FALLBROOK (KGTV) -- A couple looking to buy a home in the North County wants to share an experience they're describing as negative as the new solar energy law goes into effect in 2020.The law requires that homes built in California starting in 2020 must have solar panels. It has caused confusion among potential homebuyers, like Brian and Carmen McKay. They recently left Las Vegas, looking to move back to San Diego County.“I used to work at Fallbrook skilled nursing many years ago,” said Carmen McKay. The couple found a home they liked in the Horse Creek Ridge development, a new housing project in Fallbrook.“When we realized it was a corner lot… oh my gosh, we loved it,” Carmen said.They were told the cost was roughly 5,000—which sounded like a reasonable price for San Diego, according to the McKays. That is when they say they got a surprise from the sales representative.“Then she says, by the way, once we were sold on the house and the price… there’s solar panels on the house. You have the option to lease it or buy it. And we’re like, why?” Carmen said.They said during the home tour, solar panels were not mentioned at all. Carmen said the sales representative only mentioned it when they were back in the office, ready to sign documents to buy the home. As the McKays were questioning solar, they were told “it’s required by the state.” That is only partially true. A spokesperson for the California Energy Commission told Team 10 that “the law only applies to homes that have been permitted after Jan. 1, 2020.”“If that’s not the case with the home in question that you mentioned, then the mandate does not apply,” wrote energy commission spokesperson Edward Ortiz.The McKays were told it would be about ,000 extra to buy the solar panels.“I think that it was misleading because we were buying a house that we were told it was 5, but it’s actually 5 or we’re paying a higher monthly out of pocket,” said Brian McKay.The seller knew they were on a time crunch.“We sold our property [in Nevada]. We’re at an AirBnB… we need to buy,” Carmen added.Nobody at the sales offices at Horse Creek Ridge would comment. Team 10 was directed to public relations. Through email, the spokesperson said:“Two separate state energy requirements guide D.R. Horton in its decisions regarding home design options in the state of California – the current State Energy Code requirements (commonly known as Title 24) and the State‐Mandated Solar requirements, which take effect in 2020. In most communities, we have found that solar is the best, most cost‐effective option for both D.R. Horton and our homebuyers to meet the current Title 24 Energy Code requirements. Thus, Horse Creek Ridge was designed using solar to meet the current Title 24 requirements, and as a result, we are required by the state to have solar on each home in the community.”When asked why that was not told to the potential homebuyers from the beginning, during the tour of the home, D.R. Horton spokesperson added that “solar requirements are communicated to customers via numerous marketing materials… and as an addendum to the home purchase agreement.” She pointed to an 8-page brochure, where solar is mentioned once on page 7. She also sent Team 10 an image of solar displayed on a model home—something the McKays said they never saw.There is no mention of solar or photos of any homes with solar on Horse Creek Ridge’s website. “I feel like I was deceived,” Carmen said. “We fell in love with the place. I felt like I was pushed in the corner.”Dan Zimberoff is an attorney not involved in this case, but he has seen solar disputes in the past. “A buyer needs to be aware,” Zimberoff said. “If you’re purchasing a new home and you see what that price is, ask the details. Is that really going to be the final price?” “We’re starting to remember why we left California,” Carmen said.The McKays ultimately decided not to buy the home. They hope their experience teaches others about the right questions to ask. “We were willing to pay the higher cost to live here, but I don't like being misled by builders,” Brian said. (KGTV) -- Neighbors in an Escondido neighborhood are worried after they say dozens of tires were slashed overnight Saturday.The incidents reportedly happened on 4th Avenue and 2nd Avenue between Date and Elm Streets.Residents on 4th Avenue reported waking up Sunday morning to find that at least 11 vehicles had their tires slashed.Similarly, residents on 2nd avenue reported that nearly 30 vehicles had slashed tires.Police said they have been made aware of the incidents but it’s unclear if they have a suspect or will be investigating.Imagine waking up and finding your tires slashed, then finding out it happened to DOZENS more on your block. ESCONDIDO, Calif. (KGTV) -- It was a murder-mystery that gripped San Diego County. The family of 12-year-old Stephanie Crowe, waking up on the morning of January 21, 1998, to a horrifying discovery.Stephanie - lying dead on her Escondido bedroom floor in a pool of blood, after being stabbed multiple times.Her family told detectives they were asleep inside the house when the murder happened and heard nothing. Detectives say they found no signs that someone forced their way inside.The investigation and court battles that followed would change the way law enforcement collects evidence and performs interrogations."It was a case where there were clearly major problems with the investigation," said Brad Patton, Richard Tuite's criminal defense attorney. "The problems with the investigation related to the crime scene."Patton spoke with 10News on Thursday, nearly 20 years after Stephanie's death. He told 10News the problems surround the case were how police collected evidence and how detectives interrogated suspects. Problems that caused the case to turn cold - letting Stephanie's true killer continue to walk the streets in San Diego County.  "I don't think the Crowe family will ever get closure," Patton said. Who killed Stephanie Crowe?In the months after her death, Stephanie's 14-year-old brother, Michael and two of his friends would be charged with the murder. A knife was found under the bed of John Treadway. Both he and Stephanie's brother Michael later confessed to detectives during videotaped interrogations.The boys were subjected to intense, prolonged questioning and deprived of food and sleep. The confessions were later judged to be coerced and the charges were dropped. Then, a new suspect. Richard Tuite. He was a transient and diagnosed schizophrenic. Brad Patton was his defense attorney. Tuite was seen in the Escondido neighborhood that night - banging on doors, looking for an old girlfriend. Most damning of all, he was seen wearing a sweatshirt with Stephanie's blood on it. "Mr. Tuite could not, did not, go into that house. There was no forensic evidence of him being in that house," Patton said. There were no hairs, no fibers, no DNA. Tuite claimed he found the sweatshirt while dumpster-diving. Tuite was convicted and would spend more than a decade behind bars. Then, he got an appeal.  An appeal where he was found not guilty of voluntary manslaughter. Stephanie's parents never suspected her brother. Years ago, her mom had this to say to 10News, after Tuite was cleared:"I just hope that North County is aware that he's going to be out walking the streets and that people lock their doors."The murder of Stephanie Crowe is still unsolved.Patton says there's only one way he sees the mystery solved. "You're probably never going to find the actual killer unless that person comes forward at some time," he said. The Crowe family has since moved to the Pacific Northwest. ESCONDIDO, Calif. (KGTV) - A retired Escondido homeowner is figuring out how she'll pay for Thanksgiving dinner after everything she bought for the holiday was spoiled during a power outage.On a fixed income, Carol Marbrey purchased the meal at the beginning of the month.“I was never warned that my electric would be turned off, and then I was told it would be on by 7:30 AM, then I was told it would be on by noon, and this is all online, and then I was told it would five at night.”Marbrey came home that night to a dark house; power wasn't restored until the next day.The outage happened earlier this week during the extreme wind conditions and Red Flag Warning countywide.San Diego Gas & Electric says some customers weren't warned because it was a fluid situation, with weather conditions changing by the hour.  A spokesperson tells 10News after power is shut off, technicians must inspect hundreds of miles of lines before turning them back on.Marbrey says she called the company several times to understand the situation.“I was getting different answers as to why our electric was not going on," said Marbrey.An SDG&E spokesperson tells 10News they encountered an issue trying to re-energize Marbrey's circuit, by then it was getting dark, and they had to wait until the following day.Marbrey says she understands the necessity to keep the community safe but wishes she’d been better informed.She knows her situation could be a lot worse.“Our hearts really go out to those people that really suffered; we really respect the fire department, the electrical people that are on the ground, the maintenance people, everyone that's doing their best to keep us safe.”Marbrey estimates they lost 0 to 0 in spoiled food. Her efforts to get reimbursed by SDG&E have been unsuccessful so far.SDG&E says they generally don't reimburse spoiled food during an extreme weather situation, but that customers can still try and make a claim. 1967
