SAN DIEGO (CNS) - Military officials are preparing to transfer the remains of seven U.S. Marines -- including one from Montebello -- and a Navy sailor to Dover Air Force Base in Delaware over the next few days to be prepared for burial.The remains were recovered Friday after the Marines went missing near San Clemente Island when their amphibious vehicle sank during a training mission last month."Our hearts and thoughts of the 15th Marine Expeditionary Unit are with the families of our recovered Marines and Sailor," said Col. From Dover AFB, their remains will be released to their families in accordance with their wishes.RELATED: Remains of missing Marines and Sailor recoveredThe transfer of remains will not be open to the public.A group of service members and supporters went on an 8-mile hike Saturday morning in Carlsbad to honor the Marines and sailor.The U.S. military announced Tuesday it had located the amphibious assault vehicle that sank last week off the coast of San Diego County, killing the nine young servicemen, and confirmed the presence of human remains where the vessel came to rest on the sea floor.The naval Undersea Rescue Command made the discovery near San Clemente Island on Monday using video systems remotely operated aboard the HOS Dominator, a merchant vessel whose crew specializes in undersea search and rescue.The amphibious troop-transport vehicle was en route to a waiting ship during a maritime training mission about 80 miles west of Encinitas when it foundered for unknown reasons about 5:45 p.m. July 30, according to Lt. Gen. Joseph Osterman, commanding general of the 1st Marine Expeditionary Force.The 26-ton vessel went down roughly 1,600 yards from a beach on the northwest side of the island in water nearly 400 feet deep.Seven members of the Camp Pendleton-based crew survived the accident. Medics took two of them to Scripps Memorial Hospital La Jolla, where both were admitted in critical condition. One was later upgraded to stable condition.The other five rescued Marines received clean bills of health and returned to their units.Pronounced dead at the scene of the accident was Lance Cpl. SAN DIEGO (CNS) - A San Diego federal judge largely upheld California's private prison ban in a ruling stemming from dual lawsuits filed against the state by the Trump administration and a private prison firm.U.S. District Judge Janis Sammartino issued a preliminary injunction Thursday upholding in most respects Assembly Bill 32, which took effect Jan. 1 and prohibits the operation of private detention facilities statewide.By 2028, the law would bar all inmates from being held at privately owned facilities. The law also prohibits agencies from entering into new contracts for privately owned detention facilities or renewing existing contracts at currently operating facilities.The federal government and private prison firm The GEO Group argued that the law is unconstitutional because it encroaches on the government's operations to house federal inmates by unlawfully allowing a state government to regulate federal operations.Additionally, the government has argued that private facility closures will force the relocation of thousands of inmates at high cost to taxpayers, with inmates also forced to be incarcerated at greater distances from their families, especially if they are relocated out of state.The GEO group alleges that it will lose around 0 million per year in revenue if forced to close down its California facilities and could lose more billion in capital investment and revenue over the next 15 years.Sammartino ruled that AB 32 is a regulation of private detention contractors rather than the federal government and its operations and disagreed with plaintiffs' arguments that AB 32 interfered with congressional objectives to house detainees in private facilities, except in respect to United States Marshals' detainees.Sammartino wrote, "Congress clearly authorized USMS to use private detention facilities in limited circumstances, such as where the number of USMS detainees in a given district exceeds the available capacity of federal, state and local facilities."As AB 32 would prevent the use of private facilities when no available space exists in other facilities, she preliminarily enjoined enforcement of the ban in regards to USMS detainees, but it remains in effect for the U.S. Bureau of Prisons and ICE.According to court papers, 1,100 USMS inmates in California are housed in private detention facilities, representing about 22% of USMS statewide.Among those inmates, many are housed at San Diego facilities that include the Metropolitan Correction Center, Western Region Detention Facility, and Otay Mesa Detention Center.The United States and the GEO Group can file amended complaints within the next three weeks, according to Sammartino's order. 2706

SAN DIEGO (CNS) - A woman was seriously injured when she crossed into the path of an oncoming car in Linda Vista, police said Saturday.A 72-year-old woman had just gotten off a bus at a stop on Linda Vista Road near Tait Street around 5:20 p.m., according to San Diego Police Officer Robert Heims. She walked to a marked crosswalk and began to walk across the street against the signal, Heims said.At the same time, the driver of an approaching Toyota did not stop for the pedestrian and hit her, Heims said.Paramedics were dispatched and the pedestrian was taken to a hospital. She suffered extensive head injuries, Heims said.Police don't believe drugs or alcohol were factors in the crash. 700

SAN DIEGO (CNS) -- A San Diego man who allegedly had Molotov cocktails in his possession at last month's La Mesa police brutality protest is facing federal charges, the U.S. Attorney's Office announced Tuesday.Zachary Alexander Karas, 28, is charged with possession of an unregistered destructive device for allegedly having two glass bottles containing gasoline and wicks while at the protest, which began May 30 and carried over into the morning of May 31.According to the charging document, officers spotted Karas and his girlfriend sitting on the pavement at the corner of Allison Avenue and Spring Street at around 2 a.m. May 31.Karas was arrested for not leaving the area after dispersal orders were given by law enforcement, following the declaration of an unlawful assembly, according to the complaint.In an interview with law enforcement, Karas allegedly said "he brought the Molotov cocktails to the protest at the police station because he intended to use the Molotov cocktails to set fires, but ultimately did not cause any fires."Fires were set at the Chase and Union Bank branches and Randall Lamb Associates building near the site of the protest, but the complaint does not allege Karas set any of the fires sparked following the protest."The Constitution strongly protects the First Amendment right of all to speak out and peacefully protest," said U.S. Attorney Robert Brewer. SAN DIEGO (CNS) - A man was hospitalized in San Diego Saturday morning after being seriously injured when he laid down in front of his friend's car during an argument and was run over, authorities said Saturday.The incident occurred at 11:15 p.m. Friday in the 5800 block of Market Street in the Emerald Hills neighborhood, according to Officer John Buttle with the San Diego Police Department.The victim argued with his friend and in an attempt to get his friend's attention, he laid down in the street in front of a car the suspect was driving and was run over, Buttle said.A friend of the victim called 911 to report the incident and the suspect got out of the car and took the friend's cell phone and told the 911 operator the victim had laid down intentionally in front of his car, then the suspect drove away from the scene, said Buttle.The victim was transported to a hospital with serious, but not life-threatening injuries, he said.MAP: Track crime happening in your neighborhoodThe suspect's vehicle is a 2001 burgundy Mazda 4-door with California license plate number 7XNW211. 1095
