Former Boulder District Attorney Stan Garnett explained the statute in an interview with Denver7 Friday.In court Tuesday, Watts answered questions from the judge of whether he understood the charges against him with short responses of, “Yes sir.”Watts and his attorney waived his right to a preliminary hearing within 35 days and asked for a status conference to be held instead. His attorney and prosecutors agreed that an evidentiary and discovery hearing could be held in the case as well.Prosecutors will have 63 days after Watts' arraignment to decide if they will seek the death penalty in the case. If they do not, Watts would face mandatory life in prison without the possibility of parole if he is convicted on any of the murder charges.Shanann’s father and brother, Frank Rzucek and Frank Rzucek Jr., both attended the hearing. The elder Rzucek was visibly emotional during the hearing; his son comforted him as he buried his head in his hands and wept as the charges against Chris were read.The affidavit for Watts' arrest was ordered unsealed Monday and was released Monday afternoon. It says that he was having an affair that he had previously denied to police, and that he claimed that Shanann had strangled their daughters, Bella and Celeste, after he told her he wanted to separate.Watts was arrested late last Wednesday and has been held without bond ever since.His pregnant wife and daughters, 34-year-old Shanann, 3-year-old Celeste and 4-year-old Bella, were reported missing last Monday by a family friend after Shanann missed a doctor’s appointment.A day after the three were reported missing, Chris Watts gave an interview to Denver7 in which he pleaded for the girls to come home and said he and his wife “had an emotional conversation” before he allegedly last saw her.Shanann’s body was discovered in a field on Anadarko Petroleum Company property. Court documents show her body was found in a "shallow grave near an oil tank." Her daughter’s bodies were discovered concealed within oil tanks nearby, sources told Denver7. Court documents filed late last week show experts were advised the bodies were in tanks filled with crude oil "for several days." Chris Watts had been an Anadarko employee but was fired by the company Wednesday.At a news conference Monday, Weld County District Attorney Michael Rourke declined to elaborate on the case beyond the documents that were released.At the same news conference, Rzucek delivered a brief statement: "We would like to thank everyone in the Frederick Police Department and all the agencies involved for working so hard to find my daughter, granddaughters and [unborn child] Nico," Rzucek said. "Thank you everyone for coming out to the candlelight vigil and sending all your prayers. They are greatly appreciated. And keep the prayers coming for our family. It could crest at more than 46 feet (14 meters) by Wednesday night, officials said. About 4,000 residents in two dozen river communities were ordered to evacuate Tuesday evening but officials estimate only about half heeded the orders, Crum said.Jeff Bridges, co-owner of the R3 Hotel in Guerneville, said he and others who stayed behind were well prepared to ride out the storm. The often-waterlogged Venado weather station 5 miles (8 kilometers) from Guerneville recorded more than 20 inches (50 centimeters) of rain in 48 hours.In the Sierra Nevada, which has already seen a month of heavy snow, two Amtrak trains together carrying nearly 300 passengers stopped and reversed directions because of an avalanche that closed railroad tracks. Service on Amtrak's California Zephyr between Reno and Sacramento, California, has been suspended until weather conditions improve, Amtrak spokeswoman Kimberly Woods said.California officials were also concerned about potential mudslides in saturated wine country hillsides and in areas scarred by wildfires in 2017.A mudslide Tuesday near Monte Rio trapped a man and a woman before they were rescued, messy but unharmed."I fell into the mud when the tree fell over the top of me. It happened so fast you don't even know," Kear Koch told KGO-TV.Elsewhere in the area, several people had to be rescued from cars stranded while motorists tried to drive through flooded roads. Nina Sheehan, who is visiting from North Carolina, had to abandon her rental SUV after it got stuck in a flooded hotel parking lot."We made a decision to take the rental car through the waist-high water and we got two thirds of the way and then the car stalled," she said. "Do not try to go through any water over a foot high because you never know what you're going to find."Firefighters in Monte Rio worked through the night pulling people out of cars stuck in flooded roadways and getting people out of their homes as water approached, Fire Chief Steve Baxman told the Press-Democrat newspaper of Santa Rosa."We took 17 people out of cars and houses during the night. (AP) -- Authorities say a thief took a break during his burglary of a Southern California pizzeria to make himself a pizza pie before fleeing with the restaurant's delivery car.Police say Oscar Sanchez broke into Big Slice Pizza in Fullerton, Calif., on Nov. 8. He was arrested on Wednesday and police posted security video of the pizza-making on Facebook on Friday.Officials say Sanchez allegedly also stole the pizzeria's cash and tablets.Security footage shows him stretching dough at the restaurant's counter.It was not immediately clear if he had an attorney who could speak on his behalf. 620
