I would ask that you reserve judgment or comment on this case until you actually see the evidence presented by the parties.In the event that you will not, I understand that a person unfamiliar with most of the facts in this case, and a person unfamiliar with the obligations that individuals are under when they give deposition testimony, might perceive Mr. Ryan’s statement as noteworthy. It is not. First, as I doubt you’re aware, Mr. Evans himself has testified – unequivocally and under oath – that Mr. Ryan is not racist and was his friend; so whatever point Mr. Evans is trying to make by leaking deposition testimony to you is undone by his own words. Second, this testimony is not Founders’ defense in this case as you allege. Founders evaluated and decided to terminate Mr. Evans based only on his job performance. Mr. Evans’ poor job performance will be apparent when Founders files its upcoming motion. Third, through this testimony, Mr. Ryan was simply saying that he does not assume anything about individuals’ race or ethnicity unless they tell him that information. While it might be acceptable to speculate about this type of thing in casual conversation, Mr. Ryan was not having a casual conversation. He was under oath when he made these statements. As all deponents are instructed, Mr. Ryan was directed not to guess, assume or speculate in his deposition. This is the reason for his answer.The fact that Mr. Evans is selectively leaking this type of information to you indicates that, unlike Founders, he has no evidence to support his position in this case. PHOENIX, AZ — An Arizona family is searching for a U.S. Marine who left for Camp Pendleton on Monday but never arrived at the base.Lance Cpl. Job Wallace, 20, was last seen leaving a friend's house in Surprise, Arizona, between 8:30 and 9 p.m. Monday, his mother, Stacy Wallace, said. He loves the Marines, was recently promoted and was excited to get back to Pendleton after a three-day leave that took him home to the suburbs west of Phoenix and a camping trip. "He got into several colleges and missed scholarship opportunities just so that he could be a Marine, because he felt it was his duty to serve his country," Wallace said. Wallace said law enforcement officials told her that her son's phone was last pinged Monday night in Arizona. But a Border Patrol camera spotted his truck the next morning traveling eastbound on Interstate 10 near Fort Hancock, Texas, southeast of El Paso. A Surprise police spokesman says officers took a report and have turned the matter over to the Naval Criminal Investigative Service. "NCIS and our partners are working diligently to locate Lance Cpl. Wallace and bring him home safely," Kurt Thomas, special agent in charge of the NCIS Marine Corps West Field Office, said in a statement. He urged anyone with information on his whereabouts to contact the NCIS or local law enforcement. Wallace is 6'3" tall, about 205 pounds with brown hair and green eyes. PALOMAR MOUNTAIN (CNS) - Due to overnight snowfall and current low temperatures, chains were being required today on Palomar Mountain, the California Highway Patrol said.Only vehicles with chains, or four-wheel drive snow-rated tires, will be allowed access, authorities said."The CHP and the San Diego Sheriff's Department will be patrolling the area to monitor trespassing and make sure the roadways are kept clear of parked vehicles," said Oceanside CHP Officer Mark Latulippe, who pointed out there are limited facilities on Palomar Mountain for food, restrooms and trash.Mountain visitors were being urged to respect the privacy of residents and private property.Officials also recommend using extra caution on slippery roads, reducing speed and increasing following distance due to compromised visibility in wintery conditions.The CHP also reminded visitors to Palomar Mountain to "practice good snow etiquette."That involves:Parking only where legally allowed, and not blocking roadway accessfor emergency vehicles. Vehicles blocking any part of the roadway may becited or towed.Avoiding trespassing onto private property.
