A former Google engineer is accusing the company of firing him after he spoke out about incidents of racism, sexism and harassment.Tim Chevalier is suing Google for retaliation, wrongful termination and failure to prevent discrimination and harassment, according to a lawsuit filed in San Francisco on Wednesday.Silicon Valley -- and Google in particular -- has been shaken by fierce debates over diversity issues. Highly charged arguments between Google employees have at times burst into public view as the company wrestles with how to address the concerns.The lawsuit by Chevalier, who identifies as transgender and disabled, claims Google's culture is discriminatory. He alleges that some employees use the company's internal social-networking and messaging systems to belittle and bully women, people of color and LGBTQ colleagues."Chevalier pushed back on the online bullying he and others were experiencing, using the same internal messaging systems to try to educate his employer and coworkers on how to change Google's working conditions to be inclusive and supportive of underrepresented minorities, such as himself," the lawsuit says.His lawsuit alleges that rather than trying to address the concerns he was raising about other employees' behavior, Google fired him in November, citing the political nature of his posts."It is a cruel irony that Google attempted to justify firing me by claiming that my social networking posts showed bias against my harassers," Chevalier said in a statement provided by his lawyers. "The anti-discrimination laws are meant to protect marginalized and underrepresented groups -- not those who attack them."Google spokeswoman Gina Scigliano declined to comment directly on Chevalier's allegations. She said that lively debate is important to Google's culture, but that there are limits."All employees acknowledge our code of conduct and other workplace policies, under which promoting harmful stereotypes based on race or gender is prohibited," Scigliano said in a statement. "This is a very standard expectation that most employers have of their employees. The overwhelming majority of our employees communicate in a way that is consistent with our policies. But when an employee does not, it is something we must take seriously. We always make our decision without any regard to the employee's political views."In the lawsuit, which was first reported by tech news site Gizmodo, Chevalier alleges that some Googlers would call coworkers "immoral" because of their sexual orientation. Employees also questioned the competency of women and minorities on internal message boards, he said."Company social networking forums can be incredibly useful, but employers have an obligation to prevent them from becoming a cesspool of bullying and harassment," David Lowe, an attorney for Chevalier, said in a statement. "Firing the employee who pushed back against the bullies was exactly the wrong step to take."Debates inside Google about diversity issues erupted in August when one of the company's senior engineers at the time, James Damore, published a controversial memo claiming women are underrepresented in technology because of psychological and biological differences, not sexism.In his memo, Damore claimed to "value diversity and inclusion," but he took issue with Google's approach, which he described as overly political and alienating to "non-progressives."Damore, who was fired over the controversy, and another former Google engineer, David Gudeman, are suing the company, alleging that it discriminates against white men and conservatives.Chevalier waded into the internal debates over Damore's memo last summer, according to his lawsuit. It says that in September, a Google human resources representative spoke with Chevalier about some of his emails and posts on internal forums regarding the memo and other politically charged subjects.Google is also facing a gender-pay lawsuit claiming the company paid women less than their male counterparts.  4016

A bus carrying Houston-area band students fell into a 50-foot ravine in Baldwin County, Alabama, early Tuesday morning, killing the driver, police said.The crash and rescue effort closed down Interstate 10 in both directions near the Florida state line.The bus struck a bridge support when it landed in the ravine, and inspectors need to make sure the bridge is sound before reopening the interstate, he said.A wrecker was pulling the bus out of the gulley as Alabama State Trooper Capt. John Malone spoke to reporters."The bus came to rest on one side down in the ravine. Those had to either be brought up by ropes or rappelling individuals from the fire department during the rescue operation. Some were carried out by either deputies or other law enforcement," Baldwin County Sheriff Huey Hoss Mack said, explaining that the depth of the ravine complicated rescue efforts.First Class Tours, which operated the bus, identified the driver as Harry Caligone, a longtime employee of the company"We are deeply saddened for this loss. We offer our heartfelt condolences to his family," the bus company said.Mack said several injured people were taken to 10 hospitals in Baldwin County, the Alabama cities of Mobile, Daphne and Fairhope, and Pensacola, Florida. He estimated there were about 45 people on the bus.Sacred Heart Hospital in Pensacola received 18 of the patients, according to its website.Six or seven Medevac helicopters transported patients to hospitals, the sheriff said. One patient remains critical, he said, and five are in serious condition. The rest of the injured, including a Baldwin County deputy hurt during the extrication process, suffered minor wounds, he said.A video of the crash showed a bus on its side in a grassy aqueduct as rescuers with flashlights scoured the area. Firefighters looked down from a bridge, a line of emergency vehicles lining the road leading up to the bridge.The bus' front axle appeared separated from the vehicle and at least two doors to luggage compartments had been ripped off the side. The roof of the bus also appeared damaged.The bus was traveling west, carrying the students home from Central Florida when it drove into the median on Interstate 10 and then into the ravine at Cowpen Creek, about 5:30 a.m. (6:30 a.m. ET), Mack said.The creek runs through the ravine, and there is water in the creek, but the bus did not land in the water, said Baldwin County Sheriff's Maj. Anthony Lowery.The last victim was extricated from the crash shortly before 9 a.m. (10 a.m. ET), Mack said."The next thing we needed to do was get blankets up here. Of course they were cold. It was 40 degrees this morning."Mark Kramer, a spokesman for Channelview Independent School District in unincorporated Harris County, Texas, said, "A charter bus transporting Channelview High School band students was involved in an accident on Interstate 10 in Alabama early this morning. At this time, details are limited."First Class Tours said in a statement that the bus was carrying students home from Orlando, Florida, and the company is cooperating with investigators."Our prayers are with the injured and their families at this time," the statement said.Baldwin County runs up the eastern edge of Mobile. A federal court in Texas sentenced ice cream manufacturer Blue Bell Creameries to pay .25 million in criminal penalties for shipments of contaminated products linked to a 2015 listeriosis outbreak, the Justice Department announced Thursday.Blue Bell pleaded guilty in May 2020 to two misdemeanor counts of distributing adulterated ice cream products.The sentence, imposed by U.S. District Judge Robert Pitman in Austin, Texas, was consistent with the terms of a plea agreement previously filed in the case.“The results of this investigation reflect the determination of the Defense Criminal Investigative Service to hold companies that sell food products to the military accountable and ensure they comply with food safety laws,” said Michael Mentavlos, Special Agent-in-Charge of the DCIS Southwest Field Office. “The health and safety of our service members and their dependents are of paramount importance.”The .25 million fine and forfeiture amount is the largest-ever criminal penalty following a conviction in a food safety case.“American consumers must be able to trust that the foods they purchase are safe to eat,” said Acting Assistant Attorney General Jeffrey Bossert Clark of the Justice Department’s Civil Division. “The sentence imposed today sends a clear message to food manufacturers that the Department of Justice will take appropriate actions when contaminated food products endanger consumers.”According to the plea agreement, Texas state officials notified Blue Bell in February 2015 that samples of two ice cream products from the company’s Brenham, Texas factory tested positive for Listeria monocytogenes, a dangerous pathogen that can lead to serious illness or death in vulnerable populations such as pregnant women, newborns, the elderly, and those with compromised immune systems.Blue Bell directed its delivery route drivers to remove the remaining stock of the two products from store shelves, but the company did not recall the products or issue any formal communication to inform customers about the potential Listeria contamination.Two weeks after receiving notification of the first positive Listeria tests, Texas state officials informed Blue Bell that additional state-led testing confirmed Listeria in a third product.Blue Bell again chose not to issue any formal notification to customers regarding the positive tests. Blue Bell’s customers included military installations.In March 2015, tests conducted by the Food and Drug Administration (FDA) and Centers for Disease Control and Prevention (CDC) linked the strain of Listeria in one of the Blue Bell ice cream products to a strain that sickened five patients at a Kansas hospital with listeriosis, the severe illness caused by ingestion of Listeria-contaminated food.At least three people in Kansas died as a result of the contamination, according to the CDC.The FDA, CDC, and Blue Bell all issued public recall notifications on March 13, 2015. Subsequent tests confirmed Listeria contamination in a product made at another Blue Bell facility in Broken Arrow, Oklahoma, which led to a second recall announcement on March 23, 2015.According to the plea agreement with the company, FDA inspections in March and April 2015 revealed sanitation issues at the Brenham and Broken Arrow facilities, including problems with the hot water supply needed to properly clean equipment and deteriorating factory conditions that could lead to insanitary water dripping into product mix during the manufacturing process.Blue Bell temporarily closed all of its plants in late April 2015 to clean and update the facilities. A golfer in Colorado is recovering after being gored by an elk over the weekend, splitting one of his kidneys.Zak Bornhoft was at Evergreen Golf Course about an hour west of Denver on Saturday evening. He and his friends saw dozens of elk near the course and thought they would be safe if they kept their distance, according to reports.He tells local media the large elk charged at him while he sat in a golf cart near the 17th hole. The person driving the cart brought him to the clubhouse to get help.The Elk’s antler sliced his left kidney in two. Bornhoft was rushed to the hospital, and treated in the ICU. He is reportedly making a good recovery.Elk are allowed to roam freely in the area of the course, and wildlife officials say attacks on golfers are rare. 773

  

A judge ruled Wednesday that President Donald Trump’s son Eric Trump must testify in a New York investigation into the family’s businesses before the November election. State Judge Arthur Engoron said Trump must comply with a subpoena for his testimony no later than Oct. 7. Eric Trump's lawyers had claimed his “extreme travel schedule” on the campaign trail warranted a delay. The judge said the investigation and the court are not “bound by the timelines of the national election.” Democratic State Attorney General Letitia James is investigating whether the Trump Organization lied about the value of its assets in order to get loans or tax benefits.“We will immediately move to ensure that Donald Trump and the Trump Organization comply with the court’s order and submit financial records related to our investigation," James said. "Further, Eric Trump will no longer be able to delay his interview and will be sitting down with investigators in my office no later than October 7. To be clear, no entity or individual is allowed to dictate how or when our investigation will proceed or set the parameters of a lawful investigation. The court’s order today makes clear that no one is above the law, not even an organization or an individual with the name Trump.” 1274
