SAN DIEGO (KGTV) — It’s an online service that brings groceries right to your doorstep, but some who work for Instacart told Team 10 they are being treated unfairly.Instacart entered the San Diego market in 2016. It basically works like Uber, where people can sign up to be “shoppers” and fill orders for a fee.Jacquelyn Westby signed up for Instacart to make extra cash.“We shop for groceries and then deliver using our own vehicles, our own gas,” Westby said. She recently graduated from grad school and is looking for a job in the field of occupational therapy. Instacart helped keep her afloat as she dealt with growing bills.“This job was the difference between homeless and not. Being able to eat and not,” Westby said.Westby said Instacart changed its pay structure over the past couple months. A company spokesperson said changes were meant to improve the shopper experience, adding things like “pay per mile” and estimated earnings. Westby, however, said the new pay formula has made things worse.“Before I could easily work a four hour shift in the morning or the afternoon and make 0 [to] 0 and be done with my day,” Westby said. “Now, I’m working 12 hours a day and sometimes I’ll make upwards of . Sometimes, it’s .”She said tip is now factored into total earnings from Instacart. Westby also said while heavy pay is added for heavier items, it is not consistent.“I think it’s about the bottom dollar. SAN DIEGO (KGTV) - In just a few weeks, voters will decide the fate of the San Diego Chargers' former home, now known as SDCCU Stadium.In a recent 10News/Union-Tribune poll, Measure G, known as SDSU West, is the clear front-runner.With the clock winding down, backers of both Soccer City and SDSU West are blanketing the airwaves in hopes of winning over voters.10News analyzed two advertisements currently airing on our station and put their messages to the test, separating fact from fiction.The first ad we looked at deals with Measure E, better known as Soccer City. The ad features soccer star Landon Donovan asking two people if they want to see the future. After showing one of them a video of the design planned for the location, one of the people asks Donovan how much it will cost for what he saw. Donovan says, "It won't cost you a dime."10News analyzed that statement and found it to be in a grey area.According to a San Diego City Attorney analysis, a private developer would normally pay the city for staff time spent processing its development. It’s unclear whether any city staff time will be reimbursed.Also, the City Attorney analysis noted the initiative does not establish the actual amount of rent the city would be paid for a 99-year lease of the property.The ad goes on to claim taxpayers get the same stadium that's currently there for the next ten years and it's going to cost six million dollars a year. Team 10 can’t verify timing but according to the City Attorney analysis, Measure G provides for the sale of approximately 132 acres.The measure doesn't talk about time frames and does not guarantee that the property would be sold or that any specific development would be built.Team 10 also read through the City of San Diego Office of the Independent Budget about stadium costs. The report says the stadium historically operated at a deficit.Officials with Soccer City disagreed with some points of our analysis saying the initiative pays fair market value. They also pointed to provisions in the ballot language saying it shows city costs will be covered.Team 10 also took a look at a Measure G ad starring former San Diego Mayor Jerry Sanders.The ad starts with Sanders saying “Voters have a big decision in November. The choice is clear, SDSU West, Measure G on the ballot is a once in a lifetime chance to grow the university to meet the needs of future students.”The ad says Measure G will create a western campus for SDSU with a research center, a beautiful public park along the restored San Diego river, affordable housing and a home for SDSU football and soccer.A 10News analysis found those statements to also be in a grey area.All of that could happen, but the city attorney's analysis says voter approval of this measure does not guarantee that the property would be sold or that any specific development would be built. It goes on to say if the property is sold to SDSU, the Board of Trustees of the California State University will determine the use of the property in its sole discretion - through a Campus Master Plan revision process. A Campus Master Plan revision does not require City approval.The review also notes the initiative does not address who would plan, build and maintain the river park.An official with Measure G sent 10News a statement saying: 3334

SAN DIEGO (KGTV) — ICE served four subpoenas to the San Diego Sheriff's Department (SDSO) Friday for information protected by sanctuary state policies regarding migrants arrested in San Diego.SDSO is required to protect the data under California's sanctuary state laws, which prohibits local law enforcement from cooperating with immigration detainers or requests for data concerning illegal immigrants."The public needs to be aware and concerned that California sanctuary state laws do not protect public safety and is bad public policy. Criminal aliens are being released back into the community daily and most will reoffend resulting in more victims, " said Gregory Archambeault, San Diego Field Office Director for ICE’s Enforcement and Removal Operations in San Diego.RELATED: US border agents to pursue migrants in 'sanctuary' citiesICE says it rarely uses subpoenas for information because most law enforcement agencies comply with requests for data on illegal immigrants that have been arrested.California passed its sanctuary state policy in 2017, preventing local agencies from complying with ICE's request. Friday's subpoenas are the agency's first issued in California."The Sheriff’s Department has received the subpoenas from ICE and is in the process of reviewing them. If able to, the Department will comply with the lawful requests in a timely manner," a statement from SDSO read.ICE is seeking information to the following cases:A 40-year-old Mexican national who was arrested in December by San Diego Police for continuing sexual abuse of a child, lewd and lascivious act of a child under fourteen years old, and oral copulation with a person under fourteen years old. ICE says the individual has two DUI convictions from 2009, has been returned to Mexico on eleven occasions between 2009 and 2011, and is currently in SDSO custody.A 42-year-old Mexican national who was arrested for first degree robbery by SDPD in November 2019. ICE says he has a prior conviction for possession of a controlled substance (methamphetamine) from 2013 and he was granted a voluntarily departure, but failed to leave the U.S. ICE says he has since been released back into the community.A 31-year-old Mexican national who was arrested by SDPD for battery of spouse and false imprisonment in December 2019. ICE says he has a prior conviction for a deceptive government identification from 2008 and that he's been removed from the U. S. three times between 2008 and 2010. ICE says he has since been released back into the community.A 28-year-old Mexican national who was arrested for assault with force, great bodily injury, child cruelty and battery of spouse by SDPD in January 2020. ICE says he was previously arrested in 2017 for battery on spouse by local law enforcement and was returned to Mexico multiple times in 2004 and in 2018. SAN DIEGO (KGTV) -- It's survival of the fittest once again for gyms and fitness centers across the county as San Diego braces for stricter pandemic-related restrictions that go into effect Saturday.One gym preparing for the big shift is major chain 24 Hour Fitness. While members can't choose from their dozens of locations to workout, seven county locations will be open and offering outdoor equipment to members."We're committed to staying outdoors, staying safe, and the well-being of our members is the priority," said 24 Hour Fitness district manager John Amato.Amato told ABC 10News that member visits will be reservation based with 90-minute windows, minimized to 57 guests at a time.While many prepared for what's to come, others like gym owner Tom Green of Green Speed Training in Eastlake did the opposite. Instead of expanding his outdoor space for members, he doubled the square footage on the inside, even though guests won't be allowed to workout indoors until the county falls in a less restrictive tier."It's certainly risky, but I've always been kind of a risk taker and I go with my gut instinct, and if I feel good about it, I go for it," Green said.Since the COVID-19 pandemic began, Green said support from the Eastlake community along with members of his gym have helped keep things afloat and allowed him to upgrade indoor space."It's very supportive, and we have a lot of great clients who really support what we're doing,” said Green.Regardless, both gyms said they'll continue to be there for their clients no matter which tier San Diego slips into next."To get that one-hour workout in, and de-stress to stay healthy, that's what our goal is,” said Amato. 1691
