It's a frightening case of road rage that happened in broad daylight and spanned several communities.Now Police in Allen Park, Michigan are asking for the public's help in finding the man who was driving a black Nissan Altima with a damaged fender and out of state plates on the front and back of the vehicle. Detective Jim Thorburn with the Allen Park Police Department said the man chased another driver several miles and then unleashed at least eight rounds of gunfire at another driver in broad daylight on the southbound Southfield Fwy ramp to I-94. It all started with a fender bender around 3:30 p.m. on Sunday in Detroit, in the area of Chicago near Greenfield. The driver of a pick up truck tried to exchange information, he told police, when the black Nissan Altima driver pulled out a gun. That when he ran. "He was being chased by a Nissan Ultima and he had a big pick up truck and he thought by cutting through fields and stuff he would lose the Ultima," Thorburn said.But that didn't happen. The victim hopped on the Southfield Freeway southbound driving to the I-94 ramp, where the suspect who was still chasing him, opened fire. The victim was hit in the backside but was able to keep driving, he finally lost the shooter, pulled over in Taylor and called police. Police photos show the side of the pick up truck riddled with bullet holes. A big bullet hole in the head rest was a sign that the suspect was likely shooting to kill. The victim escaped with a superficial bullet wound to the backside. Today he said he is in pain, but recovering.  Police are hoping to find someone who might have seen the male suspect fire eight to nine gun shots through the passenger window of his black Nissan Ultima in broad daylight on the busy freeway. In it, the former Subway pitchman – now serving more than 15 years on charges of child porn and sexual conduct with a minor – alleges federal Judge Tanya Walton-Pratt, who sentenced him to prison, two members of the 7th Circuit Court of Appeals, an Illinois U.S. district court judge and both of his lawyers undertook a “scheme to defraud” Fogle by tricking him into pleading guilty to a false charge.READ | Full?Fogle?plea agreementIn addition to his wrongful imprisonment, Fogle claims he suffered at least million in damages. The suit asks the government to grant him threefold damages as remuneration in the sum of million.The claim – which purports to outline a sprawling RICO case involving fraudulent search warrants, bogus charges and ill-gotten advice from attorneys to agree to pay .4 million in restitution to Fogle’s juvenile victims (at least million of which Fogle had already paid prior to his sentencing) – is the latest attempt by Fogle to get out of the plea he entered in November 2015.Previous such attempts – an apparent “sovereign citizen” defense rejected in November, the demonstrably false claim that Judge Pratt was “biased” because of her two teenage daughters at the time of the sentencing (she had none), and the argument that he pleaded guilty to an “unconstitutional” charge of conspiracy –  have so far been unsuccessful. In addition to this most recent filing, Fogle also has two open civil cases against Pratt and the U.S. government arguing he should be released.Fogle is joined in the RICO case claim by two other defendants: James Nathan Fry and Frank Edwin Pate.Pate, a former resident of Bonham, Texas, was sentenced to 210 months in federal prison in November 2015 for wire and mail fraud in connection to a foreign currency trading scheme and ordered to pay .8 million in restitution.Fry was sentenced in October 2013 to more than 17 years in prison and to pay million in restitution for his role in a .65 billion Ponzi scheme, according to the Star Tribune in Minneapolis.Pate and Fry are asking for million and 4 million in restitution, respectively, from judges, FBI agents, assistant U.S. attorneys and IRS employees connected to their cases.In all, the three men’s combined complaint targets 34 defendants and asks for 3 million in damages to be paid to Fogle, Pate and Fry.At least part of Fogle’s motivation behind the RICO suit may have been made clear Wednesday, when he filed a motion to dismiss in his civil suit against Pratt claiming that, because he has filed a RICO suit naming her as a defendant, the entire U.S. District Court for the Southern District of Indiana is now a “conflict of interest” forum.Fogle is currently serving his sentence at the federal correctional institute in Englewood, Colorado. Investigators have found evidence that a missing University of Iowa student was doing homework on her laptop the night she went missing, according to the woman's brother.Mollie Tibbets, 20, went missing on July 18 when she went jogging near Brooklyn, Iowa. TIbbets' brother, Jake, says investigators found that evidence that she was on her laptop that evening.The older brother of 20-year-old Mollie Tibbetts says investigators told him evidence shows she was doing homework on her computer last Wednesday evening. Tibbets was reportedly dog-sitting for her boyfriend, Jack Dalton, at the time of her disappearance. It is unclear if she returned after her jog, but the new details, family members say it is possible she did. Investigators previously executed a search warrant for Tibbits' Fitbit and social media accounts. A spokesperson for the Iowa Department of Criminal Investigations said Tibbets' case may be the first time Fitbit data has been used in an investigation in the state.  1043

  

IRVINE, Calif. (CNS) - More than 70,000 Orange County residents have been forced from their homes by a wind-whipped wildfire that severely injured two firefighters and was only 5% contained Tuesday.The Silverado Fire had blackened 11,200 acres by Tuesday morning, with 70,000 people under evacuation orders in Irvine and another 6,000 evacuated in Lake Forest, according to the Orange County Fire Authority. More than 750 firefighters have been deployed to battle the flames, and they'll be receiving assistance from 14 helicopters, an OCFA spokesperson said.Unlike most of the day on Monday, firefighters on the ground are being aided by water drops from helicopters, OCFA Capt. Thanh Nguyen said.SILVERADO FIRE MAP, EVACUATION CENTERS"I saw several of them this morning," Nugyen said."It's windy, but not as bad as yesterday," he added. "Because we're getting helicopters we're optimistic, but until we get the results it's all hands on deck."Firefighters are not concerned the Silverado fire would merge with the Blue Ridge blaze in Yorba Linda, Nguyen said."Unless we had some weird weather pattern I don't see them catching up to each other," Nguyen said."We've been fortunate to not lose any structures yet," OCFA Chief Brian Fennessy said Monday evening.Evacuation orders have been issued for the Jackson Ranch and Williams Canyon area, the OCFA said at 6:39 a.m. Tuesday. Silverado, Modjeska, and Trabuco Canyons along Live Oak Canyon are under evacuation warning, a spokesperson for the agency said.At 6:40 a.m. the OCFA announced an evacuation warning for Mission Viejo in the areas of El Toro Road to the north, Marguerite Parkway to the west, Upper Oso Reservoir to the east, and Los Alisos Boulevard to the south.The fire erupted at 6:47 a.m. Monday in the area of Santiago Canyon and Silverado Canyon roads.Late Monday, Southern California Edison told California officials that a lashing wire may have contacted its overhead primary conductor, sparking the fire. SCE sent a letter to the California Public Utilities Commission on Monday night acknowledging it had overhead electrical facilities in the area where the blaze broke out."We have no indication of any circuit activity prior to the report time of the fire, nor downed overhead primary conductors in the origin area," SCE said in the letter. "However, it appears that a lashing wire that was attached to an underbuilt telecommunication line may have contacted SCE's overhead primary conductor which may have resulted in the ignition of the fire."In Irvine, mandatory evacuation orders were issued for the area between Great Park and Bake Parkway, and north of Toledo until the city limits; from Irvine Boulevard south to Trabuco Road, and from Jeffrey Road East to Portola High School; areas north of Irvine Boulevard between Jamboree Road and Bake Parkway.Irvine Mayor Christina Shea said the city opened eight facilities to shelter evacuated residents and several quickly filled up.Irvine Police Department Chief Mike Hamel said city officials were working with the American Red Cross to provide overnight shelter for residents with no place to go. All areas, including roadways, north of Irvine Boulevard remain closed as part of the mandatory evacuation order, and Great Park Boulevard is closed east of Sand Canyon.All schools in the Irvine and Tustin Unified school districts will be closed Tuesday, including distance learning classes in Tustin Unified.High winds compromised the aerial firefighting effort, with all aircraft grounded by mid-morning Monday due to gusts, which rendered water drops ineffective while also making flying treacherous for pilots. Winds of 20 mph-40 mph were reported, with gusts up to 60 mph."This is a tough fire," Fennessy said. "We're experiencing very high winds, very low humidity... Any time winds are that bad you can't fly, and that certainly has an impact on both hand crews and bulldozers and firefighters at the end of those hose lines."Air attack is very important, but still it's the firefighters on the ground that put out that fire."Gusty winds were expected to continue Tuesday, but at weaker speeds than Monday, according to the National Weather Service.Two OCFA firefighters were hospitalized with severe burn injuries and remained in critical condition, OCFA Capt. Jason Fairchild said. Officials have been told the next 24 to 48 hours will be critical in their recovery, Fairchild said. They are 26 and 31 years old. Both sustained second- and third-degree burns about 12:15 p.m. Monday, one over 65% of the body and the other over half the body, Fennessy said. Both firefighters were intubated at OC Global Medical Center in Santa Ana, he said."I got an opportunity to talk to members of their families and spend time with both firefighters in the emergency room while they were being treated, but they were not in a position where they could speak with me," Fennessy said.The two firefighters were "at the heel of the fire where it started," he said."I know them personally," Fennessy said. "They're gravely injured. Their families are with them. I was with them when their families arrived. Obviously, it's very emotional. We're giving them all the support we can."Gov. Gavin Newsom announced a grant from the Federal Emergency Management Agency to help provide resources and a 75% reimbursement for firefighting costs.The southbound Riverside (91) Freeway to the Foothill Transportation Corridor (241) toll road was closed and the northbound 241 was closed at Portola.The Eastern Transportation Corridor (133) northbound was closed at Irvine and eastbound Chapman-Santiago Canyon was closed at Jamboree and Santiago Canyon from Silverado Canyon was closed, according to California Highway Patrol Officer Florentino Olivera.OCFA officials said the flames jumped the 241 Freeway shortly after 9 a.m. Monday.The fire sent a major plume of smoke over the entire region, creating unhealthy air across a wide area.The Orange County Health Care Agency urged residents in affected areas to stay indoors, limit outdoor activity, keep windows and doors closed and run air conditioners to filter the air.On Tuesday morning, fire officials said they expected lighter winds -- in the 10-15 mph range -- than on Monday. 6837
