SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. "We fully corrected the issues underlying the allegations in this lawsuit years ago and are unaware of any unresolved consumer impact."DEBT COLLECTION LAWSUITSPart of the complaint talked about debt-collection lawsuits.In July Team 10 discovered a 157% increase in the number of rule 3.740 collections lawsuits filed in San Diego County court from 2015 to 2019. That involves any debt collection company."If you look not just in the county of San Diego, throughout the state of California, and in fact the dockets throughout the nation, we have a massive epidemic right now," said attorney Abbas Kazerounian during a July interview.Kazerounian said if someone's been sued or contacted by a debt collection company, they need to know their rights."The amount of debt is irrelevant," he said. SAN DIEGO (KGTV) - The City of San Diego has more than 2,300 jobs vacant but is struggling to fill them.The jobs run the gamut from 9-1-1 dispatchers to water utility workers to swimming pool managers to civil engineers. The list of vacant positions came to light after the city Audit Committee discussed struggles with worker retention and recruitment at its meeting this week. "We need to do something about that," Councilman Scott Sherman said. "Change the culture and get it to where employees are really looking forward to going to work and like being where they are."Michael Zucchet, who heads the Municipal Employees Association, says the city is losing workers to other agencies in this county and others because they offer better pay and retirement benefits, such as a pension. He says the problem has gotten worse since the unemployment rate has dropped to a near-historic low 3.5 percent. The city in 2012 switched most new employees to a 401(k) style retirement plan after voters passed Proposition B. That proposition is now in legal limbo after the California Supreme Court said the city skipped a key step in the approval process. "The City of San Diego is hemorrhaging employees to other jurisdictions," Zucchet said. "We have documented people who have been city employees for a long time, have no interest in leaving, but they can't pass up a 20-30 percent pay raise in Chula Vista, Carlsbad, National City and these other places."Zucchet gave examples of current job advertisements showing accountants in Chula Vista making 20 percent more than those in the city of San Diego, senior management analysts in Encinitas earning 38 percent more, associate planners in Poway making 21 percent more, and a police service officer in Coronado makes 27 percent more. A search on the city's hiring website shows 53 jobs, but Zucchet said those positions reflect multiple openings. As of March 1, the city had 2,373 vacant positions, up about 8 percent from a year earlier. The city auditor is now investigating how the city can improve worker retention and recruitment. A July study found the city had an overall 10 percent turnover rate, but that it was 15 percent with millennials, who may be gaining experience at the city before moving on to higher paying positions. 2289

  

SAN DIEGO (KGTV) — The explosions that shook a La Jolla neighborhood late last week revealed the surface of a much deeper, bitter fight. The detonations happened behind the home of the late Alex Jvirblis, who died in August at the age of 82. Neighbors describe him as a quiet but pleasant individual, and recalled few interactions. RELATED: Explosions ring out during hazmat scare at La Jolla homeOn Thursday and Friday of last week, the bomb squad exploded illegally stored chemicals from behind Jvirblis' house on Wrelton Road in Bird Rock. Jvirblis had no spouse or children. What he did have, however, was a business called Curtis Technology. It's tucked away in an industrial part of Sorrento Valley. Curtis Technology offers metal forming, cutting and finishing operations, which requires the use of chemicals. A woman named Daksha Dave is listed as its business contact online, and as treasurer with the Environmental Protection Agency. His will gives the state to the full authority to sell, lease, or hold all of his assets. That's where the fight starts. In October, Robert Hockenbrought and Amber Shuey, Jvirblis’ nephew and niece, filed a legal challenge to the Jvirblis Trust. "Except as provided in this will, I have intentionally omitted to provide for my heirs."RELATED: La Jolla party house scene of violent attack, mother saysIn court documents, they accuse Dave of cooking Curtis Technology’s books to increase bonuses, destroying or hiding Jvirblis’ true estate documents, and going into Jvirblis’ filing cabinet when he was hospitalized and stealing gold. A woman who identified herself as Dave declined comment Tuesday at the Curtis Technology headquarters. Her attorneys did not immediately respond to a request for comment. Hockenbrought is also the one who alerted authorities to the illegally stored chemicals, according to federal search warrants. Then, upon Jvirblis’s death, that employee informed Dave and the alternate executor — also at Curtis Technology — of the chemicals stored at the homes. The warrant says the employee was then told not to worry about it and that he was no longer allowed to go those locations. Hockenbrought said the family would have no comment, citing an ongoing FBI investigation into the chemicals. 2623
