San Diego (KGTV) - Thousands of kids across California approved for in-home nursing care are struggling to get the help they desperately need.On Thursday two children filed a class-action lawsuit against the California Department of Health Care Services and its director claiming the state has failed to fulfill its commitment to provide them with sufficient Medi-Cal in-home nursing services.It says, “this class action lawsuit asks the Court to order Defendants to take all steps necessary to arrange for previously-approved, medically necessary in-home shift nursing services for Plaintiffs and Class members.”According to the lawsuit plaintiff, Ivory N. is a seven-year-old and a Medi-Cal beneficiary. It says the child needs 63 hours per week of skilled nursing at home but only receives about 56 hours per week.The non-profit group, Disability Rights California, says more than 4,000 Medi-Cal eligible children have been approved by the state to receive Medi-Cal in-home nursing care, but the state lacks an effective system for arranging for needed nursing."It’s too bad that a lawsuit had to be filed, but they are right to file it because right now that need is not being met,” said California State Assemblyman Brian Maienschein.In 2017 Maienschein tried to get the problem fixed through legislation. He believes the state is not following through on its promises to the kids.“It was a significant victory last year that we were able to get money in the budget, but they are still not following through on the promises they made,” he said.According to a news release from Disability Rights California, “29 percent of authorized Medi-Cal nursing hours go unstaffed.” 1693

SAN DIEGO (KGTV) - Tucked within City Heights are natural wonders along a winding system of trails and walkways.But many of those scenes of nature go unnoticed. Not by intention, though.Justin Boone, owner of Burly and the Bean, noticed visitors coming into his coffee shop looking for a way to connect to the nearby canyons and beyond.RELATED: Mariachi dances above Interstate 5 in San DiegoThe trend got Boone thinking. SAN DIEGO (KGTV) -- Two San Diego-based Marines are under investigation after posting a video that appears to show them in "blackface."According to KPBS, Zach Highfield originally posted the video on Snapchat. Highfield's Instagram page shows him in his Marine uniform. The video shows Highfield and another man in uniform with their faces blackened. One of them is heard saying "blackface." The other man puts on his cap and salutes. At one point, one of them uses a racist slang used to describe African Americans. The video shared on social media, with many people on Twitter, saying the Marines should be kicked out of the military. Bishop Cornelius Bowser is the pastor of Charity Apostolic Church. He agrees. "It seems as though, whether it's military or someone in the community or working for a company, they should have learned by now that this is unacceptable," said Bishop Bowser. Highfield told a KPBS reporter, they were wearing charcoal masks used to clean pores. He said they didn't mean to offend anyone. 10News tried calling Highfield at the number posted on his Instagram page, but his voicemail was full and he did not respond to texts. Bishop Bowser believes the two knew exactly what they were doing. "We pay our tax dollars for them to protect and serve our country and this is not it, right there, that kind of display, that kind of character should not be allowed." A spokesman with The Third Marine Aircraft Wing, based at Miramar Air Station, wouldn't release any details, but said the matter is under investigation. SAN DIEGO (KGTV) - While bars are set to open Friday, it's not going to look much different from restaurants right now, according to those in the industry.10News spoke with Nathan Colonero, the Director of Operations at Sandbox Pizza and The Tipsy Crow, and he said the only change will be businesses without a food license will be able to reopen and bars that serve food don't have to enforce a food order on each tab.Customers will be required to wear masks when they walk in and may only remove their mask once seated.Tables must be spaced at least six feet apart or partitioned.Colonero is hopeful the easing restrictions will continue, "who knows? Maybe three more weeks and no spike and we get a little more back to, the biggest thing for us is to get back to, if people are allowed to be in the venue, maybe at a lower capacity, just not seated."Many San Diego bars with food licenses have been open for the past three weeks and some are feeling the squeeze of the new restrictions."The 0 unemployment is killing businesses right now to get staff back," Colonero said. SAN DIEGO (KGTV) - A local Marine's dreams are close to becoming a reality in the form of a massive property in Dulzura. It is not just for Kalani Creutzberg. His efforts to help others prompted an Animal Planet star to join the cause. Nate Schoemer was also a Marine. He was fresh out of high school with his blood type on his boots when he joined the invasion of Iraq.  "The first group was out there for three days and when they came back you could tell that they've just been through hell," Schoemer said. "This is hard for me to talk about," he said with tears in his eyes. It is especially hard to him to discuss it with civilians who often cannot comprehend the horrors of war. He lost some friends on that deployment in 2003."I could hear it from where I was," he started. "I mean I could hear them screaming," It haunted his heart on home soil., but he said his dog's love lifted his spirits. "I need to continue on this mission and helping others the way she helped me," he added.When he got out of the service he became a master dog trainer. He went on to host an Animal Planet show called "Rescue Dog to Super Dog". In it, he saved shelter dogs and turned them into service dogs for people in need. In episode one, he trained Bas for Creutzberg, which is how the two met. Creutzberg survived chilling deployments, but the fight for his life followed him home. "Before I knew it I was homeless," Creutzberg explained. "It was embarrassing, it was shameful," Bas gave him a sense of purpose. "When I was going there to rescue him he was actually the one rescuing me," Creutzberg added. Now, he is on a mission to give homeless vets a home. He plans to buy a property that is nearly 300 acres in Dulzura. "We're going to run our day to day operations very much like when we were back in the service," he explained. "There will be structure, we will work together…… the very things that a lot of us miss."It does not end there.  They will also rescue homeless dogs  about to be euthanized."[We'll] allow both the veterans and the dogs to grow relationships and start anew," he said. Schoemer believed in the Cammies and Canines Sanctuary so much, he joined the efforts. He plans to turn some of the dogs on death row into service dogs for vets. "Just being around Marines and veterans is a great thing,"  Schoemer said with a big grin. Their goal is to get back to tackling battles together. If that is not enough, man's best friend might just save someone else from being their own worst enemy. Creutzberg said they have raise about 0,000 of the 0,000 they need to purchase the property, so they are looking for investors.
