SAN DIEGO (KGTV) -- San Diego City Attorney Mara W. Elliott has heard complaints from neighbors and has filed a civil enforcement action to shut down a short-term vacation rental property in La Jolla that has been dubbed a "COVID party mansion."The complaint alleges that defendants are maintaining a public nuisance and engaging in unfair competition, including false advertising at the La Jolla Farms rental property located at 9660 Black Gold Rd. According to city officials, the rental property continues to operate in violation of state and county COVID-19 public health orders.According to a press release, Elliott is seeking civil penalties and a permanent injunction against property owners Mousa Hussain Mushkor and Zahra Ali Kasim, property manager Nital Meshkoor, and Steven S. Barbarich, who leased the property from Mushkor and subleased it as a short-term rental.City officials said the oceanfront mansion has been the subject of at least 30 calls to the San Diego Police Department. Officers have spent more than 173 hours at the property to investigate nuisance activity. Most of the incidents involved raucous parties, some of which had up to 300 attendees.Elliott said about a dozen of the party complaints came during the COVID-19 pandemic, while public health orders prohibited large gatherings.According to the press release, concerns about the property were brought to the City Attorney’s Office by San Diego police and by neighbors who reported that the situation was "becoming more pronounced as the COVID-19 pandemic progressed." “Shutting down dangerous party houses protects the public health by preventing COVID super-spreader events and other illegal behavior,” Elliott said. “It’s unfortunate that San Diego does not have short term rental regulations in place. Relief for this neighborhood would have come much sooner. Instead we must rely on time-intensive prosecutions at significant taxpayer expense.”According to the press release, gunfire was reported to police during a party in May of 2019. Officers arrived and found a large party in progress. Partygoers questioned by police admitted gunshots were fired during a fight that had occurred earlier. Police found shell casings outside the property and a neighbor found an additional casing the next day and turned it over to police. The City Attorney's Office assembled evidence from investigations by SDPD, the Code Enforcement Division of the City’s Development Services Department, the County Health & Human Services Department, and the City Fire Marshal. SAN DIEGO (KGTV) - San Diego Mayor Kevin Faulconer announced Wednesday that a record number of potholes have been filled in the city in 2019.An average year sees 32,000 potholes filled, but Wednesday crews filled pothole number 49,000. This year the city tripled the number of pothole repair teams and extended their hours to include nights and weekends. Matt Sinclaire lives on Georgia Street in University Heights, however, and showed 10News a doorknob flier that was left at homes on his block last week announcing that street would be repaved this week. Curiously, the no parking signs were pulled Friday, he says, and the job, he was told, was canceled. Wednesday, that announcement from the mayor was held, and two potholes were repaired directly in front of Sinclaire's home. "This whole thing pissed me off," says Sinclaire. "We waited this long and finally we were going to see our street paved... but we have a nice shiny little black square that's going to probably be good for the next year." Deputy City of San Diego Chief Operating Officer Johnnie Perkins told 10News the project was postponed, not canceled, due to the subcontractor's staffing issues. There was a miscommunication and the contractor gave neighbors bad information about a cancellation, Perkins said. SAN DIEGO (KGTV) -- San Diego County leaders Monday announced proposals that would crack down on vaping amid vaping-related illness and death throughout the U.S. At the Monday news conference, County Supervisors Dianne Jacob and Nathan Fletcher proposed a ban on the sale and distribution of flavored tobacco products and e-cigarettes. The recommendations will come to go to the board on October 15 and, if the board follows up with approval, the rules would take effect in the county’s unincorporated area. “Vaping-related illnesses are a grave concern and we must take local action to address this fast-growing public health crisis,” said Jacob, chairwoman of the Board of Supervisors.“Teenagers and young adults have been the hardest hit, and we must stand up to vaping manufacturers that are preying on them for profit.”So far across the U.S., there have been more than 800 confirmed illnesses tied to vaping and 13 deaths. The news conference comes after health officials around the country advise people to refrain from vaping as investigations into the cause of the illnesses and deaths continue. “E-cigarettes, and in particular the flavored products, are erasing years of progress in reducing teens’ use of tobacco and nicotine,” said Supervisor Fletcher.In San Diego County, there have been 22 confirmed probable vaping-related illness cases. Teenagers and young adults make up about half of those hospitalized as a result of e-cigarette use, according to the state Department of Public Health. 1513
