A federal judge ruled Monday Pennsylvania’s Governor Tom Wolf’s COVID-19 pandemic restrictions are unconstitutional.Four counties in the state filed a lawsuit claiming the governor’s orders closing non-life-sustaining businesses and limiting outdoor gatherings, and stay-at-home orders were unconstitutional. They stated the orders were "arbitrary, capricious and interfered with the concept of 'ordered liberty' as protected by the Fourteenth Amendment."Plaintiffs included hair salons, a drive-in theater, other businesses, as well as state representatives and congressman Mike Kelly.In his ruling, the judge says the governor’s actions likely had good intentions, “to protect Pennsylvanians from the virus," but that "even in an emergency, the authority of government is not unfettered."U.S. District Judge William Stickman IV ruling reads, “"(1) that the congregate gathering limits imposed by defendants' mitigation orders violate the right of assembly enshrined in the First Amendment; (2) that the stay-at-home and business closure components of defendants' orders violate the due process clause of the Fourteenth Amendment; and (3) that the business closure components of Defendants' orders violate the Equal Protection Clause of the Fourteenth Amendment."In his written opinion, Judge Stickman continued his explanation of his ruling."There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures,” Stickman wrote."Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. A Brownsville, Texas man has been sentenced to 50 years in prison after stealing and reselling .2 million in fajitas from a juvenile detention center over the span of nine years.Gilberto Escamilla had previously pleaded guilty to felony theft charges.Escamilla was caught last summer after he took a day off work from the Darrel B. Hester Juvenile Detention Center for a doctor's appointment. A driver called the kitchen at the juvenile center saying they had 800 pounds of fajitas to drop off.The center did not serve fajitas, but the driver said he had been delivering the meat to the center for nine years.After the driver spilled the beans, investigators found packages of fajitas in Escamilla's fridge where he reportedly sold the meat to separate buyers.Escamilla was fired from his job in August.The-CNN-Wire 865

A California university is using testing and contact tracing to stop a large outbreak of Covid-19 among fraternity houses, according to media reports.The University of Southern California has reported at least 150 positive coronavirus cases. Los Angeles-area media reports that dozens of those cases were traced to three or four fraternities near campus.The fraternity houses are off-campus, and it is not clear if the infected people were fraternity members or just students renting a room for the summer.Dr. Sarah Van Orman, chief health officer of USC Student Health, does not believe the students got Covid-19 from a party."And because people live in close proximity, they sort of spread it to each other," Van Orman told ABC7. "It was not large fraternity parties, they were small gatherings, but unfortunately, it was enough to allow it to spread to these communities."Van Orman said the number of cases at the university “dropped dramatically.” She said since the first report of cases on July 9, the university has used continued testing and contract tracing to identify exposed people. 1102
