Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758

EL CAJON, Calif. (KGTV) - The El Cajon man who is accused of beating his roommate to death with a frying pan says he's not guilty. Brad Payton showed no expression as he was arraigned on Thursday afternoon in front of an El Cajon judge.An attorney spoke for Payton who entered the “not guilty” plea during the video-streamed initial court appearance since the attack, which happened exactly one week ago. Deputy DA Carlos Campbell told 10News that the crime comes with a sentencing of 26 years to life in prison.The attack happened before sunrise at an independent living facility on Naranca Avenue in El Cajon. Police say the two men were heard arguing before 25 year-old Payton allegedly grabbed a frying pan and beat the other man to death. 10News spoke to the victim's mother on the day he was attacked, before she knew he died. She said he suffered from a developmental disability and didn’t like to follow the rules, which was how he ended up at the living facility. His name has still not been released by the Medical Examiner’s Office. The county lists the property where the attack happened as a home to those with physical or mental disabilities. (KGTV) -- El Cajon Police searched an illegal marijuana dispensary that resulted in six people being detained Thursday morning.Police served the search warrant after receiving complaints about the illegal business, which is located near homes on the 400 block of West Douglas Avenue.The City of El Cajon doesn’t allow marijuana dispensaries within city limits.When police arrived, they found marijuana, marijuana edibles, drinks and cash.Police said no arrests have been made in the case, but the investigation is ongoing. 547
EL PASO, Texas - A cathedral in El Paso was vandalized while the church was open and available for prayer Tuesday morning.The Diocese of El Paso says a suspect came into the sanctuary at St. Patrick Cathedral around 10 a.m. and destroyed an almost 90-year-old statue of the Sacred Heart of Jesus, which was located in the center behind the main altar.“I am in shock and we at the Cathedral are heartbroken over such an unexpected situation,” said The Rector of St. Patrick Cathedral, Fr. Trini Fuentes.The suspect has been detained by the El Paso Police Department, officials said.“This statue is one of my favorite representations of Jesus—his arms open wide in welcome, his heart aflame with love for us. I would often take inspiration from this image as I prepared for Mass,” said Bishop Seitz. “As sad as I am to see a statue attacked and destroyed, I am grateful that it was not a living person. But a statue, particularly this statue, concretizes and connects us to persons and ideals that are not visible to our eyes. They reveal to us realities that are close to us, but unseen."Officers are currently continuing their investigation into the vandalism.“At this point we do not know anything about the person who carried out this assault, but he certainly must be a person who is greatly disturbed to have attacked this peaceful place in our city and this image of the King of Peace. I hope this might be the impetus for him to receive the help he needs.
