FALLBROOK, Calif. (KGTV) - A grateful family is speaking out after a Camp Pendleton Marine helped save their trapped baby as flames engulfed their car.Two Mondays ago, Tony Hurley, his wife and 1-year-old daughter were in their car on East Mission Road, on their way to a relative's home, around 5 p.m. Hurley says a gas can fell off a truck in front of him. Fire officials say it became wedged under the engine, leading to sparks as it dragged on the road."Almost like a firework going off ... As we pulled over, the car is already on fire. Flames were surrounding the perimeter of car," said Hurley.A frantic Hurley, along with his wife, got out and went to the back seat to get their daughter, but he says the latching mechanism for the car seat base was stuck."That's when I look up, and I'm face to face with a Marine on the other side of the car," said Hurley.That Marine was Gunnery Sergeant Kyle Wetter, who just happened to be driving by."At that point is when I used my pocketknife to cut the car seat belt that was holding the baby's seat int the car, so the dad could get the car seat out," said Wetter in a video interview released by the Marine Corps.As the family scrambled to safety, Wetter grabbed their belongings out of the car before also getting to safety. About a minute later, three different explosions rocked the car. After a few more minutes, flames had consumed the car."I don’t even want to imagine what could have happened if he hadn’t been on scene," said Hurley.Hurley says the Marine's efforts ended with the best Christmas gift ever: his family was alive and well."He's definitely a hero in my book, and I'm more than grateful," said Hurley."It's what I expect any person to do in that moment, is to help someone in need. I don't think I'm special by no means. I was just the person behind them that decided to help," said Wetter.Wetter credits his Marine Corps training, which has taught him how to react to fast-developing situations.A Gofundme campaign has been set up to help the Hurley family with the purchase of a new car. 2070

(KGTV) - Students in the San Dieguito Union High School District won't be returning to campus in January.Monday morning, the school board voted to confirm that it will not continue with its reopening plan that would have brought students back on campus one day a week beginning on January 4th, with the option of returning five days a week on the 27th.The move comes after the union representing the teachers filed a lawsuit last week to block the return.Jason Barry's daughter is in 7th at Earl Warren Middle School. She was looking forward to returning to class."Here we are again, kicking the can down the road. I hope this isn't a pattern that is going to continue," said Barry.Barry broke the news to his daughter Monday after the board vote. "She's gone from, as this whole thing has gone on, she's gone from tears to frustration to just quiet," said Barry.Newly elected Trustee Michael Allman was the only board member to vote against ratifying the settlement reached last week with the union."We offer all this accommodation so that these essential workers, who are guaranteed the highest paid in the county can teach our kids, and they say thank you by filing a lawsuit , and then they offer to settle as they hold the kids as bargaining chips and I just don't want to reward that behavior," said Allman during the meeting which was held via Zoom.The California Teachers Association filed a legal petition on behalf of the San Dieguito Faculty Association. The union said the district's reopening plan violated the state's public health rules concerning the pandemic.Under the state's health mandate, schools that were already open for in-person instruction were allowed to remain open. The legal petition challenged the district's definition of "open," alleging that none of the schools was open for regular instruction; instead, they were open for small cohorts.The union also estimated up to 20% of teachers would not return in January either for health concerns or childcare issues.Barry and other parents are starting a grassroots effort to make it easier for people to become substitutes. Many parents say they are willing to step in to help fill the void. The district has said there is a shortage of subs."Whatever I need to do, to get this across the line if I need to be a substitute teacher, be one body that can help, I'm going to do that," said Barry.Barry said he worries about the impact of remote learning on his daughter's development."This whole situation is causing a stunting to, I would say, an entire generation of kids who should be engaging, learning, growing, expanding their boundaries, and now they are stuck at home not testing themselves with their peers. ESCONDIDO, Calif. (KGTV) - A young San Diego security officer says she faced retaliation after reporting sexual harassment to her employer, Escondido’s Palomar Medical Center.She spoke exclusively with 10News about her experience. The hospital will not discuss the details with 10News, but reports it takes matters like this seriously.The woman and her attorneys are now suing the hospital and the supervisor who she accused of sexual misconduct.10News was asked to withhold the identity of the woman who filed the sexual harassment claim.In a recent emotional interview, she said, “I'm helping my dad with my sister so if I lose my job [I] don't see how I’ll be able to financially support my family.”Attorney Anna Yum with Gilleon Law Firm is representing the woman. Yum told us, “Every worst nightmare that she could have anticipated [has] happened.”Yum said the woman was working as a security officer at Palomar Medical Center when her supervisor kissed her, but it was not welcomed.Yum added that the supervisor is a former police officer who is nearly twice her age. Yum’s client told us, “He said, ‘Just please don't say anything. I’ll be sure that you get that lead position that you applied for.’”The woman explained that she agreed and told him, “I won't say anything,” and, “Just, please. I want to leave.”She said she did not report it at the time because she was concerned about retaliation. She was promoted, but said he continued to make her uncomfortable with his comments and would hug her on several occasions.Due to her anxiety and stress, the lawsuit reports she took a medical leave of absence. Late last year she claimed he tried to kiss her again.“He told me, ‘If you do go to HR, I'll make sure you lose your job.’ Now that I’m experiencing all this with HR, it's like surreal,” she added.She reported the harassment in a letter to HR on February 15th, 2018, she told us. Yet she said it wasn’t until almost two weeks later that HR opened an investigation into the matter.By that time, she hired Yum as her lawyer and wanted Yum present at her meetings with HR. However, Yum claims that HR refused to let her have an attorney present for the meetings.HR reportedly wrote to her on March 27th, 2018, reiterating that the hospital “would have to conduct the investigation without [her] input, which is obviously not preferred.”According to Yum, “They said, ‘Well, we couldn't corroborate because [the client] refused to cooperate with us,’ which is the furthest thing from the truth.” The letter goes on to explain that since she refused to do an interview without her attorneys, HR, “…concluded the investigation without [her] input."Yum says her client was then notified that she was getting demoted under the false pretense that it was her client's idea to step down, not the hospital's idea.Yum says that continued retaliation unfolded. Her client tells 10News that on March 30th, 2018, she received a letter from HR placing her on immediate investigatory leave so the hospital could “review an alleged security incident” from three days earlier while she was “on duty as the lead security officer”.Yum has called it a sham investigation. She says her client knows nothing about a security incident that happened on her watch.“This is so classic. This is exactly why women don't want to come forward,” Yum told us. Yum and her client are now suing the hospital for sexual harassment and retaliation, among other complaints.They're also suing the accused harasser, who we are not naming, as he has not been charged with a crime. Both he and the hospital declined our interview requests.A statement from Palomar Medical Center reads, “Although Palomar Health cannot comment on pending legal matters, please be assured that we take all complaints of discrimination in the workplace seriously, including the complaint at issue. We are also not at liberty to discuss any of the details of our investigations into workplace misconduct due to the privacy rights of the employees involved.”“They don't want to have anything to do with me, I feel. I feel like they've already chosen their side and their truth,” Yum’s client told us. (KGTV) - A retired Escondido homeowner is figuring out how she'll pay for Thanksgiving dinner after everything she bought for the holiday was spoiled during a power outage.On a fixed income, Carol Marbrey purchased the meal at the beginning of the month.“I was never warned that my electric would be turned off, and then I was told it would be on by 7:30 AM, then I was told it would be on by noon, and this is all online, and then I was told it would five at night.”Marbrey came home that night to a dark house; power wasn't restored until the next day.The outage happened earlier this week during the extreme wind conditions and Red Flag Warning countywide.San Diego Gas & Electric says some customers weren't warned because it was a fluid situation, with weather conditions changing by the hour. A spokesperson tells 10News after power is shut off, technicians must inspect hundreds of miles of lines before turning them back on.Marbrey says she called the company several times to understand the situation.“I was getting different answers as to why our electric was not going on," said Marbrey.An SDG&E spokesperson tells 10News they encountered an issue trying to re-energize Marbrey's circuit, by then it was getting dark, and they had to wait until the following day.Marbrey says she understands the necessity to keep the community safe but wishes she’d been better informed.She knows her situation could be a lot worse.“Our hearts really go out to those people that really suffered; we really respect the fire department, the electrical people that are on the ground, the maintenance people, everyone that's doing their best to keep us safe.”Marbrey estimates they lost 0 to 0 in spoiled food. Every morning, Philip Staroska starts his day by logging onto his computer and wishing his class of kindergarten students in Phoenix, Arizona a good morning. The spiking COVID-19 cases have kept this life-long educator out of the classroom for longer than he could’ve ever imagined.There are days when all Staroska wants to do is give his students a hug or a high five, but instead, a virtual pat on the back over Zoom has to suffice.“I would give anything to give my kids a high five, a hug, to be able to be like, ‘hey, come on, focus.’ It’s a lot more powerful in-person than over the screen,” Staroska said.And yet, for as much as he longs to be in the classroom, Staroska knows with COVID-19 cases reaching record-high levels in his county, keeping kids and their families safe is taking precedent right now.“I would love for it to be a normal school year, but it’s not,” he added.It’s been long, challenging year for teachers like Staroska across the country. Regardless of whether learning is occurring in-person or virtually, many educators are worried the pressures of the pandemic are dramatically impacting student’s academic progress.“It’s just not the same as being in the classroom,” Staroska said.His sentiments are shared by other teachers and administrators, trying their best to navigate the challenges of learning during a pandemic.In Nashville, Tennessee, Dr. Kenyae Reese, a high school principal, is worried about the emotional impact this year is having on her high school students. In many cases, students are now taking part-time jobs to help parents who may have lost their jobs due to the pandemic.“We’re seeing high school kids who have to watch little siblings because their parents are out of work. It’s then juggling being a student, but I also have to monitor a younger sister or brother. There’s a lot more responsibility,” the principal said.“Sometimes kids are working during the day because they may be one of the breadwinners, especially right now,” she added.Another concern: attendance, especially among students who are starting to experience burnout.“Even kids who are super strong with social media and technology are struggling.
