SAN DIEGO (KGTV) - A Los Angeles area man says the San Diego County District Attorney's office charged him with a crime he didn't commit.Angel Galvan says the mistake cost him money, time and when you search his name at the courthouse a court file."For me to go through all of this, it hurt a lot," said Angel Galvan.Galvan says in July of this year, he received a letter from the San Diego County District Attorney saying he'd been charged with Grand Theft of Personal Property from Go Wireless. He thought it was a mail scam."What is PC 487," Galvan said.It was no scam.Galvan says the district attorney's office claimed he and other people were using stolen credit cards to buy merchandise from a Go Wireless location in the San Diego area."I hope you realize I live in the valley (San Fernando) like I don't live nowhere near San Diego," Galvan said.Galvan lives in Panorama City, that's in Los Angeles County, about two and a half hours from San Diego.Galvan says he did work at a Go Wireless store near his home, but for only two months, and that was back in 2017. The alleged crime happened in March of 2018."Every day I got home, I was stressed," Galvan said. "I couldn't believe it," he said.According to a claim, Galvan filed with the County of San Diego, "It turns out that another individual named Angel Galvan worked at Go Wireless, but worked in San Diego, committing crimes."Team 10 obtained an email sent by a San Diego County Deputy District Attorney in August of 2019 to Galvan's criminal attorney acknowledging he was not the correct Angel Galvan.The email stated, "HR at Go Wireless mixed him up with another Angel Galvan. I will calendar a dismissal asap. Sorry for the mix-up.""No one called him, no one looked to see if it was the right person, no one checked his address no one checked his work records," said Galvan's civil attorney Alex Ozols.Ozols claims the District Attorney's office did not do any further investigation after receiving Galvan's information from Go Wireless, and that's a problem."A lot of time, they do get it right, and we appreciate that they are representing the state of California," Ozols said. "However, when they get it wrong, the repercussions are just so bad when they do, and in this case, they did."Galvan tells 10News he had to sell his truck to pay the legal fees. He also had to drive to San Diego for an arraignment where he was order to do a book and release. He says he was fingerprinted and had his DNA taken.According to the claim, "He will/does have this listed on his Department of Justice print out, he is still in the police system, an arrest records still exists, and his DNA was taken against his 4th amendment constitutional right because he was charged with a felony."Galvan says he lived in constant fear he'd go to jail, and his son would grow up without a father."I work 50-60-hour weeks. I barely even see my son now, and the last thing I wanted to do was go to jail and not be able to see him at all," Galvan said.Galvan said when the case was finally dismissed there was a wave of emotion."It hurts a lot because of everything I went through," he said.Both the San Diego County District Attorney's office and Go Wireless said they couldn't comment on pending litigation.Galvan's attorney tells 10News the County of San Diego rejected the legal claim, and they do plan to file a lawsuit.Court records show there is an ongoing court case involving another person named Angel Galvan. 10News tried to track that person down was unable to speak with anyone. 3540

SAN DIEGO (KGTV) — A San Diego company says they have the solution to make people recycle more and get back the money they spend on redemption fees. One Earth Recycling wants to put the redemption centers in high-traffic areas like malls and grocery stores, rather than their usual spots in industrial areas of the city."Our goal is not to try to exceed people's expectations of recycling, we're trying to develop a whole new category of recycling," says One Earth CEO Josh Turchin.RELATED: California considers overhaul of bottle and can recycling programEvery year, Californians leave hundreds of millions of dollars on the table because of unredeemed cans and bottles. Turchin says the biggest problem is that it's not easy to find redemption centers, and they're not always the most welcoming of places."This program has been hijacked by opportunistic operators who have just strip-mined the model and operate it as inexpensively as possible," he says.To counter that, Turchin plans to open 100 small-scale redemption centers at malls and grocery stores across California. Putting them where people already shop will make it easier for them to bring back redemption bottles and cans."We focus on marketing to the soccer mom set, kids and across demographics to make recycling something everybody has access to," says Turchin.RELATED: Residents voice concern over North San Diego County recycling center projectThe first One Earth Recycling center is already set up at the Westfield Mission Valley parking lot. SAN DIEGO (KGTV) -- A Marine was killed in a hit-and-run accident in the Midway District just after 7:00 p.m. on Saturday night, according to San Diego Police.The victim, who was in his early 20's, was visiting an establishment with his friends earlier that night.At some point, his friends could not find him. Police said he walked or fell into the street in the 2700 block of Midway Drive.Police said a car hit him and took off toward Rosecrans Street. There was no description of the driver or vehicle available. Police were checking surveillance video and his phone to find out more information. SAN DIEGO (KGTV) — A San Diego man is back in the U.S. after being held in a Mexican jail since Sunday. Rob Thomas, a Marine veteran and avid surfer, had been kept in custody after Mexican authorities determined he was at fault for a traffic collision that sent four people to the hospital, according to friends and local news outlet Rosarito en la Noticia.Under Mexican law, drivers found at fault in a collision can be detained until they prove they can cover the estimated costs of the crash. Thomas did not have valid car insurance in Mexico, so authorities demanded a cash bond, said longtime friend Mikey “Beats” Beltran. The amount of the bond was negotiated by an attorney representing Thomas, but it could be ,000 to ,000, friends said. “This is without a doubt a traveler’s worst nightmare, ending up in a foreign jail surrounded by people that don’t speak your language,” he said. “They don’t feed the people in detention, and so friends of ours that are down there, they’ve had to feed him daily.”Thomas was in Rosarito on a surf trip. After eating tacos with his girlfriend, Thomas made a left turn in his pickup truck and collided with a passenger van Sunday around 5:10 p.m. on Highway Rosarito-Ensenada near the Las Rocas hotel.Two adults and two children in the passenger van were taken to the hospital, Rosarito en la Noticia reported.Thomas' mother, Pauline Thomas, said the U.S. Consulate provided a list of attorneys, but otherwise not much help."I’ve cried so much, my eyes are almost swollen shut," she said by phone from Kansas. SAN DIEGO (KGTV) -- A man who was ambushed and shot eight times by two gunmen early Sunday morning suffered non-life-threatening injuries, a San Diego Police Department officer said.The shooting happened at around 12:20 a.m. at 4700 Uvas St. in the Chollas View neighborhood between 47th and Market streets in San Diego.A 27-year-old male victim was standing on the sidewalk when a white sedan pulled up, said SDPD officer Robert Heims. Two Hispanic males got out of the vehicle and fired several rounds at the victim, striking him eight times. The suspects got back in the car and fled northbound 4700 Uvas St., said Heims.The victim was transported to the hospital and with non-life-threatening injuries. No other information about the victim or his injuries was released at time.The suspects were described as Hispanic males wearing black plaid shirts.
