffic accident found Ruiz unconscious and suffering from a gunshot wound to his upper body in a vehicle alongside the roadway in the 7000 block of Paradise Valley Road.Paramedics took the victim to a hospital, where he was pronounced dead. Police have not disclosed what led investigators to identify Apan, Herrera and Orozco as suspects in the case and have revealed no suspected motive for the slaying.``The District Attorney's Office is currently reviewing this case, which is still an ongoing investigation,'' Brown said. ``We will not be making any further comments or providing additional information at this time.'' 1216
