SAN DIEGO, Calif. (KGTV) - Nearly six years after it passed, Proposition B will be in front of two courts this week, with the future of San Diego pension reform on the line.Prop B was on the ballot in June of 2012 and passed with 65% of the vote. It promised to solve San Diego's pension crisis by giving new City hires a 401(k) style retirement plan instead of a pension. The change went into effect for all city hires except police officers.Since then, it's been mired in legal challenges.Shortly after it passed, union leaders sued, arguing that any changes to union employment agreements have to be negotiated first before they're placed on a ballot. They said that then-Mayor Jerry Sanders violated that rule when he openly campaigned for the Proposition in 2012.In 2015, the State Labor Board agreed with the union claims.That ruling went to the California 4th District Court of Appeals, who overturned the Labor Board's findings in 2017.In 2018, the State Supreme Court reversed the 4th District's ruling. The Supreme Court sent the issue back to the lower courts to decide what an appropriate "remedy" would be to Sanders' improper campaigning."They did not say 'Overturn Prop B.' They could have," says Reform California's Carl DeMaio, who wrote Proposition B. "They said, 'Hey, district court, find out how you punish the City of San Diego for this violation.' What’s the punishment? A slap on the wrist, a speeding ticket?"The 4th District will hold an open session on Monday, March 11 to begin that process. DeMaio says if the District Court rules to overturn Prop B, he plans to appeal that decision."Do you think they’ll actually overturn the citizens initiative? If they do, we will counter-sue on the punishment phase," says DeMaio.Meanwhile, the US Supreme Court will also look into the Proposition this week. On Friday, they'll decide whether or not to hear a case based on the First Amendment. Supporters of Prop B say the California Supreme Court's ruling violated Mayor Sanders' First Amendment rights of free speech and his ability to openly support or oppose items on a ballot."The issue is whether for not elected officials have first amendment rights," says DeMaio. "Can an elected official actually give an opinion on a ballot measure? I think yes. Even if I disagree with that opinion, it is their constitutional right. He doesn’t lose his personal free speech rights to take positions once he's elected."The US Supreme Court will announce their decision on Monday, March 18th. 2515

Many are desperately looking for qualified tutors as families safely go back to school. But we found that the demand for tutors is not matching up with what is currently available.As the start of the distance-learning school year approaches, parents are beginning to feel the pressure."Desperate," parent, Cortney Lemos-Crawford laughed. "Desperate because of my own sanity!"Lemos-Crawford says she and her husband are fortunate to still have their jobs during the pandemic. But it is demanding. Distance learning for their 8-year-old daughter in March was not easy."It's very difficult, as you can imagine, to work full-time and have your child present, let alone present and needing your interaction," she said.She says it was hard for her daughter to concentrate at home, in a relaxing environment, with toys all around. She also does not want her daughter's formative years to suffer because of her own work schedule. So for weeks, she has been searching for a personal tutor.Jamie Evans and her partner Hannah Obradovich are former teachers who now run Ignite Learning Center in La Jolla. They provide K through 12 and Special education support around the county."We have been inundated with parents wanting us to form 'Pandemic pods,' garage groups, working outside, working with small groups with different age children to hire us to be their teachers," Evans said.But Evans says the supply of accredited teachers and tutors are not even close to the recent demand from desperate parents."We are in a rush to hire more teachers," Evans said. "I already talked to three people this morning, and I'm going to an interview right now."Lemos-Crawford says her tutor search so far has come up empty."I've had a couple of leads, but those people have been snatched up," she said.But she is not giving up. SAN DIEGO, Calif. (KGTV) - The VA San Diego Healthcare System began distributing its first doses of the COVID-19 vaccine Tuesday, Dec. 22.The VA received 2,800 doses of the Moderna vaccine, which is enough for their whole staff and everyone on their priority list. The first people to get the vaccine were people who either work or live in nursing care facilities and also people in the spinal chord injury unit. The VA anticipated being able to get all of those people vaccinated in the first day.Next for the VA are people in the ICU, emergency departments and those directly caring for coronavirus patients. It was estimated that all of those people should be vaccinated in the first day or two.Doctor Robert M. Smith is the director of VA San Diego Healthcare System and said their priority is getting people vaccinated quickly. He said they do not plan on saving any of the doses that are needed for a second vaccine 28 days after the first is injected. Rather, they will rely on the chain of command to get them those second doses in a timely manner, vaccinating as many people as they can in the meantime.“We and the rest of San Diego are seeing a huge increase in the number of COVID patients right now and it’s really straining resources so we need to make sure our staff can stay well so they can provide that care,” said Smith.Smith said they are starting with giving out 300 doses per day, hoping to be able to give up to 600 doses per day eventually. Once all staff are vaccinated in the next few weeks, the focus will be on the community and the 120,000 eligible veterans who are covered by the VA.He advised veterans in the community to not reach out to the VA, saying at first, the VA will be prioritizing some veterans and contacting those who are eligible, then eventually the VA will be more flexible with allowing other veterans to walk in and get the vaccine. 1888

SAN DIEGO, Calif. (KGTV) -- A group of University City residents is suing the city of San Diego over its plan to pump sewage under their neighborhood to be turned into tap water. The nonprofit University City Community Foundation filed the lawsuit after raising ,000 from residents to challenge the environmental impact report for the city's Pure Water pipeline. The suit doesn't challenge the city's goal of making heavily treated reclaimed water one-third of its supply by 2035. The city says that will protect against future shortages and price increases. The lawsuit, however, says the city did not explore alternatives and did not adequately notify the public of the project's pipeline. It will pump sewage from the Morena Area, through Clairemont and University City, to a treatment plant at UTC. "There's no 100 percent guarantee that there could not be a leak, there could not be some discharge," said U.C. resident Barry Bernstein, who supports the lawsuit. "There could be some discharge. There may be some problems with the purification system."Ruth DeSantis, who heads the foundation, said the city and foundation are now in settlement talks. A city spokesman declined to comment on the lawsuit, but said there are multiple protections in place - including a system designed to immediately cut off to avoid sewage geysers. He said the city still plans to break ground on the project by early next year.  1476

San Diego (KGTV)- As teachers come up with their virtual lesson plans for the upcoming school year, one local music teacher is turning to the community. Students at Grossmont High School need guitars for class."We'll have 80 students plus taking guitar this year," says teacher Jeremy Cooke. "It is vital for them to be able to play a guitar at home."The high school is not able to provide an instrument for each student."We're a Title I school. So over half of our students get free or reduced lunch, and many can't afford their own guitar."Cooke made a post on Facebook asking for the community to donate any used or new guitars. He says the response has been amazing. As of Monday afternoon, Cooke has received over 30 guitars. Many others are pledging to donate."I've been driving around the county picking up guitars, meeting the people who are donating, and its really neat to see, especially during these tough times."As part of his distance learning plan, Cook has compiled multiple videos recorded over the years to help students learn to play the guitar.Once the class is finished, the students will return the donated guitars to the school for others to use the following year.Grossmont High School is still in need of more guitars. Cooke says he is accepting used and new acoustic or electric guitars for the upcoming school year.
