DENVER (AP) — A Colorado police officer will not face charges for fatally shooting a homeowner who had just killed an intruder inside his suburban Denver home, prosecutors said in a letter released Monday.Adams County District Attorney Dave Young described Richard "Gary" Black's death as a "harrowing tragedy" but said his role was to determine whether the Aurora Police officer who shot the 73-year-old Vietnam War veteran was justified in using deadly force.Based on witness interviews and more than 90 videos captured by officers' body cameras, Young said Officer Drew Limbaugh did not know who Black was and fired when the homeowner refused police commands to drop his handgun.Young said Limbaugh's belief was reasonable and prosecutors cannot prove that the officer was not justified in firing. He said there also is no evidence that Limbaugh was reckless or criminally negligent."Officer Limbaugh engaged in conduct that was consciously focused on minimizing the risk to public safety," Young wrote.At the time of the shooting, Young said police did not know that Black had woken after midnight to investigate banging sounds and soon heard his 11-year-old grandson screaming as an intruder attacked him inside the bathroom. Police also did not know that the intruder, later identified as Dajon Harper, was lying on the bathroom floor after being shot twice by Black, he said."The evaluation of Officer Limbaugh's reasonable belief must be based not upon what we now know, but the circumstances as he perceived them at the time: hearing gunshots and then seeing an armed man emerge from a back room who refused commands to drop the weapon," Young wrote.The witnesses and police officers interviewed by investigators paint a chaotic scene. Young said police arriving at the home in Aurora around 1:30 a.m. on July 30 had little information and no description of a suspect.Within seconds, he said police heard gunshots inside the house and saw Black come into the hallway holding a handgun in one hand and a flashlight in the other. Young said the body camera footage shows police repeatedly told Black to drop his weapon before he came toward officers, raising the flashlight, and Limbaugh fired three times.Police have said Black had hearing impairment due to his military service. Young wrote that Black may not have heard the commands or recognized the officers as police but said that does not change Limbaugh's "reasonable belief that Mr. Black presented a threat."Witnesses told police that Harper was at a party at a family member's home nearby and may have been using drugs. Early that morning, he ran away and apparently broke down the Black family's front door.Black's grandson told police he woke up after feeling a cold breeze. He described walking toward his father's bedroom but then seeing a stranger showering as he passed the open bathroom door.The boy said the man grabbed him, locked the bathroom door and was strangling him before his father and grandfather were able to get inside the room.Harper, who was 26, died after being shot twice in the chest by Black. An autopsy report found levels of marijuana and methamphetamine in his blood. 3172

Democrat Stacey Abrams on Friday acknowledged that Republican Brian Kemp will become the next governor of Georgia, ending her bid to become the first black woman in American history to lead a state.The announcement comes after more than a week of post-election legal maneuvering from her campaign and allies as they sought to find enough votes to reduce Kemp's lead and force a December 4 runoff.Abrams was considering further legal challenges as recently as this morning, but ultimately made the decision to end her campaign in a fiery speech to supporters at her headquarters in Atlanta.Even in acknowledging defeat, Abrams insisted her speech was not a speech of concession."So let's be clear -- this is not a speech of concession, because concession means to acknowledge an action is right, true or proper," she said. "As a woman of conscience and faith, I cannot concede that. But, my assessment is the law currently allows no further viable remedy. Now, I can certainly bring a new case to keep this one contest alive, but I don't want to hold public office if I need to scheme my way into the post. Because the title of governor isn't nearly as important as our shared title -- voters. And that is why we fight on."Abrams had previously described Kemp as an "architect of voter suppression" and in her remarks said he had purposefully made the process a "gut-wrenching hardship" for many in Georgia."Under the watch of the now former secretary of state, democracy failed Georgia," Abrams said of Kemp, who served as the state's chief elections officer for nearly a decade before resigning after overseeing his own contest."Make no mistake, the former secretary of state was deliberate and intentional in his actions," Abrams said. "I know that eight years of systemic disenfranchisement, disinvestment and incompetence had its desired affect on the electoral process in Georgia."Earlier in the day, Abrams' campaign launched a digital ad that asked voters to share their stories of trouble at the polls. 2018

Democratic presidential nominee Joe Biden will address the devastating wildfires that are currently ravaging the West Coast in scheduled remarks on Monday afternoon.During a prepared speech that he delivered at the Natural History Museum in his hometown of Wilmington, Delaware, Biden appealed to voters by attempting to position himself as a champion of environmentalism and a candidate who "respects science."Conversely, Biden painted Trump as a climate change denier, claiming that Trump has ignored the ever-increasing threat brought by climate change."Dangers of climate change are already here," Biden said.In pointed phrasing, Biden later adding that Americans "aren't safe" from natural disasters wrought by climate change in "Donald Trump's America." In recent months, the Trump campaign has pushed the idea that America would not be safe from violent crime in "Joe Biden's America."Biden did not take questions from the media following his address.Biden's address came as millions of acres of forest have been lost to wildfires in recent weeks in more than a dozen states in the western U.S. Among the states hardest hit by the blazes are northern California, Oregon and Washington, which have seen a combined 35 deaths due to wildfire in recent weeks.Though cooler weather helped firefighters calm the fires over the weekend, officials worry that high wind gusts in the region could cause problems in the days to come.Wildfires have become an increasingly dangerous and destructive problem in recent years due to increased temperatures and drought in the region. Some experts believe the crisis will only worsen in years to come.President Donald Trump was scheduled to receive a briefing on the fires during a visit to the Sacramento area on Monday.Biden's speech also came amid a flurry of tropical storm activity in the Atlantic Ocean.
