SAN DIEGO, Calif. (KGTV) – A prominent harbor cruise company is continuing to operate despite being cited for violating a County health order. Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. Tuesday, a company spokesperson sent the following statement to 10News.“We are part of the Passenger Vessel Association, not recreational boating. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail. Harbor Police say they're documenting each sail the company is doing and incorporating those into the original citation that it sent to the City Attorney's Office. 2046

SAN DIEGO (KGTV): A new study shows that young adults are seeing a spike in deaths from liver disease related to binge drinking. It's especially dangerous in California, where high alcohol content drinks are popular.The study, published this month in the British Medical Journal, says that the number of 25- to 34-year-olds who died annually from alcohol-related liver disease nearly tripled between 1999 and 2016, from 259 in 1999 to 767 in 2016, an average annual increase of around 10 percent.It cites binge drinking as a leading cause, because of rising rates of alcohol consumption between 2002 and 2012.It's especially bad in California, which the study says was among the top five states for those types of deaths.Local experts say the kind of alcohol we drink may be to blame, as craft beers tend to have higher concentrations of alcohol."If someone was having highly concentrated alcohol, then they're consuming more drinks per hour," says Dr. Rohit Loomba, with the UC San Diego Health Liver Center. "That will have detrimental effects on the liver, for sure."The CDC recommends no more than 1-2 drinks per day for "moderate" drinking. Binge drinking is defined as 4 or more drinks over 4-6 hours. Loomba says you may hit the "binge" point in fewer drinks if what you're having is stronger.For example, a Bud Light has just 4.2% alcohol by volume. Craft beers often have 6% or higher, so one craft beer may be as much as 2 or 3 other drinks."That quantity of alcohol intake over years definitely will contribute to higher risk for liver disease," says Loomba.He says people should ask themselves four questions to determine if they are drinking too much:1. Have you ever cut down on drinking? 2. Would you be annoyed if somebody asked you to cut down on drinking? 3. Do you feel guilty after drinking excessively over a weekend? 4. Do you need an "eye-opener" in the morning to get to work?Dr. Loomba says if you answered "yes" to 2 or more of these questions, you should talk to your doctor to discuss treatment.He also says obesity combined with alcohol can lead to more severe liver problems and even death. People with diabetes or who are overweight multiply their risk of the disease."If you're obese, you not only should restrict your alcohol, but you should try to lose some weight as well," says Loomba.The study says the financial crisis may have led to more binge drinking in the past decade, as young adults turned to alcohol to cope with financial stress. Researchers found the rise in alcohol-related deaths overlaps with rising rates of binge drinking from 2002 to 2012 observed across much of the U.S.The good news, according to the study, is that many liver diseases are preventable and reversible."Once you stop alcohol use, you can reverse complications related to it in the majority of cases," says Dr. Loomba. 2882

San Diego (KGTV)- As Westin Hotel workers fight for better wages, local business owners are fighting to keep business.Hotel workers have been on strike for the past few weeks. Business owners say customers are now avoiding the area and its costing them money.Joey Aiello owns a shoe shine stand that sits outside of The Westin Hotel. He says he’s seen fewer customers this month because of the strike. “People don’t think its a big business but it supports my family,” says Aiello.He says since the workers hit the picket line, he’s lost 00 in business. “The first week they were here I made less than 0 a day. We have to make 0 a day to stay a float.” Other business also say they are concerned about the noise.The San Diego Police Department says they have received six complaints since October 9th. A spokesperson with Marriott International sent us this statement that says in part:“We are disappointed with some of the tactics the union has deployed including the noise levels. We continue to work with local police to address these issues and we are grateful to our guests for their patience during this time.”The Unite Here Union President, Bridgette Browning, says employees are now in negotiations with the hotel. She also sent us a statement that says:“While we are sympathetic to neighboring businesses - we believe the Marriott has the power to fix this strike and the businesses should be demanding that Marriott do the right thing. The workers are not to blame for the low standards that Marriott has created at the Westin San Diego Gaslamp. The workers are prepared to settle as soon as Marriott decides to do the right thing and sign a contract that provides living wages.”For business owner Joey Aiello, he says he won’t be able to make back the money he’s lost. “I just have to work harder and keep everything a float the best I can.” 1869

  

SAN DIEGO (KGTV)-- Thousands of people got their vaccinations Saturday, to kick off this year's flu season. The vaccination event was held at four Kaiser Permanente locations in San Diego County.For Byron Frohm, a trip to Kaiser Permanente in Mid-September is an annual tradition. "I can't think of any reason not to get it," Frohm said. The reason he does get the flu shot is his perfect, 40-year flu-free record. He says the vaccinations help him ward off the dangerous bug. "This virus is very strong," Shreya Chandra, MD. said. "It is hitting our community, and getting the vaccination really is prevention."Last season, health officials recorded 77 deaths in San Diego County. In the 2017-2018 season, there were 343 deaths. This was the highest number of fatalities since the county began tracking flu data nearly two decades ago. Already this year, there has been one confirmed flu-related death. The county said a 74-year-old Chula Vista man died August 15, 2019, due to complications from Influenza B. All the more reason for 76-year-old Frohm to stick to his regimen. "At my age, I'm probably more susceptible," Frohm said. Other high-risk groups include pregnant women, people with asthma, diabetes, and other illnesses. Some symptoms of Influenza include high fever, severe body aches, nausea, sore throat, and fatigue. This could last up to two weeks. Many people mistake the signs to that of the common cold. Doctors say many people who have the flu do not show any symptoms. But they can still spread the illness."I can still carry it and pass it on to elderly parents or people who can potentially get really sick from this virus," Dr. Chandra said. That is why Dr. Chandra strongly recommends the annual vaccine. She believes the best treatment is prevention. "We have State-of-the-art care and medicine. We live in San Diego. But the point of this vaccination is that we never need State-of-the-art care. You never get sick in the first place," Dr. Chandra said. 1990

(KGTV) - After serving active duty in the Marine Corps from 2013 to 2017, Cole Lawton pictured himself when he heard the news that nine service members had died in a routine training incident involving an AAV. Lawton said he has been inside an AAV and can imagine the terror those eight Marines and one Sailor must have felt in the moments when the AAV sunk.“I couldn’t help but imagine myself when I was in those amtracs if the same thing had happened to me … and that’s a nightmare,” he said.RELATED: Service members in deadly Southern California amphibious assault vehicle accident identifiedLawton also is a lover of the ocean and has a passion for diving, so he wanted to pay tribute to the nine lives lost using his skills. He and a group of friends took an American flag and the Marine Corps flag diving and took photos with the flags in the deep water. They posted photos with the caption “In memory of the Marines and Sailor of 1/4 who's amphibious vehicle sank to the ocean floor, we raised the colors at sea to show even 130 feet underwater, freedom still rings. Gentlemen, Marines have officially taken Davy Jones Locker.”The post exploded online and as of Sept. 11, had been shared more than 13,000 times. Family of the nine people killed even commented, thanking the divers for their tribute.“From the brotherhood of the Marines to the families extended by the Marine Corps, it’s all the same. It’s powerful to me. And it meant a lot to me that it meant a lot to them,” said Lawton. 1522
