SAN DIEGO (KGTV) - Local family members are reacting to the news that the bodies of two San Diegans who went missing in Mexico have reportedly been found in a well in Baja, California.According to the Associated Press, the Baja California state prosecutor’s office said in a statement that 78-year-old Ian Hirschsohn and 73-year-old Kathy Harvey were discovered in a well, south of Ensenada, Mexico.On Tuesday, the U.S. State Department sent ABC10 News the following statement: “The U.S. Department of State's top priority is the safety and security of U.S. citizens. We are aware of reports that local authorities have discovered the remains of two people near San Quintin and are closely monitoring their ongoing investigation.”On Tuesday, ABC10 News spoke to Hirschsohn's son-in-law over the phone. He said that family members are not yet ready to go on-camera but they want viewers to know what a senseless tragedy this is. They’re trying to accept the reality that Hirschsohn and Harvey may have been murdered but they’re yet entirely convinced that the bodies found are those of the retired couple. However, San Diego Police confirmed Tuesday that positive identification was made.“He went to Mexico a lot. I'd say he went down at least every couple of months,” Hirschsohn’s Solana Beach neighbor and friend Jim Dietz told ABC10 News on Tuesday. He described Hirschsohn has a highly-intelligent, active and well-traveled man. Those words were echoed by his son-in-law.“He was a real gentleman. He wouldn't say an unkind word about anybody,” said Dietz who added, “I feel very bad for [his kids] because they lost their mother a few years ago and now they lose their father in this kind of a tragic way. SAN DIEGO (KGTV) — If you've noticed the sharp increase in gas prices around San Diego lately, chances are we're not done.The average price for a gallon of gas Saturday was .77 in San Diego, according to AAA, jumping another four cents since Friday and reaching the highest San Diego has seen in about five months.At this time last month, San Diegans were paying on average 46 cents less per gallon. A year ago, 23 cents less. The closest San Diego's average has come in recent months to was .84 on average in Oct. 2018, according to Gas Buddy.GAS MAP: Search for the cheapest gallon in San Diego with our Gas Map"Four dollars a gallon on average is certainly within the realm of possibility given today's average is .73 and wholesale prices went up some 18 cents," Patrick HeHaan, with GasBuddy, told 10News. "That, in addition to the increases that are already coming down the pipeline, will likely thrust San Diego to that a gallon mark. That's something we have not seen in four, call it five years."AAA says a series of refinery issues have reduced gas supplies. According to Bloomberg, Valero Energy Corp's refinery in the Bay Area, Phillips 66 refinery in Los Angeles, and Chevron Corp.'s El Segundo plants have all seen shut downs and halts in oil production this month due to various problems.Nationally, gas has been averaging .73 a gallon. SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation.The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. SAN DIEGO (KGTV) — Jalen McDaniels, San Diego State University basketball's sophomore forward, was accused of filming consensual sex acts with a classmate in 2016 without her knowledge and sharing it with friends, according to a civil lawsuit filed Wednesday in Washington.The civil suit alleges McDaniels recorded the intimate moments with an 18-year-old female student while they were both seniors at Federal Way High School near Tacoma, Wash.The lawsuit goes on to say while McDaniels later told the plaintiff about the unauthorized recordings and that he had shared it with his friends, she learned from other students that the video became widely circulated. When she confronted McDaniels, he explained he had gotten away with a similar incident involving another female student, according to the lawsuit.The plaintiff's attorney, Joan Mell, who filed the suit, wrote her client has suffered from several self-destructive behaviors as a result, including attempting suicide.SDSU is accused of wrongdoing in the lawsuit as well.Mell alleges in the lawsuit that SDSU was contacted by Washington police to provide them with McDaniels' phone number, but failed to do so. The suit says SDSU, instead, alerted former basketball coach Steve Fisher, who secured McDaniels a lawyer, and McDaniels refused to cooperate.The suit goes on to allege McDaniels' refusal to cooperate and, "that others concealed his wrongdoing prevented prompt criminal investigation and referral to the prosecutor's office for timely filing of criminal charges under Washington’s criminal offense of distribution of intimate images."In a statement, SDSU said there would be "no change in [McDaniels'] status at the university" at this time, after an investigation by Washington authorities resulted in no charges before McDaniels' enrollment at the school: 1837
