SAN DIEGO (KGTV) -- A judge ruled Wednesday that a Navy commander will face a third trial on charges he tried to rape a junior officer in her home.John Michael Neuhart II asked the judge to dismiss all charges after a second jury was unable to reach a verdict.The judge dismissed charges of assault with intent to commit rape during burglary, burglary and resisting or delaying a peace officer.RELATED: Mistrial declared for former Navy commander accused of rapeThe judge added that prosecutors can proceed with a third trial in January on charges of attempted forcible rape and assault with intent to commit rape.Neuhart now faces six years behind bars and lifetime sex offender registration if found guilty. Neuhart had previously been facing life in prison.In the two trials combined, 21 out of 24 jurors voted to convict Neuhart. SAN DIEGO (KGTV) -- A non-profit in Logan Heights is asking for the neighborhood's help clean up a community space used by families and children. The Logan Heights Community Development Corporation owns the Gilliam Family Community Space. In March, they were forced to shut it down indefinitely because vandals were using the space overnight.  The area is covered in graffiti and littered with trash. The vandals were using the tree house overnight and damaging the fruits and vegetables in the community garden.  Now, the non-profit wants volunteers to help revamp the area. They plan on knocking the tree house down and eliminating the garden to deter the people coming in overnight. A large community cleanup is scheduled for Saturday, June 2 at 2835 Imperial Avenue at 9 a.m. The non-profit relies solely on donations. SAN DIEGO (KGTV) - A reported threat to San Diego State University campus was deemed not credible, according to campus police.University police were told of a person making "incoherent threats" on campus Thursday morning. Responding officers made contact with the individual, detained the person, and determined the threat was not credible, police said.The person never posed a threat to the campus or community, police clarified.RELATED: City of Poway debuts hotline to handle school threat reportsOfficers said the individual was removed from campus and they are not affiliated with SDSU.There have been at least 20 school threat investigations in San Diego County since the Parkland shootings on February 14.  740

SAN DIEGO (KGTV) -- A Hillcrest man is still recovering in the hospital after he says he was attacked, leaving him with a head injury and partial paralysis.Ricky Jackle says he was walking with a friend on Robinson Avenue in Hillcrest October 14.“I was out with a friend of mine. Had a few drinks at The Rail.” According to Jackle, that’s when the assault took place.“Last thing I remember, there was a confrontation between the person I was with and somebody else. I tried to get in the middle of it to stop in. I was pushed on my chest, went backwards and hit my head on the curb. Apparently that’s when I bled out. I heard voices, by friend’s voice behind me,” said Jackle.Jackle says after the incident, his friend fled the scene.In tears, Jackle describes how the assault has changed his life. “I can’t work, I can’t do the things I used to do. I’m scared.”“I don’t think anyone should be attacked or a victim like I was, I don’t think it’s right.”While under observation at the hospital, Jackle began to feel numbness in his hands and arms which resulted in loss of movement in his hands, arms and legs, according to a GoFundMe post.“The injury caused swelling which compressed his spinal cord resulting in loss of movment [sic] and some paralysis,” according to the post.Jackle’s cousin, Derrick Roach spoke about the friend who left Jackle following the attack. “He said the reason I left Ricky is with all the blood I thought he was dead.
