Five US Marines who were missing after two aircraft collided mid-air off the coast of Japan on Thursday morning have been declared dead, the US Marine Corps said.The US military called off its search for the Marines on Tuesday, according to a statement from the Marine Expeditionary Force."The Marine Corps has pronounced the five remaining Marines involved in the F/A-18 and KC-130 aviation mishap deceased," the Marine Corps said in a statement. "The change in status comes at the conclusion of search and rescue operations."The identities of the Marines have not been released, but the Marine Corps said their next of kin have been notified. 652

Former Chicago Police Superintendent Garry McCarthy, who was previously fired by Chicago Mayor Rahm Emanuel, announced on Wednesday that he intends to run against Emanuel to be the city's mayor.The election will be held in February 2019. McCarthy was fired in December 2015 after it took the department 14 months to release video of the death of Laquan McDonald, who was an unarmed black 17-year-old shot and killed by Chicago Officer Jason Van Dyke. It was determined that Van Dyke had shot McDonald 16 times, leading to protests in Chicago. The case led the City of Chicago to offer a million settlement to the McDonald family, the Chicago Tribune reported. Van Dyke, who has since been charged with homicide, is still awaiting trial. McCarthy told the Tribune that he is running as a "conservative Democrat." “Between the taxes, our economy, the schools and the crime rate here, we’re a laughingstock in America,” McCarthy told the Tribune. “The prevailing thought about Chicago is we’re on our way down in all those areas, and they all infect each other, and nobody seems to get that. It’s almost like a ‘Wake up, Chicago’ moment.”McCarthy is going up against a relatively popular mayor. According to a poll by Anzalone Liszt Grove Research, Emanuel's approval rating as of January was 51 percent, compared to 40 percent who disapproved. Emanuel is seeking his third term after being President Barack Obama's first Chief of Staff in the White House. While McCarthy has made it clear that he is not running as revenge against Emanuel, he contends his firing was unjust."While I am very emotional, that’s not my motivation here,” he told the Tribune. “Why would I possibly take on turning around one of the largest American cities in the right direction? Because I’m annoyed? Florida Democrat Sen. Bill Nelson called Wednesday for a recount in his race for re-election against Republican Gov. Rick Scott.In a statement from Nelson's office, the longtime incumbent said Scott had prematurely declared victory in the race, which CNN has not yet called.In Florida, an automatic recount is triggered when the final margin is less than .5% and are not triggered by candidate requests. Votes were still being counted Wednesday morning, but Scott's lead was within that margin, according to CNN projections. The initial vote count won't be finalized until Saturday at noon. 598

FREDERICK, Colo. — Newly released court documents in the Chris Watts case obtained by KMGH suggest his two young daughters may have been strangled.The suggestion came in a motion filed by defense attorneys in Weld County court to compel the coroner to take DNA from the necks and throats of the remains of 4-year-old Bella and 3-year-old Celeste Watts, whose bodies were found inside oil and gas tanks Thursday. The court document also said the bodies were submerged in crude oil for four days.The bodies of the two young girls were found in close proximity to the other body positively identified as Shanann Watts, the girls’ mother.In the motion filed Friday, DNA expert Richard Eikelenboom concludes that DNA evidence “would remain on the necks of the decedent children,” after they were submerged in the oil. Eikelenboom is quoted in the motion as saying he believes the oil would not eliminate DNA and said samples can be obtained "after strangulation."The motion also asks that DNA samples be taken from the hands and nails of the body of the girls' mother.Eikelenboom writes:“This DNA can be retrieved with a double swab technique. DNA scientists are familiar with this technique and an experienced person should take this samples. In my opinion the presence of oil will not destroy the DNA. The hands wand nails of the mother should be sampled as well. After samples are taken the nails should be cut preserved. I have a lot experience taking samples from dead bodies getting good results after strangulation. The hands of the children should be sampled as well.”Eikelenboom is a forensic scientist who has claimed to be a DNA expert in trials in Colorado and across the United States, but was discredited two years ago in a 2013 sex assault case in Denver District Court.“I would be shocked if the defense tried to use him front of a jury after he has been discredited as an expert witness,” said former Denver District Attorney Mitch Morrissey, who led the charge against Eikelenboom.The motion was dismissed by the judge.On Friday, the coroner's office announced they have positively identified the victims of the Frederick case as Shanann Watts and her two daughters. The manner and cause of death of all three bodies are pending further laboratory results and will not be released at this time.Chris Watts remains in the Weld County Jail on suspicion of murder his family. He was taken to jail at 11:30 p.m. Wednesday after he was detained for questioning. Two law enforcement sources told KMGH Watts had confessed to killing his wife and daughters. He faces investigation on one count of first-degree murder after deliberation; two counts of first-degree murder – position of trust; and three counts of tampering with a deceased human body.All three were reported missing Monday around 2 p.m. after Shanann did not arrive to a scheduled meeting. In addition to having two daughters, Shanann was also 15 weeks pregnant. The FBI and CBI were brought in to help Frederick police in the investigation.Weld County prosecutors said they believe Shanann and the girls were killed inside of the family’s home but did not say why they believe that. 3241

Former Trump campaign chairman Paul Manafort on Monday gave up his effort to challenge special counsel Robert Mueller in civil court.Manafort has withdrawn his appeal of a judge's decision to throw out his civil lawsuit against Mueller, according to court filings."It is hereby stipulated and agreed by and between the parties that the (case) be voluntarily dismissed," the new filing said.Manafort filed the initial lawsuit in January against Mueller, the Justice Department and Deputy Attorney General Rod Rosenstein,?who appointed Mueller as special counsel. A federal judge?dismissed the case in April, saying that the civil proceedings were "not the appropriate vehicle" for Manafort to try to chip away at Mueller's authority.In her ruling, federal Judge Amy Berman Jackson told Manafort to pursue his grievances against Mueller during his criminal proceedings. Manafort then asked the federal appeals court in Washington, DC, to review her decision.The decision to drop the appeal comes one day before Manafort's criminal trial is scheduled to begin in Virginia federal court. Manafort is accused of financial crimes, including bank fraud and tax evasion, relating to his lobbying work for the government of Ukraine. He has pleaded not guilty to the charges. Jury selection begins Tuesday.The unsuccessful civil lawsuit sought, among other things, to prevent Mueller from bringing additional charges in the future, including potential charges relating to Manafort's work on the Trump campaign. Mueller is investigating Russian interference in the 2016 election, including potential coordination between the Trump campaign and Russia. President Donald Trump and Manafort have both said there was no collusion.Manafort has used similar arguments to challenge his indictments in Virginia and Washington. But federal judges overseeing both cases have upheld Mueller's authority to investigate and prosecute Manafort. One of the judges, T.S. Ellis, said prosecutors rightfully "followed the money paid by pro-Russian officials" to Manafort.Manafort is also charged in federal court in Washington with undisclosed foreign lobbying and money laundering. He pleaded not guilty to these allegations, and the case is scheduled to go to trial in mid-September.The judge overseeing that trial, Berman Jackson, revoked Manafort's bail last month and ordered him to await trial from a jail cell.
