SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

SAN DIEGO (KGTV) - A man accused of sexually assaulting women at knife-point across San Diego will face trial.On Tuesday, Judge Maureen F. Hallahan bound over eight felony counts against 19-year-old Seth Roberts.Three of his alleged victims gave testimony on Tuesday, describing their encounters with him.The first was an 18-year-old woman who said she had dated Roberts for about two months last year. They had been living in Oklahoma but both decided to hitchhike to California in October. RELATED: Former pro skateboarder convicted of rape and murder granted paroleThe woman, whose name was not released, said they stayed in Los Angeles for a week before coming down to San Diego where they were staying in a tent at a campground.She told the judge Roberts forcibly raped her one morning, holding her hands above her head.“I was telling him it was wrong, saying it was rape,” she said.After, she said Roberts left to go to work and she called a Lyft car which drove her all the way to Arizona where she called police and reported the alleged rape.The second victim said she met Roberts while walking near the beach in Pacific Beach in November of 2018.“He seemed like a very nice person,” she said through an interpreter.RELATED: Police searching for additional victims in sex assault caseThe woman said she is from Brazil but had been living in Washington, DC working as an au pair for a family.She traveled with them to San Diego for vacation and bumped into Roberts on her day off.She said he began making small talk and told her his roommate had a Brazilian girlfriend. He convinced her to walk with him towards his apartment to meet her.But she said before they made it there, he directed her to an area on the side of a home and pulled out a knife.She told the court that Roberts put his hand down her pants and inserted his finger into her anus while holding a knife to her throat.“I thought of my family. I thought of my dreams, how much I wanted to come here,” she said. “I could have never imagined this would happen to me.”A third woman also testified, saying Roberts raped her in her home at knife-point after she refused his advances.Roberts is being held on ,000,000 bail. SAN DIEGO (KGTV) - A man in his 70s was found dead at Sunset Cliffs Thursday afternoon after being reported missing, police confirm. According to the department, the body was discovered just after 1 p.m. near Froude Street and Sunset Cliffs Boulevard. Images from the scene showed crews working to remove the body at the bottom of a cliff. Police confirmed late Thursday evening that the body was that of a man in his mid-70s who was reported missing by his wife. The death has been ruled an accident. Police have not yet released the man's name. 555

SAN DIEGO (KGTV) -- A man was arrested after deputies say he intentionally drove onto a sidewalk outside an Encinitas bar, seriously injuring several people. According to the San Diego County Sheriff’s Department, the incident happened on the 500 block of South Coast Highway 101 around 1:20 a.m. Deputies say the man, later identified as Christian Davis, 28, was asked to leave The Saloon Bar because he was too intoxicated. RELATED: Man dies following attack in Vista; suspects at-largeAfter leaving the bar, deputies say Davis got into his rental U-Haul van and intentionally drove it onto the sidewalk, hitting three people. One of the victims was taken to Palomar Medical Center while two others were taken to Scripps La Jolla Hospital all with serious injuries. Davis was detained by witnesses at the bar before being taken into custody by deputies. Two of the witnesses were injured while detaining Davis and were taken to Scripps Encinitas hospital with minor injuries. The suspect is facing four felony charges including three of attempted first-degree murder and one of attempted escape with force. Davis is scheduled to be arraigned Tuesday.
