A man and his girlfriend sued the state of Hawaii, saying the false missile alert debacle earlier this year caused him to have a heart attack.James Sean Shields and girlfriend Brenda Reichel filed the suit Tuesday. In addition to the state, Vern Miyagi, former head of Hawaii Emergency Management Agency, is also named as a defendant. In the suit, Shields and Reichel say they were driving to the beach on January 13 when they received alerts on their cell phones that a missile was headed toward Hawaii and that they needed to find shelter."Both plaintiffs believed this message to be true and were extremely frightened and thought they were shortly going to die," the lawsuit reads. "They decided that there was not much they could do to protect themselves from this threat and decided that if they were going to die, they might as well die together on the beach."Reichel then got a call from her son, who serves in the Hawaii Army National Guard. He told her the threat was real, heightening their fears even more.Minutes later, they arrived at the beach and began calling loved ones, saying their goodbyes. Right after Shields called his son and daughter who live on the US mainland, he said he started to feel "a severe and painful burning" in his chest. He went to a hospital where he went into cardiac arrest. A doctor performed CPR, and Shields then underwent emergency surgery. The damage to Shields' heart since the heart attack has been confirmed by several tests, the suit says. 1495

A judge ruled Monday to consolidate the cases against University Hospitals in Ohio in the fertility clinic catastrophe that left 4,000 eggs and embryos destroyed. The ruling stated the decision was made because the lawsuits all have common issues and the parties are essentially the same; all the actions involved have a common question of law or fact regarding the March 3 incident at the UH fertility clinic. 422

A day after Republicans attempted to portray the Democratic Party's platform as "far-left socialism," the Trump campaign will attempt to continue that messaging during the second night of speeches at the Republican National Convention. On Monday, speakers attempted to paint Democratic presidential nominee Joe Biden as part of the party's left-wing, despite his moderate record. Speakers warned of progressive Democrats' calls to defund police departments and institute gun control measures.Tuesday's program will attempt to further those talking points. According to the Trump Campaign website, the second day of the RNC will focus on "how Democrats' radical left agenda will deny Americans the opportunity to achieve their full potential."The theme of Tuesday's program is "Land of Opportunity," which includes a focus on the Trump policies that Republicans say "empower" all Americans.Tuesday's slate of speakers is highlighted by Sec. of State Mike Pompeo, one of Trump's fiercest allies. Pompeo's speech will likely focus on Trump's defeat of the Islamic State group, his attempts to normalize relations with North Korea and his attempts to push back against national security threats from China.Pompeo drew criticisms last week for tweeting a Simpsons GIF to mock House Speaker Nancy Pelosi. Also expected to speak is Kentucky Attorney General Daniel Cameron — the man currently in charge of investigating the death of Breonna Taylor a the hands of police in March. Two of Trump's children are also slated to deliver addresses — Eric, his second-oldest son, and Tiffany, his youngest daughter.Below is Tuesday's list of speakers in the order in which they are expected to appear.Pastor Norma Urrabazo, International Church of Las VegasMyron Lizer, Vice President of the Navajo NationRichard Beasley, former FBI special agent an President of Global Intelligence NetworkJon Ponder, founder and CEO of HOPE for Prisoners, Inc.Sen. A John Wayne exhibit in the main hall of USC’s School of Cinematic Arts will be removed. The decision comes after renewed visibility of some of the actor’s comments, and recent conversations about removing statues and memorials of those who promoted hateful views."Conversations about systemic racism in our cultural institutions along with the recent global, civil uprising by the Black Lives Matter Movement require that we consider the role our School can play as a change maker in promoting antiracist cultural values and experiences," Assistant Dean of Diversity and Inclusion Evan Hughes said in a statement. While the statement from the University of Southern California did not directly mention it, Wayne’s legacy has been re-examined recently after a 1971 interview with Playboy went viral last year. In the interview, Wayne shared derogatory views of African Americans, Native Americans and films with gay characters."I believe in white supremacy until the blacks are educated to a point of responsibility," the actor said during the 1971 interview. "I don't believe in giving authority and positions of leadership and judgment to irresponsible people."When the interview was widely shared last year, many USC students and others called for the school to remove the Wayne exhibit, according to USC student news outlet Annenberg Media. 1351

A heartbreaking social media post by the brother of James Eric Davis Jr., the man who police say shot his parents to death inside of his Central Michigan University dorm room Friday is asking for compassion and support for his younger brother.“To the media and opinionated people... Please don’t make a villain of my brother... that is NOT who he is... and despite the circumstances, he also lost a mother and father... And I LOVE him. Consider that!,” wrote Russell Matthew Davis on his Facebook page.“Never thought I’d have to post this type of post... but unfortunately the news is true. My mom and dad both rest from their life of labor and stress in a very tragic event,” he wrote.Davis Jr. has been charged with two counts of murder and a weapons charge in the shootings of his father, Eric Davis Sr., and mother, Diva Davis.Davis Jr.’s parents had come to the university Friday to pick up their son from the hospital and take him back to their hometown in Illinois for Spring Break.  Their son had acted so strangely the night before, that University police suspected he was on drugs and admitted him to a hospital in Mt. Pleasant. The shooting occurred on the 4th floor of Davis. Jr.’s dorm room in Campbell Hall as his parents were packing up his belongings. A 16-hour manhunt and university lockdown ensued before Davis Jr.’s capture.Russell Mathew Davis said on his post that he’s pursuing a doctorate in faith and “THIS is my examination!!”RELATED STORIES: 1480
