SAN DIEGO (CNS) - A San Diego-based telemarketer was fined nearly million by the Federal Communications Commission Wednesday for making more than 47,000 robocalls over a two-day period leveling false accusations against a local state Assembly candidate and manipulating caller ID information to appear as though a competitor was making the calls.Kenneth Moser and his company, Marketing Support Systems, were fined ,997,750 for making the calls on May 30 and May 31, 2018, about one week prior to the primary election, in which Philip Graham unsuccessfully sought to represent the 76th Assembly District.Shortly before the primary, a woman accused Graham of kissing her against her will in an Encinitas bar, triggering a sheriff's department investigation that concluded the claim was unfounded. Nichole Burgan, the woman at the heart of the allegation, later pleaded guilty to filing a false report.According to the FCC, the robocall messages repeated Burgan's claim and caller ID information was manipulated to make the calls appear as though they originated from another telemarketing company, HomeyTel, described as a competitor to Moser's company. As a result, HomeyTel received "a multitude of angry complaints" from people who received the calls, as well as a cease-and-desist letter from Graham, according to the FCC.The agency said 47,610 robocalls were made during the two-day period, with multiple calls sometimes sent to the same recipients.The calls violated the Truth in Caller ID Act prohibiting manipulation of caller ID information -- otherwise known as spoofing -- with the intent to defraud, cause harm or wrongfully obtain anything of value, according to the FCC. 1697

SAN DIEGO (CNS) - An 18-year-old man was shot twice in the stomach during an armed robbery early Thursday morning in a Mission Beach parking lot, police said.Two 18-year-old men were in a car leaving a party at the Bahia Resort Hotel, 998 West Mission Bay Drive, when they were approached by two men on foot in a public parking lot on Gleason Road at around 12:30 a.m.One of the men on foot pulled out a gun and pointed it at the pair in the car while demanding items from them, San Diego Police Department Officer Robert Heims said. The victims got out of the car and the man with the gun stole a chain necklace from one of the victims.The other victim tackled the gunman and was shot twice in the stomach, the officer said.The suspects fled in an unknown vehicle and the victim who had his necklace stolen drove the gunshot victim to a hospital for treatment of his wounds, Heims said. The gunshot victim underwent surgery, but an update on his status was not immediately available.A detailed description of the suspects was not immediately available. 1061

SAN DIEGO (CNS) - A man who beat his estranged wife to death with a commemorative baseball bat as she delivered food to him at his City Heights apartment was sentenced Friday to 16 years to life in state prison.Dana Marion Davis, 56, pleaded guilty at an earlier hearing to second- degree murder in the death of April Davis, his spouse of more than 30 years and the mother of his six children.The defendant beat the 51-year-old victim with a wooden bat on the afternoon of Oct. 7, 2017, then prevented a family member and police from entering the apartment, said Deputy District Attorney Stephen Marquardt. When officers finally gained entry, she was found dead on the floor.Davis told Judge Michael Smyth that he was remorseful for killing the mother of his children."She didn't deserve this," the defendant said before he was sentenced.To his children -- three of whom were present in court -- Davis said, "I am deeply sorry for the pain I have caused you."A psychologist determined the defendant suffered childhood development trauma that affected his relationship with his wife, Deputy Public Defender Amy Hoffman told the judge.When talking to police after the murder, Davis was "clearly in shock" as to what happened, Hoffman told the judge. The attorney said alcohol was involved in the fatal encounter.According to Marquardt, the defendant was on probation for domestic violence when he killed his wife. The two had been living apart.The prosecutor said the defendant had been violent with the victim in the past, having been convicted of misdemeanor domestic violence in 1994 and 2016.When the defendant was convicted of punching his wife in the head in 2016, he was also prosecuted for choking his teenage daughter, Marquardt said. 1749

SAN DIEGO (CNS) - Cruise ships are scheduled to return to the Port of San Diego this week and through the new year, part of an effort by the cruise lines to reestablish ships in U.S. waters as a prerequisite to resume cruising in a post-COVID-19 world, it was announced Monday.Five Holland America Line ships and one Princess Cruises ship are scheduled to arrive beginning Wednesday, periodically docking at the B Street Cruise Terminal for fuel, food, supplies and services. At this time, none of the vessels will be carrying passengers or conducting any sailings, according to local port officials.To resume cruises after the U.S. Centers for Disease Control and Prevention deems it safe in light of the ongoing COVID-19 pandemic, the ships must reestablish operations in United States waters to meet CDC and U.S. Coast Guard guidelines.According to port officials, time spent docked in San Diego will be limited. Each ship is scheduled to dock at B Street the morning of their scheduled arrival date and depart that evening.The Holland America Line ships are scheduled to remain in the San Diego area and may be visible off the coast, with some periodically positioning in the outer anchorage just outside of San Diego Bay off the coast of Coronado. After their initial arrival, each HAL ship plans to periodically return to the B Street Cruise Terminal to refuel and/or to resupply or receive services. The Emerald Princess is scheduled to go to Los Angeles after its Dec. 24 visit, but port officials stressed that vessel schedules may change.Crew members aboard the vessels will not be allowed off unless as part of crew changes with plans and procedures reviewed and approved by the CDC, Coast Guard, Customs and Border Patrol and county Health and Human Services. SAN DIEGO (CNS) - A lawsuit has been filed on behalf of 40 women against Pornhub's parent company for hosting videos produced by former San Diego-based website GirlsDoPorn.com, the owners and operators of which are facing federal sex trafficking charges.The plaintiffs, identified as Jane Does 1 through 40 in the lawsuit filed Tuesday in San Diego federal court, allege Montreal-based MindGeek owns and operates a multitude of pornographic sites that have hosted videos featuring the women, and maintained its business relationship with GirlsDoPorn even as the site came under scrutiny for allegations of videos made through coercion and fraud.The suit alleges MindGeek's business partnership with GirlsDoPorn continued through late 2019 and only ended because GirlsDoPorn ceased to exist amid a Department of Justice sex trafficking investigation and a civil lawsuit filed in San Diego Superior Court.The federal suit alleges that after the partnership ended, MindGeek's sites continued hosting victims' videos, including as recently as Dec. 12."MindGeek knew it was partnering with and profiting from a sex trafficking venture for years," the latest suit alleges. "MindGeek also knew of the significant harassment and trauma GirlsDoPorn's victims were enduring by its continued publication of the victims' videos. MindGeek simply did not care and continued to partner with GirlsDoPorn until it was no longer profitable because of the indictments and arrests."MindGeek did not respond for comment regarding the lawsuit.The company and its most popular site, Pornhub, were featured in a New York Times article this month alleging Pornhub hosts videos featuring rape and child abuse. In the article's wake, several major credit card companies -- including Visa, Mastercard and Discover -- cut ties with the website and Pornhub instituted a ban on videos uploaded by unverified users and removed millions of videos from the website this week.In the Superior Court case originally filed in 2016, GirlsDoPorn's owners were sued by 22 women who alleged they were coerced to film pornographic videos or led to believe their videos would only be distributed to private owners, rather than proliferated online on GirlsDoPorn's subscription website, as well as numerous free sites, many of which are owned by MindGeek.Several of the women alleged they were lured to San Diego with online advertisements that made no mention of nudity or pornography, much less the GirlsDoPorn business name.The women were awarded nearly million earlier this year by San Diego Superior Court Judge Kevin Enright, who ruled the defendants pressured the women to sign documents replete with "broad, vague releases couched in disorganized, complicated legalese," which obscured the victims' concerns over potential online dissemination. Other women hired as "reference models" allegedly spoke to uneasy victims over the phone and claimed they had been featured in prior videos without issue, falsely assuring victims that their videos would not end up on the internet.Once the women discovered their videos were posted online, the website owners ignored requests to take the videos down and cut contact with the women altogether, Enright ruled. The women also alleged GirlsDoPorn's owners shared links to their videos with people within the victims' social circles in order to drive up website traffic.Late last year, prior to Enright's ruling in the civil suit, federal prosecutors filed sex trafficking charges against the site's owners and operators, alleging many of the same claims presented in the civil case. Six defendants are currently charged, including GirlsDoPorn owner Michael James Pratt, who remains at large. 3707
