SAN DIEGO (CNS) - A man stabbed his housemate to death in Chula Vista two years ago, then stuffed the victim's body into a barrel that he and another man dumped into San Diego Bay, a prosecutor alleged Tuesday, while defense attorneys maintained that the evidence against their clients was entirely circumstantial. Timothy John Cook, 54, is charged with the Sept. 30, 2017, murder of Omar Medina, 28, and co-defendant Derrick Spurgeon, 40, is charged with being an accessory for allegedly driving the boat used to dump the victim's body, which was located 12 days later inside the barrel, which had been weighed down by a makeshift anchor made of wire and cinderblocks. Medical examiners said Medina had been stabbed more than 60 times in the chest, back, neck and head. In a text exchange with his brother, Cook expressed annoyance with Medina over his drinking and sloppy household behavior, leading Cook to eventually kick him out of the house, according to the prosecutor. Sommerville also noted that Medina had recently come into a substantial amount of money via an ,000 settlement he received in a lawsuit. Medina's family never heard from him after Sept. 30, and filed a missing person's report soon afterward with Chula Vista police. Medina's unlocked car was found about a week later on Oaklawn Avenue, not far from the home he shared with Cook on McIntosh Street. Numerous belongings, including his computer and guitar were inside the vehicle. Defense attorney Kara Oien countered in her opening statement that there was no hard physical evidence tying Cook to Medina's death, and told jurors the district attorney was relying on circumstantial evidence to come to a false conclusion that her client killed Medina. The attorney said the prosecution lacked a murder weapon and witnesses to the murder, which allegedly occurred during the daytime hours of Sept. 30 at the Chula Vista home. Oien said Cook's agitation over Medina's sloppiness was far from indicative of a motive to kill and that Cook would have tried to get closer to Medina if he really wanted his settlement money, rather than kicking him out of their house. Surveillance footage allegedly captures the men in a green Ford F-150 owned by Cook's half-brother, which is seen towing Spurgeon's boat from El Cajon to the bay. Somerville alleged that a barrel matching the one containing Medina's body can be seen in the bed of the pickup in the footage. She also said a search of the McIntosh Street home yielded additional indications that Cook was covering up the murder, such as removal of his home's kitchen sink and stripping down Medina's room, which was located in an attached building on the property. Oien said Cook was merely fixing up the home, and that he had an agreement with his landlord to make occasional repairs in exchange for lower rent. Spurgeon's attorney, Roland Haddad, said there was no evidence that his client had any knowledge of assisting Cook of disposing Medina's body, if Cook even committed the murder at all. The men exchanged phone calls on Oct. 11, but Haddad said there was no evidence regarding what discussions they had over the phone, nor what was said on the alleged boat ride when Medina's body was dumped into the water. 4056

SAN DIEGO (CNS) - Multiple local and nonprofit organizations around San Diego County will host Christmas meals Tuesday for underserved and low-income residents.Salvation Army San Diego will host its 35th annual Christmas meal, beginning at 11 a.m. at Golden Hall at 202 C St. The organization expects hundreds of volunteers to assist with the event. Volunteers will escort attendees to their seats and serve them a traditional holiday meal.Serving Seniors will also host its annual Christmas meal for low- income and homeless San Diego County seniors, many of whom would otherwise spend the holiday alone. About 350 seniors will enjoy a meal of Cornish hen with Mornay sauce, cornbread dressing, whipped potatoes, green peas and carrot cake, according to the organization. The meal begins at 11 a.m. at 1525 Fourth Ave.Rev. Shane Harris, former president of the National Action Network, will host his second annual community Christmas breakfast at the National Black Contractors Association. Attendees will receive a free hot breakfast, free clothes and children will receive free gifts.The event begins at 7 a.m. at 6125 Imperial Ave. According to Harris, the breakfast is open to the public, but foster families, low-income residents, homeless residents and military veterans are all encouraged to attend. SAN DIEGO (CNS) - District Attorney Summer Stephan warned San Diegans, especially senior citizens, to beware of a scam in which callers are pretending to be from the Social Security Administration in an attempt to obtain Social Security numbers for financial crimes.There are multiple versions of the rip-off, Stephan said.In some cases, the caller may say a person's Social Security number has been linked to a crime and has been blocked, but that for a fee it can be reinstated. The caller then asks the victim to verify the Social Security number.Another variation involves the caller saying that a person's Social Security number has been used to apply for multiple credit cards, which could cause the person to lose Social Security benefits. Or the caller may say that acause the person to lose Social Security benefits. Or the caller may say that a person's bank account is on the verge of being seized and the victim should withdraw all cash from the account."All of these are scams," Stephan warned. "Do not provide your Social Security number or banking information to any caller, even if the caller ID shows Social Security's 1-800 number. Instead, hang up and call Social Security to verify. SAN DIEGO (CNS) - Assisted by San Diego officers, Los Angeles police Friday morning arrested social media personality Raymundo Diaz on suspicion of sexual assault.Diaz, 33, who is known online as Ray Diaz, was arrested by detectives with the Los Angeles Police Department's Robbery-Homicide Division's Special Assault Section about 5 a.m. in San Diego, according to the LAPD."Proud of our elite RHD who pursued this relentlessly," Chief Michel Moore tweeted Friday evening. "Their work brings a small measure of justice."Moore also thanked the public for their concern regarding the case."We are better when we share the responsibility of making sure every member of our community is safe," Moore tweeted.San Diego police assisted in the arrest of the Hollywood resident, the LAPD reported.Details about the alleged assault were not released, but according to media reports, an investigation was launched after videos surfaced that appeared to show him assaulting an underage teen girl he was reported to have been dating.The 16-year-old alleged victim said in an interview with "DramaAlert" YouTube channel host Daniel "Keemstar" Keem she had been dating the 33-year-old Diaz for the past 18 months while she was underage and was emotionally and physically abused.On July 5, the alleged victim's mother posted a video clip to her daughter's Instagram page that showed Diaz screaming at the teenager, Newsweek reported.Keem posted a longer version of the clip that showed Diaz yelling at the girl and saying she should "kill herself" and "die."The teen and her mother said they have both filed restraining orders with the Los Angeles Police Department, Newsweek said.Diaz, who has claimed the video depicted an acting exercise and not an actual assault, was being held in lieu of 0,000 bail, according to the LAPD.In June of 2018, Diaz was arrested on domestic violence charges for scratching and bruising his girlfriend at the time.
