LA JOLLA, Calif. (KGTV) — La Jolla's Children's Pool has closed for the season to make way for seal pupping season on the beach's shore.The annual closure went into effect Sunday and will extend until May 15, 2020. During the closure, visitors will not be permitted to use the sheltered beach and, much like the rest of the year, be discouraged from getting too close to the seals.The closure is meant to give harbor seals a safe area to birth and wean their young for the season. Park rangers and lifeguards will monitor the beach to make sure both the public and seals are kept safe.RELATED:Coastal Commission approves permit to protect seals during pupping seasonChildren's Pool sea wall could be deteriorating faster, historical architect saysCity officials began closing the beach for pupping season in 2014, after environmental activists voiced concerns over the safety of young seals born and cared for at the Children's Pool. For years afterward, the city was tied up in litigation over the beach and ability to close it to the public. Critics argued the closures violated the state Coastal Act and the federal Marine Mammal Protection Act.In June 2018, a state appeals court ruled in favor of the city and the ability to close the beach for the season. A year later, the California Coastal Commission renewed a 10-year permit to close the Children's Pool to human access during pupping season.Critics have threatened to take the matter to the state Supreme Court, but the matter hasn't moved that far as of yet.The Children's Pool was opened in 1932 as a space for inexperienced swimmers to enjoy the water safely behind a seawall. Seals started convening on the beach in the 1990s and have since used it for pupping season.The California Coastal Commission has said they believe the water is unsafe due to bacteria levels from the seals and their excrement and encourage visitors to find somewhere else to swim.Officials have also been forced to post signs warning visitors to keep their distance from seals year-round, as the animals could feel threatened if humans come to close to them or their young. 2122

(KGTV) - A La Mesa dessert shop is beating the odds, flourishing through the pandemic.Toran Grays opened Extraordinary Banana Pudding March 14th, the day after the President declared a national emergency due to the coronavirus.Grays was set up for success from the get go, with prepackaged desserts available for take out, and partnering with Door Dash so he could be COVID compliant."I didn’t know COVID was going to hit so fast, but I did have belief in my product, so I said you know what I’m going to give it a try, you gotta try something at some point in your life if you want to do something great," Grays said.He tried starting up at least two other businesses before Extraordinary Banana Pudding,"I started a clothing company, an online shipping company, none of it worked before."Grays was determined. He grew up in Webster and Imperial Beach, and as a kid his grandmother came to visit, "my grandmother came down here from Mississippi, she made [banana pudding] for a bunch of our family members and I fell in love with it instantly!"Grays said it was his great-grandmother's recipe that's been handed down generations. After his grandmother passed away he realized he could keep their legacy alive.He struggled at first getting the permits for the business, but once the doors opened and customers tasted his creations, they were sold.He expanded from the traditional banana pudding flavor to everything from cheesecake to pistachio.Thursday a couple drove all the way down from Oceanside for the pudding that's catching fire on social media.Grays said a family came all the way from Texas and vowed to come back every summer until he could open up a location closer to home.Grays' business has been so successful, he's opening another shop in Las Vegas in August, headed by his brother. I guess you could say the proof was in the pudding."It’s been a blessing the community has been really really supportive and I couldn’t imagine this, I really couldn’t," he said getting emotional.Success holds a deep meaning for him and his family and he wants to encourage others to chase their dreams, "you gotta go out and get what you want, you gotta try out here because look, I did it in the middle of COVID so can you."A feat even more impressive after looking at the statistics. LINCOLN, Neb. (AP) — The owner of a pharmacy that provided drugs to Nebraska for use in a 2018 execution is expressing remorse for making the sale, but acknowledging that he knew that prison officials wanted them for a lethal injection.Public records released late Thursday show that Community Pharmacy Services, a pharmacy in Gretna, Nebraska, agreed to sell the drugs to the Nebraska Department of Correctional Services for two payments totaling ,500.State officials had refused to identify their supplier until the Nebraska Supreme Court ruled in May that they cannot withhold that information.Pharmacy owner Kyle Janssen says the drugs supplied to the Nebraska Department of Corrections were used in the August 2018 execution of Carey Dean Moore, the first death by lethal injection in the state. Moore was convicted of murdering two cab drivers in Omaha.In a statement obtained by The Associated Press, Janssen said his pharmacy has not supplied drugs to any department of corrections since the sale and will never again.“I regretted the decision as it does not align with our company’s values to provide the best patient care and customer service to the long-term care industry,” said Janssen. 1210
