SAN DIEGO (KGTV)- A local family contacted Team 10, concerned about the recent marriage of their elderly father to his new caregiver.  In a petition filed in probate court through an attorney, the family of James Donald Hess accused his new wife and former caregiver of "physically and verbally abusing him, and asserting undue influence over him." "It's just heartbreaking," said Dede Hess about her father-in-law. "I was just like, this isn't real." Dede Hess said her father-in-law, known to many as Don, is not in the best health. In the petition, it said his "health steadily declined" after Don's second wife passed away in February 2016 and that he suffered from "depression and loneliness" and became dependent on in-home caregivers. In the petition, it claimed that a caregiver named Nicky convinced Hess to marry her after just a few months. Hess and Nicky Shepard -- now Nicky Hess -- were married on October 14, 2017. Hess was 86-years-old. Nicky was 64.  "I think of her as a shark that smelled the blood in the water," Dede Hess said. RELATED: Resource guide for elderly San Diegans and families Dede Hess also learned more about the past of her father-in-law's new bride.  "When she met dad, she was married, but she was a newlywed," Dede Hess said. "Two weeks after her divorce was final, she married dad." Team 10 found Nicky was divorced at least five times.  The family alleged Nicky convinced her new elderly husband to "withdraw large sums of money from his investment accounts" and that she "forged [ his] name on documents," according to the petition. It also said she placed his health "in extreme danger" by keeping medication from him or giving him too much.  "I would love to see some justice on behalf of my father-in-law, especially if he's ill," Dede Hess said.  Team 10 learned that Don Hess is now hospitalized. His family said his heart stopped for several minutes and he also suffered from renal failure and pneumonia. The conflict brought both sides to probate court in mid-March where the judge acknowledged the difference of opinion regarding Mr. Hess's marriage.  "I know that you have very different views about whether this is on one hand, a recent marriage of an elderly person to his caregiver and the vulnerability that that can present and the possibility of financial abuse versus, on the other hand, a person who is engaging in his right in his older years to find love and get married," said Judge Julia Kelety. The petition is to remove Don Hess from the new trust made late last year. Hess's children claimed he was not competent at the time.  The petition said the new trust "largely disinherits his natural children... in favor of Nicky."  "The document was done in December so we have issues about its validity," said attorney Todd Stevens. However, the attorney present for Don's side said that is not the case.  "It appears to be a validly, executed trust by Mr. Hess," said attorney Lisa Frisella. Frisella said in court Mr. Hess went to a lawyer on his own and amended the trust.  Team 10 visited the Hess home to get Nicky Hess's side of the story.  She was home and did not want to talk in person. However, less than an hour later, Nicky called Team 10 and said over the phone: "All I need is love. I don't even think about his money. His kids did not approve our marriage."  Team 10 asked about allegations of elder and financial abuse. Nicky Hess said, "No, no way. I never elderly abuse my husband. I love him so much." In the petition response filed by Don's lawyer, it also denied any abuse and said the "children were more concerned about their inheritance than his happiness." In court, Judge Kelety temporarily "suspended" Mrs. Nicky Hess as successor trustee until another court appearance scheduled for April 5th.  It was a small victory for Dede Hess and the other Hess children, as they pray for their father's recovery. "I don't want this to happen to anybody else," Dede Hess said.  According to the National Council on Aging, elder financial abuse is likely underreported. SAN DIEGO (KGTV) - When a baby is born premature, a family’s world can be turned upside down. November is Prematurity Awareness Month. So, in recognition of that, the March of Dimes donated 50 care packages filled with everything from fuzzy socks to crossword puzzles, and tissues to parents who spend countless hours with their babies in the NICU. "Oh, is that funny?" says mom Vanessa holding her newborn. For a mother, anything her newborn does is a little miracle. "So this is our boy Ezekial,” says Vanessa showing off her little miracle. “He was 3 pounds, 10 ounces." But Ezekial is only one of three miracles. There's also sister Eleana, and little Evelyn. Triplets, three little miracles, born nine weeks premature at Sharp Mary Birch. "I spent three and a half weeks upstairs on the fourth floor, admitted. Um, it was hard,” adds Vanessa holding back tears. “I carried the triplets until 31 weeks and three days, and we've been here ever since, I'm going on about 40 days." Forty days and counting in the Neonatal Intensive Care Unit at Sharp Mary Birch Hospital. And Vanessa, with a two year old at home already, is here six to nine hours a day. "I come between 10 and 11, and I'll leave about 5 or 6. It just depends. Sometimes it's just hard to leave," says Vanessa. On this day, the March of Dimes is here delivering care packages. A little comfort for parents trying to navigate the emotional roller coaster of life in the NICU. "It's great, the nurses love our babies, and the doctors are amazing,” says Vanessa. “It's just some days are hard because this is what you come to every day. And every day I just want to hear, 'Your babies are ready to go home.'" That day will come, just like it did for Kristina and Mia. "She was born on July 31st, and she was supposed to be born on November 3rd. She was born 1 pound and 9 ounces," says mother Kristina holding her little Mia tight. Mia was 14 weeks premature. "This kind of puts it into perspective of how small she was,” says Kristina showing a picture on her phone. “That's my husband’s finger, and that's her little hand. Her fingers don't even wrap around the tip of his finger." The difficulty of having to leave your baby in the hospital, and the trust that a parent has to have in the nurses who care for them is overwhelming and at the same time, very comforting. “Yes, it is extremely overwhelming, depressing,” says Kristina. “But you bond with these people here and they become family, they really do. That's why I’m back here today to visit my primary nurse. We will always be grateful for everything they did for us here." Mia was part of a March of Dimes study when she was in the NICU at Sharp Mary Birch. Each year more than 22 thousand babies never make it out of the NICU because of complications with premature birth. SAN DIEGO (KGTV) -- Two people were killed Tuesday night in two separate crashes on state Route 54 in the Paradise Hills area.At around 9:30 p.m., the California Highway Patrol said a male driver lost control of his pickup truck and overturned off westbound SR-54 near Reo Drive.According to the CHP, the driver and his three female passengers was ejected. The driver was then run over by a passing vehicle, the CHP said.The driver, who was not identified, was declared dead at the scene. The three women were taken to the hospital with injuries of unknown severity.About an hour after the deadly rollover, CHP officials said a Honda CRV slammed into the back of a Chevrolet Silverado pickup truck that was stopped in the backup traffic on westbound SR-54 caused by the initial wreck.ABC 10News learned a passenger in the CRV died in the crash, but the driver left the scene and has not been located.The Silverado's female driver was taken to the hospital for treatment of major injuries.Both crashes are under investigation; the CHP said "alcohol/and or drugs are suspected factors" in the second collision. 1116

Their mom Rhian and her partner, Jeff Leardini, are determined to deliver some holiday cheer."There are so many families that are worried about how they're going to make it to tomorrow. Christmas is the last thing on their mind. We want to take that worry away," said Leardini.Leardini posted on the Nextdoor app an offer to buy and wrap a Christmas toy for any neighbors in need, no strings attached. Leardini, a sales manager for a pet supply company, and his girlfriend, a nurse, kept their jobs during the pandemic."We feel very fortunate and want to help people," said Leardini.During this holiday season, his family are now playing the part of Secret Santa."We just thought there are people that might be embarrassed to go to organizations, so we thought can we help them without them having to go through a lot of red tape," said Leardini.So far, a handful of neighbors have responded to his offer"It's been really emotional reading the messages," said Leardini.Some are dealing with lost jobs, others with COVID-related health issues. Those families will soon receive something extra under the tree."Want to deliver smiles to them, even if it's just for one day. Their children will be happy, and that in turn will deliver joy to their family.
